    They won’t get reimbursed for the surveys because they benefit from the survey as well. But they can recoup the legal costs.

    i remember someone else in comments pointing them out when they had a survey down and there was a view from the street back. no one sticks bushes randomly in the middle of the yard so that makes sense

    I think this might be the 5th or 6th time they've been told, and shown, where their property is. They have hidden, dug up, and destroyed every marker and line, for the past several years. Ever since the fence went up on somebody else's property. They DUG UP the cement marker that was installed. DUG IT UP!

    Not just that the fence is 2' over the property line, but that there is a 15' easement centered on the property line. That means the fence needs to be moved 9 1/2 feet and the bushes planted in the easement need to be removed.

    Don't go soft on the settlement, even if the do relocate the fence. Remember the damage to your car, remember their threats, remember their harassment, and remember your anxiety and lost sleep over the whole situation. Don't just make them pay for your legal and surveyor costs - make them pay for EVERYTHING.

They gave him hell, they had their car windows smashed, the costs of the surveys, the lawyers etc...when all they had to do was listen. All of this is on them. Plus they implied bad things about you!! She probably still doesn't believe what this guy is telling her either. Smh

    Have an attorney assess a ‘rental’ fee for your property that you couldn’t use because they tried claiming it. It’s great together your property back, but you’ve been deprived of land you paid for for this long, demand to be compensated.

    I think this contractor has two things going against him. 1. He earns "White boy money" 2. He's not telling her what she wants to hear. I bet their lawyer sent him for a reality check. He's been more than happy to milk them for as much as possible, but he's even getting tired of her

    First guy was probably a good contractor and has plenty of work. He quickly realized the homeowner messed up badly and he just left to stay away and not get involved in it. Lucky bastard! 2nd dude showed up with knowledge and a knack for explaining things.

    If this contractor had come out so long ago, almost none of these issues would have happened. He seemed knowledgeable and tried to talk to them about proper boundary lines.

    I don’t think they or she will except his word either. Remember, they pulled up the markers that were put in by a survey company, or 2. She doesn’t want to accept the hard facts in black and white legal print. She would rather listen to a friend that doesn’t know what the hell they are talking about.

    She knew when they put in the water main or sewer line, how and where that easement was. When the new people moved in, she decided to take the easement and maybe a little more. Properties that have these easements are usually cheaper to buy and must be disclosed to a buyer.

    Man, they sure are turning this into an epic saga. What's so important about a miniscule strip of grass? My neighbor wants to replace her wood fence with a block wall, an i told her they could tear out my chainlink and use the concrete base for it. Who cares about inches? It just that much less to mow.

    I think she has finally come to realize that her side yard is going to get much smaller now. Here where I live, I was told by the city that I could put a fence up, across the easement my property has. If they have to come and work in that easement, the city will take down the fence and will not be responsible to put it back up again.

    My old house had the fence on the property line, right dead center of utility pole easement....been like that since it was installed in the late 70's when house was built. Thankfully over head wires didn't need fence torn down if worked on.

    Were in the country and have to get to our property through an easement. Legally we have to keep a 70' easement road for another property owner to be able to access their property too. It is also for emergency vehicles and electric company. Sounds like same thing here only not sure how wide it suppose to be here.

    She needs to realize that because of the easement, there is 7 1/2 feet on each side of the property line which cannot be built on except perhaps a shared driveway subject to being dug up by the utility.

    @@Imageloading...That’s not true. You can install on the property line even in an easement, you however must provide utilities with access when they request it and if they accidentally destroy the fence in that area, they are not responsible for it.

    @@Imageloading... It’s something you should look into because the information about what you can and cannot do isn’t understood correctly by everyone. My neighbor was mad that I built close to the property line and tried to cause all kinds of trouble for me but the county just laughed at them. A fence in an easement is generally fine, something like a shed, is not.

    I install fences for a living and have for over 40 Years. It's a lot more expensive to have a fence taken down and cement broken off the posts and moved than to have it done right the first time. 2nd contractor knows what he is doing and it will be much more expensive. then the first one. I bet they will go with the first one out of the two. I wouldn't even get involved in this dispute, it's not worth it for me unless I wasn't busy like in the winter. Can make more money and less labor on installing a new fence somewhere else. BTW have been watching this since the beginning

    @@jilbertb I heard him say the utility easement is on Redzot's property and the span of the easement is 15 feet, so it is 7 1/2 feet on each side of the telephone poll. She pulled the original property stakes from his survey and threw them away. She is just a nasty old person and her husband is afraid of her tantrums. Can't wait for the day the fence has to come down.

    I said the same thing as this surveyor when we talked a few months ago. He said he’d reconstruct to subdivision in order to correctly verify the line. Your neighbor is screwed

    They would def have to move the fence in order to sell. But I don't think they're moving. I think it's their forever home and they've finally accepted the reality of the situation. Can you imagine building a fence with some realization that you were making a mistake doing it without a survey, going scorched Earth on a good neighbor relationship because they tried to tell you, and now accepting your fate of losing I don't know how many square feet that you never had in the first place? And that doesn't even factor in any punishment or reimbursements. lol damn lady.

    No realtor would touch this mess. Everybody involved would get sued (including the realtor) if someone bought a house with an on-going lawsuit, especially when they are clearly in the wrong! This isn't a 'nuisance' suit! This suit has merit.

    That surveyor is being very PC; asking questions he knows the answer to. In nearly every state surveys are registered and available to the public. We know for sure your previous survey is. He’s opening the conversation but he can already see what’s going on. Makes for a great video😁

    Oh I like contractor #2. He knows his stuff and tells the blunt truth. It was great to see the little dog again. I worry about the little guy. I also enjoy your birds.     That utility pole and the wires holding it in place should have been her first clue that that area is not her property. I've never seen a city easement less than six feet in width either. She should have know that her property is not right on top of that utility pole line. Just look at the bushes planted in her back yard. Those were planted on the edge of her property. From those bushes to the utility pole "invisible line" is not her property, that's easement, and she knows it.

    These are absolutely malicious compliance type of people. Don't let them on your property to remove it. Damage will "accidentally" occur. Wait until the court inevitably rules in your favor. Then request a court order that states you will hire a contractor to remove the fence, and they will pay the bill. Get two quotes so the Judge sees you aren't trying to rip them off. Return the fence to them as good will, with a stern warning and fair notice that if it is put back in even a millimeter on your properly, it will be removed and scrapped to cover the second removal cost.

    When you win in court, and we all know you will, I sincerely hope you get awarded all your legal fees AND the pin resets for BOTH surveyors. And absolutely remember, YOU helped these people out in the pandemic, they called you part of their chosen family, you were nice about EVERYTHING you had any interaction with them on, they forced you to have to go the hard route. If you forgive them, please don’t forget they turned on you. Viciously. Forgive and forget: forgive them then forget about them. They are takers.

    I would hire this guy. He clearly has knowledge and patience. He took the time to explain things in what looks like simple terms they should be able to understand. He clearly recognized the errors. I would trust him to do the job correctly. But then I have had crappy luck picking contractors for anything.

    Those neighbors made things difficult for themselves by not following the rules , building codes , and using common sense . It seems they think they can do whatever they want because they’re property owners !!!

    Been following this international incident with interest from this side of the pond. Been very entertaining for me, but I can only imagine how frustrating it's been for you to have to deal with and waste your time on. Totally unnecessary extra headache.     Now she will blame it all on the fence guys for putting the fence up on her neighbors property, while she actually stood out there the whole time and told them exactly where to put it and when the neighbor told them they were on his property she screamed and screamed.

    It’s not a realtor they have to worry about. The county won’t record the change of ownership if there outstanding issues, such as non-permitted construction, or known property encroachment.

    While there is a lawsuit ongoing, they would never be able to get new title insurance. No mortgage company would give a mortgage without title insurance.

    where i live in oregon, when i put my picket fence in, i had to offset my fence to be at least 2 foot away from all sides of a power pole thats at the edge of my property. their original fence wouldnt fly right from the start, and the fence companies know the rules.

    "Your neighbor's property.... It's not yours." Followed by explaining the easement: 'Their' property but they can't build on it. Betcha the 'friend inna Lexus' was their attorney. If so, appears he had a come-to-Jesus conversation with them. How much time, money & grief would have been saved (by YOU) had they simply listened in the first place. Can't change that, just ruminating on it. I hope if they do move the fence, you're able to pursue relief for your legal expenses & other direct costs (McK's car damage & ?) plus SOMETHING for pain & suffering. Money never fully compensates for that but is better than nothing / more insults. Looking forward to the fence getting up and walking closer to their house (with help).

    They can build in an easement all day long. A utility can tear up their work then seed and straw all day long also.

    No you can't build on an easement, for one simple reason, she does not own the easement.

    Clearly contractor #2. He showed her the property line, explained how an easement works, and even showed her how far she'd have to move that fence. Good job! At least I think so. Audio was hard to make out sometimes. That said, I never understood people that try to steal something, then attempt to justify it when they're caught... and get mad at their would-be victim when they aren't allowed to keep what they tried to steal. Like it's their victim's fault. smh PS I also don't understand why it's taking so long to get that fence off your property. Surveys were done. Property line is even or record. The easement is surely on record. Should take five minutes to review and then order the fence removed... but yet it continues. Great drama though! Wishing you the best!

    I used to be a fence contractor. In the city/county I worked in, you could put a fence on the property line in an easement. If they had to come and work in that easement, they would remove the fence and replacement is on you.

    I've had a few people do this to me over the years. Set up a meeting and proceed to pick my brain for ideas and even when I tell them it won't work or isn't legal they continue on and on. I think she's just trying to find someone to talk to lol

    I think the fence is going to disappear or get moved soon. For either 1. Lawyer says they are in the wrong and coild get ugly. Or 2. They are looking to move and need to clean up the mess. Either way i agree someones getting hired.

    I hope she goes with the second guy. He seems like he's experienced and knowing the situation, wants to make it correct especially in regards to the easement. Their lawyer has already made them realize the error of their ways. Too bad it cost them everything. I'd love to know how many square feet you'll be reclaiming once it's moved.

    I think the guy with the nice car, that was there previously, might have been the Lawyer. He probably evaluated the situation and sent this Contractor to explain it all to her and give him a full report. The Lawyer will tell her at a later meeting, that this case is not worth going forward with. ...I had argued with people in the comments months ago, that the fence should not even be on the Easement at all, and obviously not on your property, The Easement is Government property.

    Yeah. My hope is that they move the fence to where it's supposed to be not where she wants it. She wants it on the property line. Well we can't always hear the conversations that are happening you can certainly tell by the body language. I got another video coming out tomorrow where that's exactly the case.

    I think she will get another contractor out there for a quote. Then she will decide. I believe she will definitely move the fence, but will do it right. Otherwise, she knows she will owe you more money! ✌️
