I always give them the necessary documents (licence insurance registration) as for their intrusive questions they are intended as psychological manipulation and i don't answer period i dont tell them my personal business (where im going where im coming nothing personal etc) simply ignoring the questions works just fine and of course when they become persistent and ask why youre not answering their questions ya simply say that its not relevant to the stop and that usually ends them attempting to coerce you to tell them anything they dont need to know without the red flag trigger words like i dont answer questions

The road side test, I have declined but I know I will have to go to the station and have breath or blood test, the difference is I trust the properly calibrated equipment over the road side test. The total lack of training I have witnessed in road side testing staggers belief.

The second you say a word to a cop you are giving him evidence that will immediately be used against you. He can simply say you slurred your words right when you open your mouth. THIS IS NOT CONTROVERSIAL. Do not talk to cops. Not even one word. Write down you invoke the 5th and give him documentation. Why can nobody figure this out? It’s so simple.

Being contentious at the very beginning means you’re ok with getting the ticket, and do not want the office to consider giving you a break. My experiences was that by being courteous they had let me off or downgraded the offense. But guess if after they gave me a ticket and then they are still fishing, then can follow these advices.

This is very dumb advise. You never reach for your stuff before the cops get to your window. They will then claim furtive movements, get you out of the car and then search anywhere you can reach.

Truth is whatever you do don't make the officer uncomfortable. Turn lights on roll windows down hands in plain sight. They are typically very nice if you do that. Don't lie and remember they want to go home just as bad as you. You get more bees w honey and ask far less questions. Trijicon sticker prevents them from asking if I have a firearm on you. Some things don't need asking .😛

My family grows massive amounts of CBD from hemp plants. I do not mean a few pounds I mean metric tons. Now I smoke weed with high amounts of THC do to chronic pain. If he would have said this is Hemp the cops could not really tell the difference unless they sent it to a lab. By stating it was Hemp it would have been legal to have any amount on the person. However if you want to have that examined send it to the DEA or Homeland security even Customs can tell you what it is. I know that from being behind the veil inside the Customs operation centers in several major American Airports both as a civilian and as law enforcement capacity. They have labs that test everything from bugs and insects to fruits vegetables and narcotics. Also just a FYI for all you who use the Airports. The camera systems are so advanced that while you are looking from the top of the Terminal you can read what a passenger is reading on a airplane while it's idle. So if you think your getting away with something your not they are letting you go so they can see where you lead them for the police to take over for people acting suspiciously.

I guess if your going to do something look it up to see if it is against the law. Then you do not have to worry about the government. When going into a different state it is always good to look up their laws procedures for out of state citizens and visitor's. Some states if your out of state make you pay fines right their on the spot. Minnesota and Wisconsin used to be that way towards one another until Minnesota's Governor had enough of the Minnesotan drivers getting ticketed for minor offenses directed the state patrol to pull over any citizen from Wisconsin for anytype of traffic violation no matter how small. Until the Governor of Wisconsin decided to enforce speeding and several other traffic situations and then allowed to leave after paying the fine. I remember going through that as a young boy since my cousins lived in WI and I saw them weekly and we got pulled over in Hudson all the time for minor traffic violations and back then they did not have to tell you why they pulled you over. Now under MN law they do.

I come from a family of police officers. I am perfectly comfortable with having a basic discussion with officers in my state, county and city. Remain calm, polite, cooperative and honest and there should not be a problem. If I was speeding I simply admit it and move on with whatever the officer decides. In my 50 years of driving I have been pulled over perhaps six or eight times and have never been cited even when I was wrong. Being polite, cooperative and honest works. Driving a clean, neat car and looking like an upstanding citizen may also help. And, don't drink or use drugs.

"Should I call my lawyer?" If memory serves me, that isn't quite good enough as it is equivocal, at least under the recent SCOTUS decision on the Fifth Amendment claim making it clear that the Fifth Amendment is not invoked by a suspect until it is expressly cited as the basis for not wishing to speak further.. Better is a direct statement that "I don't wish to speak further with first consulting my lawyer."

In Canada, you don't have to ask if you have been detained ...as soon as a police car lights up his emergency lights behind you, is the EXACT moment of your detention. Also, in Canada, you do NOT have the right to call your lawyer while stopped on the side of the road for a traffic stop. You cannot call your lawyer BEFORE any roadside tests for drinking are performed, but if you fail the roadside test and are then taken to the station for a more thorough test for BAC, you are THEN allowed to call your lawyer. The reason you are not allowed to use your phone while being stopped in Canada is: You possibly be calling for BACKUP in case you plan on eluding the police officer, or attacking the police officer. Also, if you record the police officer during a stop and anything happens like he pulls ou out of the car, there is a scuffle, etc, the police officer can confiscate your phone because it holds data of a crime, a crime that you committed or any crime in general. They keep your phone, they then call the Judge and get a warrant where you MUST give your passcode to open the phone to retrieve ONLY the data of your police recording ...and here's the killer ....it takes about a solid YEAR before you get your phone back and they will NOT give you your SIM card so you can use another phone ... Cops win, you lose. If you enjoy recording cops in general, or you are one of those people that record protests in public, or anything happening downtown on a Friday night ... BUY A BURNER PHONE WITH NO SIM CARD.

Wow ....not in CANADA. Cops here can stop me for NO reason, give me DUI tests right there on the side of the road, I cannot refuse. They can check ALL of my car for anything not working, blinkers, brake lights, etc. Demand I blow into the 'mini" breathalyzer and if that number is between 0.05 and 0.08, I am NOT charged with DUI, BUT I am taken out of the car, taken to the station, my car is towed and stored where it will cost about 1000 dollars to get it back a few days later ...0.05 to 0.08 is TWO BEERS ! (maybe 3, I'm skinny). Now that weed is legal in Canada since 2018, the cops can ADD your numbers to charge you with DUI .. They can take a blood sample and if your blood is 0.05 for booze and 0.03 for THC, you are charged with DUI .. They convert NANOGRAMS of THC to an equivalent number to add to your BAC ... so, 1 beer, maybe 2 beer and a little puff on somebody's joint outside the bar, and you are charged with DUI. And to add insult to injury, if the cops have REASONABLE SUSPICION that you have been driving under the influence of alcohol, they can come to your home up to TWO hours later, and DEMAND that you give a breath sample. Reasonable suspicion here means that it just can't be a 911 call that you were weaving across the road, it would have to be something like you were drinking in a bar and the cameras recorded you drinking, the cops get a call from the bartender saying they say you get into a car, the cops show up to the bar, see the recording where you indeed were drinking, and they get your plate number as you left ....THAT is reasonable suspicion ...so don't think cops in Canada are just kicking in doors and sticking breathalyzers in Canadians mouths because you walked out of a restaurant that serves booze. You HAVE to roll your window ALL the way down in Canada, or it's obstructing a police officer in the course of his duties. He is not to be subjected to yelling at your closed window during a traffic stop. One question that you HAVE to answer in Canada is when you are asked if you have been drinking ...if you say nothing, that is deemed as silence equals guilt.

In my little NE town, we have 4 traffic lights along the about a 1/2 mile main street. I got pulled over recently in my pick up for running a red light. As he approached my rolled down window I just looked at him and said that I did not run a red light, that it was yellow upon entry. He just looked at me and went back to write me up a warning for speeding. Since it was a warning I didn't make an issue. But there was no way he could have determined my speed from his hidden location around the corner, and I know I was not speeding. My question is, What is the legal time delay for a yellow to turn red? And where can one find a compendium of local and state traffic laws? Also, any recommendations for cameras?

Wrong - give license, registration and insurance. I invoke my right to remain silent - repeat as needed Am I free to leave? - Repeat as needed. I do not consent to searches or roadside sobriety tests. Am I legally required to do RST? Repeat as needed. RST falls under 4th and 5th Amendment protection. [?] - He tells you to get out of the car - Is that request or a legal order? Am I legally required to do a breathalyzer? Repeat ... If order, get out. If you haven't been drinking you might want to do a breathalzer depending on your local laws. Ask if you re legally required as well as RST. He might want to jump right to RSTest. Ask why not breath first? NOTE - If he skips to RST it means he knows you're sober but has decided to arrest you anyway to fill his quota. Most sober people fail roadside acrobatics if the cops have already decided. Putting on their rubber gloves on is a major clue. Am I legally required? Will you arrest me if I refuse to do roadside test? If arrested, insist on blood draw at a hospital as long as you're 'clean.' Follow these steps and you have a very good chance of beating it in court. Be assertive but not hostile or aggressive. Fight in court, not at the road side. You might even have grounds for civil action. Build your case on your phone and his cameras. Lawyers know a slam-dunk case and most will do it on contingency. Please give complete, correct advice, counselor.

First things first. Expect to be pulled over for a traffice stop. Therefore have your "valid" Drivers License, car registration and proof of insurence readily available, maybe sitting in the divided area between the seats. Pull over as far to the right as possible in a safe area. Roll down the drivers window and place both hands on top of the steering wheel.. The Officer is running your lic plate so it may take a few minutes and she/he may or may not be waiting for a back-up patrol vehicle or motor Officer to show up. Give the officer/s time to look in the windows and see your hands. Don't answer any of the opening questions. When asked slowly reach over and get the requested drivers lic documents and hand them to the officer. Nod your head yes if asked "is this your current address'. If asked my the Officer. "may I search your car" answer "no you may not search my car". At this point when asked you sign the traffic citation and he gives you back your documents. This signals the end of the traffic citation and she/he may walk back to their car. Other things. Do not talk to the Officer about any meds your taking or if you have had anything to drink. Get out of the car if asked and they may pat you down for weapons, and shake your head "no" if ask to take the walking test or blow into some machine. At this point ask the question "am I being detained or am free to go". If "yes' leave. Times have changed and police officer expect it anymore when you don't engage in conversation.
