    When the police were questioning the individual and got to the point of asking if the casing in his Rifle would match those of the ones found, that's a pretty clear indication to me that they doing more than investigating at that point and considered him a suspect. If he hadn't been advised of his Miranda rights prior to that he should have certainly been advised at that time and his refusal to answer should have not have been able to be used. I would surmise that since he kept answering other questions that would seem to me that he hadn't exercised his right to remain silent over all and not requested an attorney. Okay I finished listening to the rest of the video and I'm a little disgusted by the police doing the questioning. IMO the police doing the questioning damn well considered this guy a suspect, they knew they should have giving him his Miranda rights and the only reason they let him walk out of the station without arresting him was so they could claim he wasn't a suspect and they didn't need to issue the Miranda rights. This case stinks to high heaven with it going before the U.S. Supreme Court and their siding with the BS police work. Don't get me wrong I am a staunch law and order person, hell I was a Military Cop and a Civilian Deputy six years combined and this is as plain as day to me what occurred. The minute the guy was considered a suspect they should have Mirandized him and continued questioning and if he asked for a Lawyer that would have been fine, get a search warrant for the Rifle and let the physical evidence make their case.

    Wait a minutes. You left our the 1st, 4th, 6th and 14th amendments. Never hurts to also say, I invoke my 1st (redress my government, freedom of press and speech), 4th, I do not consent to any search or seizure, 6th right to an attorney and 14th "simply a demand for due process. Can't hurt, even if not 100% applicable. AM I RIGHT OR WRONG?

    If the amendments aren't relevant to your situation, there's really no point in invoking them. Best to just stick to the 5th and 6th amendments. Those are the only ones that are relevant to an interrogation.
