Texas City Officials Think They Can Throw You in Jail for Criticizing Them

There is no better way to make a difference in the lives of everyday Americans than to run for local office. After a fulfilling career in communications, Sylvia Gonzalez did just that. She knocked on the doors of 500 residents in Castle Hills, Texas, and squeezed out a win, beating a well-connected and powerful incumbent. In the process, Sylvia became the first Hispanic woman to become a councilmember in her hometown.

After her election, Sylvia got right to work. Acting on her campaign promise, she helped spearhead a citizens’ petition advocating for the removal of Castle Hills’ city manager Ryan Rapelye. The petition was a non-binding vote of no confidence in Rapelye, who had come under criticism for mistreating his employees and failing to address citizens’ concerns, such as fixing their streets.
The petition did not sit well with Castle Hills’ incumbents, whose interests were well-represented by the city manager. Within weeks of winning her election, the harassment began. First, the city attorney, who was aligned with the mayor and the city manager, claimed she wasn’t properly sworn in and replaced Gonzalez on the city council with the woman she’d just beaten. When a judge reinstated Gonzalez, the city officials didn’t give up.
In fact, that was only the beginning. In the midst of their attempt to unseat her, the mayor and police chief used bogus charges and a rarely-used law to have Gonzalez arrested, booked, and thrown in jail-but Gonzalez had done nothing wrong. Once the county prosecutor got involved, he dropped the case against her.
Finally, after beating back the city twice, a group of citizens aligned with the mayor filed a lawsuit claiming Sylvia was incompetent. Sylvia stood her ground and won-but by then the damage had been done. Sylvia’s mugshot had been splashed across the news and her reputation dragged through the mud. Exhausted-with tens of thousands of dollars in legal bills-she stopped the fight to reclaim her seat.
The city’s retaliation clearly violates Sylvia’s First Amendment rights. If America’s democracy means anything at all, it means that a city can’t arrest its residents for speaking out against a city manager. The fundamental right of political speech is high in the hierarchy of First Amendment values and the courts exist to ensure that it is protected.
On September 29, 2020, Sylvia partnered with the Institute for Justice to file a federal lawsuit against Castle Hills to vindicate her First Amendment rights and hold the city officials accountable. The lawsuit is part of IJ’s Project on Immunity and Accountability, which is devoted to the simple idea that government officials are not above the law; if citizens must follow the law, then government must follow the Constitution.

    AMEN. we were INSTRUCTED to be watchful and told that it was OUR DUTY to keep control of the government - especially a 'runaway' government. we were told that mankind is 'inclined' to let things slide but that it is our duty to speak against wrongdoings no matter if you don't like doing such things! It looks like we - as a nation of citizens - have neglected and SHIRKED our duties for many years, thus DESERVING the government we now have.

In your case, there have to be studies, assessments, surveys or some type of proof this is accurate.     Namaskar, I went Missing after Kidnapped (Arrested) by 3 Victoria, TX Police Officers in May of this year, for not Committing any Crime. A Felony Charge was Written Against me, and the Truth is Felonies ( Assault) was Committed against me because I did not Agree to be Handcuff for no reason. I was Close to Death several time, while in Government Custody. (Injuries from Assault not Treated), and a(Secret Cov-19 Weapon 5G ) aimed at while in Victoria County Jail. No Public Servant came to my Aid, while I maintain my innocence. My 1st, 2nd Amendments Right were Pissed upon by Government Servants. Who can change this ? BNK

    @@kamelhaj6850 , I have a private Lawyer represent me, who negotiated by release on Bail, otherwise I might be Unlawfully incarcerated like many I met in Victoria County Jail. It's a Scam of the highest degree. I had an unloaded pistol on my waist and was exercising my 2nd Amendment. Just because the Police of Victoria saw me with a pistol, they brutally arrested me. They have no Idea who I was, if they were working under my authority or not , yet they just brutally beat me up and frame for charges that I beat them up! BnK

    A cop may arrest without a warrant based upon probably cause with some other requirements. Video doesn't make it clear if these charges were later authorized by a prosecutor. If so, it's not a false arrest. A BS charge,yes, but not false imprisonment

    The thing about Mayors is that they are the default tie-breakers. We are made to believe that councils are important, but not so much. Council members vote one way or the other, and there is usually a consensus of the vote because most of the votes are of little consequence and/or all parties of council stand to benefit for voting in one particular way. The really important ($$$) matters are often defended by those on either side who stand to benefit, probably bribing as many council members as possible, resulting in a stalemate, wherefore the mayor steps in and has the most important vote on the most "important ($$$)" issues. That's how I see it anyway . . . not sure if I explained it clearly, but I hope it was enough to get the point across.

    One thing I've taken from watching this channel is that the freedoms and rights we enjoy in this country are a lot more fragile and vulnerable than most people would think. We're one step away from following the footsteps of China, North Korea, etc if we don't have good people standing up for what's right. Love what this organization is doing ! 👏

    @herrinjerry Many older people are very active, vital, and able. They aren't all ready for a nursing home and they aren't all disconnected as you imply. I have an 87 year old relative that could run circles around me and she's sharp too! Have YOU ever ran for office? Maybe you should. Don't complain or get 'sick', if you are part of the problem.     I agree! This is what happens when some elected officials have been in office for too long, amassed too much power, and completely forgotten exactly whom it is they are supposed to be working for. In general terms, a good elected official should always have a healthy dose of humility and never forget why the public voted them into office and when that ceases to be the case, whether that be one term or ten, it is time to leave office and let another fill your seat. I don’t know how voting works where this happened, but I know how surprised I was at the level of official corruption I discovered when I moved to South Carolina 15 years ago and that corruption, in my opinion, is facilitated by two common practices among our voters here: 1) casting votes based exclusively upon the candidate’s party, often without even knowing who the individual candidates are and 2) our state’s use of a lazy “straight ticket” voting option that facilitates voting based exclusively upon party alone and encourages far too many voters to cast a vote based solely upon their political party and, sadly, encourages voters to never even bother to learn who any of the persons they are voting for actually are nor what their platforms and positions may be. I firmly believe that the “straight ticket” checkboxes should be removed from ballots so that voters at least have to take conscious responsibility for every candidate they elect by personally checking off that candidate on their ballot as the straight ticket checkbox discourages voters from taking full ownership of their voting choice and instead transfers that moral and ethical responsibility off the voter’s shoulders and places it upon the political party, allowing the voter to deny personal responsibility for any and all of their elected officials (e.g. why should I bother to educate myself to vote better if I convince myself it is my, or the other’s, party’s fault instead of my own and my fellow voters). I have always voted a mixed ticket as it is exceptionally rare that one party, regardless of one’s general personal political bias, truly has all the best candidates and ideas in any given election and I believe in holding myself accountable for every candidate I have ever voted for. When candidates go unchallenged for too long due to being protected by their party they too often forget who they really work for and become corrupt as they cease to see themselves as the public servant they promised to be and instead it becomes all about amassing ever more personal power and the back room deals meant to protect that power.

So that would mean they didn't a very good job of raising them from the start. Parent should be mindful of that when they argue with teachers in front of the child. One reason to always keep adult discussions (esp. arguments) private. Kids gain (or lose) respect for authority through the observation of their parents. But that's a whole different discussion.

    During her first week they tried to have her dismissed claiming that she wasn't properly sworn in and they put the incumbent she ran against back in office. A judge reinstated her. This was just during her FIRST WEEK! Clearly the mayor and the city council couldn't handle having one of the common folk in their exclusive club so they tried to frame her to kick her out. This is corruption, plain and simple.

    The scripture applies in monarchy - but applies to The People in this case, because it's the People who continually support psychos like these city vermin and the police who apparently capitulated to being used for political strong-arm fear tactics. Shame on the voters (where I'm from too) who complain but won't hear the whistle blowers day and night uncovering abuses and crimes by low level government reps. Democracy - everyone gets what *the majority of their neighbors* deserve.

    Funny how the Mayor could see the alleged "stolen" document in a neatly stacked bunch of papers - almost like he had X-ray vision OR it was planted there.... As for her suing, there are FEDERAL Laws that might apply here...Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States...So falsely arresting Sylvia might be a Federal offence...she needs a good lawyer

    A lawyer isn't what she needs, counsel is sufficient and I for one am willing to assist. But no one will accept my offer because most people are ignorant of their rights. I'm living proof of what I preach , but again, no one is willing to see truth.

    @@thomasspringer5738 - I get it. Though many times when a person is, overwhelmed, it can,be difficult to make a well informed decision. For me personally. I value knowledge over a fancy deploma. I find many can fake their way through school and make high grades. Though many cant fake knowledge to back it up. And, a logical mindset put it all together. Though some times its sad the world cant see facts and stuck on their false perception of things on the world.

    Unfortunately the police were clearly in on this. Just another police story of folks over stepping their bounds. I also imagine the legal system will say it's not a criminal offense what those people did to her but a civil one. Hard to win in this country, unless of course, you are the lawyers. They win everytime.
