    Honestly I feel like Kim Kardashian should just sue everyone because I feel like music wasn’t even really a thing until her song My Jam (Turn it Up) came out. It really changed the game for music, and is definitely one of the best songs of all time, and honestly the whole industry owes a lot to her.

    this has gone so far that Taylor Swift is getting sued for "stealing" a line in Shake it Off: "haters gonna hate." that's the whole line. she's being sued over three words by someone who claims to have invented the phrase. this really sets a terrible precedent. imagine if writers could sue other writers for using the same three words in the same order. literally insane.

    Awesome vid as always. I do think some (probably most) music lawsuits are silly but I do think some are justified. Mainly in the case of out right STEALING an entire melodic phrase from another song or piece. The main song that comes to mind is H.E.R.'s song "Focus" which used the EXACT same melody line used in pianist Andre Sims musical piece "Endless Minds". Andre posted his song to IG an entire year before Focus came out, plus Andre found footage of a producer talking about how he was scrolling through IG when he was "inspired" for Focus. All Andre wanted was producer's credit from H.E.R.'s team but they repeatedly ignored him, which led to him suing and it ending in a settlement.

    i’ve heard lesser-known songs “sound like” a bigger song. but the artist of the bigger song doesn’t sue them. so what i get is that these suers def want a share. get the bag i guess

    Its because publishers and editorials know that they are not making a whole lot of money of the songs, but if the song starts to attract a lot of attention and significant amount of money is coming in, they will definitely sue.

    As an independent artist I strongly disagree, Label artist can sample or steal anything w protection from their label, try to rip off a label song and post it on spotify or soundcloud, they'll strike you almost immediately.

    RiP: A Remix Manifesto is a great documentary on this exact topic, made by the National Film Board of Canada. It highlights a lot of different issues including how Disney extended copyright protections to last 70 years after the artists deaths. It also features Girl Talk, a mashup artists who's song's are created only using samples. They're like beautiful mosaics that make more sense as you get older and understand more and more of the songs referenced.

    for me the copyright system is just stupid just because you own a song does not mean you got the notes. if you have listened to a lot of songs or you are composing a song you will know that all of the songs must have something in common. in fact that fly me to the moon sounds like a part of "fugue bmv 565" and "la campenlla" and "symphony no.5" which sound entirely different. for me it is impossible to listen to any music with out it remembring me of another song. so in brief yeah it ruins a lot of music. musicans who sue people for there music that sound a bit alike just want money.

    What sucks is the creep of what constitutes theft. Lyrics?....whole melodies? sure - these are no brainers. I'm glad you brought up the Blurred Lines suit at the end because you are correct - that opened the floodgates. Who defines "vibe" and "feel" of a song? I really think that suit in particular was the major labels' answer to independent artists leveraging the web for distribution and marketing. Just as it became feasible to have a career as a musical artist without bowing to a label, now every indy has to live under the threat that if their new hot song gets too popular and starts generating some duckets, it will be discovered to have the same "vibe" as a song in Warner's back catalog. And with labels investing primarily in buying catalogs instead of artist dev.....I don't think this fact was lost on them. Just patent trolls with a treble clef logo.

    Thank you so much for making this video the last few minutes are perfect I couldnt have said it better. Are music lawsuits killing creativity? Short answer yes. Long answer ive never understood why samples need to be cleared or why music lawsuits ever existed in the first place. Music is a safe and creative space. Very few maniacal and sinister business people are looking at music rn like a devious lick. No one is saying oh im gonna start making music thats the most profitable industry in the world. As a small artist you might make $20 on your first 5 albums. And as a big artist you might make millions but be forced to deal with inevitable law suits and backlash for any new work you put out. A successful music career is not a cash grab or a career choice necessarily but a dedication to something that most people would see as impossible. This is what makes it an art form. Musicians are against all odds and people in the industry still have the audacity to treat each others work so poorly. By now there shouldve been laws in place defining music as free range and allowing anyone to profit off of anything that flows through the industry. Sadly we are still in 2022 and nothing has changed. Im still afraid to drop my next project without clearing any of my samples bc you never know when its going to blow up and be torn apart by the industry. I really hope in my lifetime people of all ages will grow tf up and understand how short of a time we are actually here for. You have roughly 80 years to make something of yourself. When you die, allow people to use your work as reference. It is afterall the most honorable thing you can do with someone elses work. Wether you profit off of it or not is determined by your skill and the ability to market yourself, not by the substance of the sample or stolen melody or how good you are at suing people.     @@ApolloMclaren I think that's a bit optimistic. The majority of people can release whatever their heart desires anyway. In the grand scheme of music, the amount of lawsuits is quite minimal compared to the potential evil done by people taking advantage of the system. Also, consider the songs written by committee. Popular songs would become awful. Oh that record label produced a super-successful song? Let's just use the exact same tune and beat and put our vocalist over top. I feel like if you're making your own music that is at risk of a lawsuit, then it's not your music (for the most part). Surely you couldn't get the satisfaction of creating and releasing your own art if you and other can just steal whatever other people make, where's the creativity in that? The lawsuit is definitely abused by some (although success is rarely achieved in most cases such as with Katy Perry) however it protects so many people. A large artist could hear a song from someone with 20 listeners, and completely rip it and get millions of dollars for it.

    Don't forget the small artists that get sued by big labels. Even the examples you give were all just big artists vs. big artists. The only small artist you named was the sue-ER in a case. There are many examples of small artists who get fucked over by big established artists who are signed to big labels. Just look at all the difficulties rappers have to go through to use a fricking sample. All of this is just nonsense; just a way for big corporations to commodify art, so that everyone has to be signed to a label in order to make making music profitable for themselves. And in this way they can profit off of other people's work under the excuse of "well, but we provide you with lawyers and PR and such". Like, all of that stuff wouldn't be necessary if labels didn't exist in the first place.

    yeah idk, olivia and paramore might be a rip. its the same chord progression in the same genre with the same lyrical theme and a similar vocal style. while i completely believe olivia and her team could have originally created this, paramores song has so many plays in the past decade, that i think its undeniable that olivia and her assists were subconsciously channeling something they’d heard

    No way two young female pop punk singers sound the same 🤯 I genuinely think no one would call it a rip off if she didn't sound like Hailey. I joked once that it's not a rip-off, but it's the same song because of the vocals. It's hardly impossible that that's what they had in mind but it's also very possible that it's just an extremely simple hook.

    The vanilla Ice thing opens up a whole different conversation about copyright with regards to sampling. Such as Frank Ocean's frankly disgusting sampling of Hotel California for 'American Weeding' which he did not have permission for and completely butchered. Then there's Pharoahe Monch's 'Simon Says' which had an uncleared sample of the Godzilla (1954) soundtrack. The ensuing lawsuit effected Pharoahe Monch's career in a way that he was never really able to recover from.

    Another interesting musical lawsuit was between Breakbot and Bruno Mars over the songs “baby I’m yours” and “treasure.” Basically Bruno Mars asked to cover the song, Breakbot said no, and then proceeded to make “treasure” which uses a lot of the same elements as “baby I’m yours.” I don’t think the two sound strikingly similar, but Bruno Mars did ask to cover the song and then was denied so I believe the lawsuit was warranted. Breakbot now has a writing credit and gets royalties on the song.

    I think the music theory-sphere is very inconsistent and selective on what constitutes infringement. The Vanilla Ice lawsuit was based on nothing but two notes and the placement of those notes. Did he rip off that bass line? Unequivocally, yes. But that has been a staple of rap music since its very inception. Especially at the time that this happened. A lot of rap artists and groups sampled things directly from albums. The Beastie Boys, for example. Tone Loc sampled Van Halen. Rappers have sampled a myriad of artists from every possible genre. And I _still_ think their songs are more original than Dua Lipa’s song. Not only is the progression the same, the lyrics are similar, the rhythm is the same, the feel is the same. The vocal delivery is damned near the same. The only thing that’s different is Dua Lipa and her band of merry writers and producers know how to produce a track better. There’s no convincing me one of the five writers of that song didn’t happen upon the track, or perhaps a live performance, and took a little too much inspiration from it. It’s the most reasonable lawsuit of its kind in a long time.

    That coi leroy video on Snapchat is a joke. People are allowed to dislike artists haha. You don’t even address her music you just talk about the comments. Her cypher was bad she barely said words maybe that could be a reason the comments were mean.
