Since our new friend in the white Lexus showed up there has been some activity. This guy shows up and does the measuring, probably some quoting. But for what? Are they moving the fence? Are they adding to it????

    OK, so she's wanting to just move the fence... the question is, are they going to fill in the previously concreted holes and re-sod? It's not just about moving the fence, that action is going to tear up the lawn.

    If that fence is on your property, it isn’t their’s to re-use. The contractor isn’t allowed on your property to retrieve it. Let him know. Make them pay as they’ve made you pay. You should use the same fence on the back of your property. But what do I know? I’m just a vengeful dick.

    It's actually on the city's easement. Which is probably worse since the city should remove it and salvage it for the costs. The 'new' fence will also be 10' further away to stay off the city easement.

    @@charliespeegleokliving8595 A city's easement is still your property. If I remember correctly, the easement in question takes 7.5 feet from each property owner for a total width of 15 feet. I speculated a year ago about what happened here. It is common, and sensible, practice that drains be located off center of the easement. That way the digger can sit on the undisturbed ground to dig the trench to lay the pipe. So, say the pipe was laid 3 feet toward redzot's side and the work was done from the 12' on Karen's side. Next, Karen assumed that the street drain was in the center of the easement and marked her property 3 feet too far over. As far as building a fence on the easement, most municipalities allow and even encourage the building of fences upon the easement because these strips of land may become eye-sores when neither party will tend it. Plus it's still their land, not the city's. The city only has the right to use it for the specific reason it was set aside. The city is still covered when they come in and tear the fence down to relay the drain if necessary. And if it doesn't become necessary everyone is happy with the fence for years on end. I have a long hedge six feet out onto town property proper. Not even an easement. It would cost me years and thousands of dollars to replace it. But the town likes the look so most property owners in town run their landscaping right up to the curb. And all of it is subject to having a trench run through it at any time. Last year I actually went to the top of my yard and stripped the sod outside my fence all the way to the road because the town was installing a new gas line. I then relaid the sod over their cheap grass seed. None of my neighbors did likewise and are still trying to get their curbage back into presentable shape.

    @@charliespeegleokliving8595 The city has the right-of-way for an easement, but the city doesn't own the property. @redzot still owns the property, and the rest of the 'bundle of rights' which go with it. Since the fence is permanently affixed to the land - with concrete no less - the fence becomes a 'fixture'. It's no longer personal property, but is now a part of @redzot's real estate.

    FAFO, had a neighbor like them. Finally got a Order of Protection against them with threat of jail if violated. No talking or even any kind of harassment. Ordered to allow me on their side of my fence to do maintenance like trim grass, kill weeds, etc. with one day notice [state law]. They Finally moved. Yeah.

    how did you get that? I repaired a fence me and my father put up. It was crooked as hell. I spoke with the neighbor about putting in a new fence and she was happy with it. I would even put the nice side facing her. Well, she died in the middle of the repair and her daughter moved in. She seemed happy with it but the other day she was cussing me and that she should have never let me take her other fence. That fence was put in by my father and myself because a wind destroyed our fences. This was 4 neighbors before her. I was a kid when we did it and no one helped us or paid us. Not sure how she thinks it was remotely hers. curious to see how this turns out. She already started crap with the crazy neighbor on the other side. Her older daughter and boyfriend are awesome. I feel like she might have had a drug problem in the past.

    @@MaSter-mw3rb I had a neighbor think his fence was mine and wanted me to replace it after his dog damaged it. I had to explain to him that way before he moved in I matched my fence boards to the ones on his yard because I didn't like the ones on my fence when I moved in. He said it had to be my fence because the boards were on my side. But every fence on that side of the street had the boards on that side because the rain blew on that side and the fence would rot sooner if the cross pieces were always collecting water. He replaced it, but insisted that I not be home when he did it, and he moved one of my security cameras when he did it and did not put it back where it was pointed. It was such a happy day when the "FOR SALE" sign when up in his yard.

    In my State you are allowed to build a fence in the easement but you can't get any reimbursement when the utility damages it. My neighbor is learning that now after fiber-internet was installed & they chose to dig a hole for a junction right up against his fence. The utility workers didn't even fill in the hole & they just left his post & concrete exposed which makes the situation even more of a nuisance as it is deep enough to possibly require railings.

    Before I retired form metro I saw several property line disputes when I had court cases. Metro is never going to take sides or establish property lines. That is what certified surveyors do. They have access to established records from when your subdivision was built, that include each land owners property. Generally speaking, fences can be built in easements as long as they do not interfere with what the easement is there for and with the knowledge that the utility or other easement 'provider' can come in and take those fences down to work in the easement area. Nothing can be considered 'permanent' that is put in them.That's why I tell to people have plat maps of their property parcel. It has all of your property dimensions on the front, back and sides.These are done by surveyors when property is developed. If you didn't have plat maps you would have property line disputes everyday.

    Our city allowed me to put my rear fence 10' into the 20' easement. There is drainage back there that goes from storm drains to the ponds. So if they need to work on this they can still do it without having to move my fence.

    Hubby and I bought a house in 2002. The guy who owned it before us told us he and the next door neighbor had a fencing dispute much like this one. Apparantly the difference was so great that the yard that our property gained was enough to park two maximum sized RV's abreast. It was weird to move in to a property that was formerly disputed. But luckily the residents of the neighboring house didn't extend their bitterness to us. They still had a good sized yard, but our yard nearly doubled.

Came home one day, new fence right in the middle, lost 4' - with a gate into my yard. Hubby took down the gate and installed a panel. Neighbor was NOT happy. Had ALL KINDS if trouble with them. But she worked for the city... so, we moved.

    Original cost of the fence with the added loss of a friendship, all the fighting plus the cost of moving the fence.. That cheap fence has really turned into an expensive one for those people. I know that the fence being moved off your property was your goal but in reality, they should have to repay you for the second survey and the resetting of the pin that she ripped out of the ground. I hope a video of them moving it is coming soon.

    That fencing is not on their property, so therefore they CAN NOT use that fence!!!!! NOT UNLESS YOU ARE WILLING TO LET THEM HAVE IT!!! They still are NOT thinking through things!!! Their Lawyer should have told them that even though they bought the fence and had it installed it's not theirs anymore!!!! They lost it as soon as they installed it on the wrong property line!!! I'm sorry that this has gone on so long and taken such a tole on yourself and the misses! The one a**hat neighbor we had sold up and moved out, the people that have the house next door that moved in after the A-hat sold out is absolutely wonderful!!!! We get along great with them! So HAPPY TIMES around here!!!

Talk to contractor about pending litigation let him know about bucket of worms he's about to step into and how no work can be done until the court rules or he may be back doing it again for free.     I mailed them the tape ruler last year. They could’ve measured like what they did. They never measured corner to corner. They were measuring from their house. It’s very basic stuff. Unbelievable. They could’ve proved it to themselves. But they couldn’t even figure that it. To complicated to measure in a straight line. How sad

    Hey Z, assuming they even try to move the fence at this point.. isn't it on your property, and by proxy, now your fence? Knowing its potentially about to be moved, you should at least consider sandblasting it and cause them even a greater financial expense to get it back to its original state

    Where I live you can build a line fence but if the city/utilities need to use the easement they can just rip it out.

    You can't fight a survey. Pulling the markers is only a small fine in my area tho. It's clear they realized they couldn't win. I would go after the company who put up the fence as well.

    You should notify whoever has the easement and let them know what's going on. State law varies, but you could be the owner of the existing fence as it is permanently installed.

    I made a video about that but in short I actually found the department that manages easements in Nashville and they gave no fucks. I went down there to talk to the guy and just see if maybe he'd write a note or something he basically told me to get out he didn't have time to deal with shit like this.

    I expect all contractors to show up with a notepad with the survey in it. A legal document to use for HIS measurements and HIS quote. Or maybe he doesn't worry about it until the actual planning begins.

    First time I'm seeing that back corner.... her original issue being that their fence couldn't end in the concrete culvert.... it looks like it would have ended a couple feet short no matter where it was and could have and should have been built in the right place in the first place, no question about it.

    In the 2nd video a contractor repeatedly says you can't build on the easement and it's 7.5ft on both sides of the property line. New fence will be 10' further away.

    We too have popcorn and snacks at the ready...Joanne-schmoanne is going to have her neighbor's fence (she had it built on HIS land) taken down and it WILL BE recorded on cameras and put on the internet for all the world to see that SHE WAS WRONG ALL ALONG AND SHE ACTED LIKE A DAMN FOOL, A CHILDISH LITTLE GIRL AND A FULL-ON WITCH THE WHOLE TIME! No one is sorry to say that the woman is a Krazy Karen and just nasty because honest people call things like they recognize them. ;)

    How many times do you need to be told you're wrong all contractors tape measures all measure the same does she think one is going to be about 5 feet longer than the rest just move the fence silly woman and your dog loves your neighbours so move the fence and give him the dog obviously want to be on his side of fence even the dog don't want to stay with a Karen

    I have thought about obstructing any efforts to move it. Then however I thought differently. Depends on who they hire I guess.
