Hello, my brother was denied for having a noticeable physical or mental disability (including alcohol abuse or domestic violence) and was instructed to file a waiver or get reevaluated next year May 2022. What do you recommend? Should we apply for a waiver?

The same situation happened with a family member of mine. She had committed fraud and had to file an I 601 waiver but her lawyer only filed 1 i-601 was it supposed to be 2?

I’ve been married to my Mexican wife for 11 years. Around 5 years ago we applied for her green card went through the waiver she got the appointment to go to Juarez for an interview but the waiver had not arrived. We decreta she should stay because we fear she was going to be left there or punished for not having the waiver approved. Finally we received a letter from UCIS stating that they had reason to believe that she entered the US illegally again back in 1998. For reason we never pursued the issue again. Do you think she has a chance to re apply again? Please let me know.

Hi sir,what of 601 waiver is deny what can one do?

My wife was detained by border control while entering the U.S. without inspection. Then she claimed asylum (on the same day she entered) and was released to her parents after a few days in holding. While her asylum case was in process we got married and filed the I-130. During the asylum final hearing our lawyer recommended that we withdraw the asylum petition, which we did. My wife was given voluntary departure. We left the U.S. before the 120 days had expired. Our I-130 was approved while my wife was in Guatemala. We now have a meeting at the U.S. of Guatemala next month. Would we run into any issues because my wife entered without inspection?

Is the backlog with 601a going to decrease under Biden Administration or will it stay like this? It changed from 13 to 31 months since I filed. Is it better/faster to go back home and file 601 instead?

Dear Sir, Please advise me ,after my wife's I-140 is approved she has to go to her country and get the green card. My wife having a penalty for serving more than 180 days without permission is subject to 03-10 year time bar.I have all the family on an A2 visa at the embassy. My daughter is in college and my son is in grade 09. In this background, I would like to know When there is a possibility of returning without being subject to this penalty on I-601 or any other option to bring my wife back to the USA or before cancel the A-2 visa. Mr. Gray, what's the reason for a family member on a family-based petition to be removed from the petition list even though they were declared when they were very young 20 years ago. I do get it that they are over 21 years old now. but when the approval for the family-based petition letter was received I paid the fees for the over 21 family members but were still removed from the list. CEAC said to wait to get interviewed and the consul will determine if the over 21 years old sons and daughter of my brother can come to U.S. my dilemma is I couldn't even access and update anything for their names cause they are deleted.

Are you going to talk about the American Families United Act that just came up. This would be a huge benefit for mixed status families who cannot adjust their status because of the permanent bars.

Dear Gray-law. I live in USA for over 13years. I have 3 children who are minor going to school. I have been in student status or working with opt since then. However my most recent opt is expired and had to leave the country to avoid an illegal stay. I am back but can only stay for 90 as a European citizen. Do you think I can use this 1-601 to adjust my status to green card. If yes, how. If no, what other options will work for me because I want to be in status and stay with my children. Hey GN Sub...I always answer your question first!!! You can indeed request an expedite, but it should be based on a good reason ie your beneficiary needs surgery in the US or something like that.

Ankita it is hard to know why they may delay your case, but you can go to immigration and make an info pass!

If you aren’t stateside, back in your country(Colombia in this case), is the I-601 waiver still taking 12 months of more to be approved?

Great question....the I 212 is for fraud and misrepresentation. The I 601 is for being illegal for more than one year. In some cases you nee d both! That is a very simple answer.

My sister filed her I-539 in april 2020 dure to corona couldn’t go back she asked for 3 month extension but her I-539 got approved in march 2021 and came with those 3 month extension she is still in usa with her pr holder husband ? Can we go for waiver thing

you can, but at the end of the day the PR will need to become a USC if your sister stays in the US.

No. One lawful entry they can adjust under 245a

My question is are they going to reduce back to 100 questions for the citizen it's no 128 questions and I know that there is a lot of American doesn't know even 10 of the citizen questions

For applications filed after December 2020, there is a new exam 128 questions. You will be asked 20 questions and you need to get 12 correct.

It should take about 18 months. One year to get the approval and 6 months for NVC to process for the interview.

On January 2019 my daughter left USA after 14 months over stay on visiting visa..since 2013 my daughter visited USA 2 twice n left on time after 1month vacation. Now everything is approved .They wanted a police report from Srilanka.we submitted it in December 2020. Now im waiting for a reponse. Sir i wish you can answer me. We file a green card application thru my eldest son is 21 year old US citizen. My question is, can my youngest son who is 13 year old can apply a foodstamp, BUT, the representative is under my name (as a mother). Is not can affect our green card application OR is this PUBLIC CHARGE. Were are not planning to include my 21 year old son, ( who petition us) thru one of the household.
