Two Families Battle Outrageous Fines and Fees in Wisconsin

CORRECTION: The private law firm representing the Town of Eagle told Annalyse Victor that it would take at least $45,000-not $20,000-to cover their fees.
“Life on the farm” conjures images of wide-open spaces, grazing animals, and lemonade on the front porch. That is, unless you’re in the Town of Eagle, Wisconsin, where “life on the farm” means endless property inspections and abusive code enforcement.

The Town of Eagle, a small municipality where most of the 3,500 residents live on multi-acre tracts of land, has weaponized its code enforcement to punish local residents and to produce a profit. With the help of Municipal Law & Litigation Group-a private law firm that is paid by the hour to prosecute code violations-the town uses its codes to retaliate against citizens who speak out against town officials, to fine citizens tens of thousands of dollars for minor violations, and to pass the attorneys’ fees on to unwitting citizens. The law firm has even threatened citizens with jailtime if they can’t pay up. The town subverts basic constitutional rights, devastating the residents unfortunate enough to be caught in the town’s crosshairs.
But the law is clear: governments may not infect their enforcement systems with perverse financial incentives. Prosecutors must serve the interests of justice, not the interests of their pocketbooks. Nor may towns retaliate against their citizens for engaging in constitutionally protected activity, such as criticizing local government. If a code is worth enforcing, it must be enforced uniformly, without bias, and to protect public health and safety. And governments may only impose fines for a code violation that are reasonable and proportionate to the violation.
The town’s officials have been skirting these constitutional requirements for far too long, but they can’t evade the law any longer. The Institute for Justice teamed up with Erica and Zach Mallory, and Annalyse and Joseph Victor, and filed challenges in Wisconsin state court to hold the town, town board and the Municipal Law & Litigation Group accountable for their unconstitutional code enforcement practices.

    Had a buddy who lost his license for no insurance. He had set up a payment plan for the tickets but lost his job in the middle of paying on them. The judge was a complete dick an refused to work the payment plan over again so they went to warrent. He said fuck it I'll sit them out. 2 day's in the city jail an the judge had a change of heart an dismissed the fines an penalties. He decided to move out of state after that an got his driver's license in the new state no problems. Amazing what happens when they can't get anymore money out of you.

    Debtor's prisons? Yes. Ways around the law that do the same thing, no. For example, if you "violate probation", by not paying your fines, you get a warrant/go to jail. I had a friend in my mid-20a that had traffic tickets to the point that they suspended his license, issued a warrant, arrested him and made him get bailed out and pay the fines, or he would be locked up again when he went to court. So yes, still debtors prison in my eyes.

    It has been for a while now. There are numerous states that have made it illegal to homestead. Apparently the water company's own the right to the water that falls from the sky. Meaning you can't collect it. Same goes for power. You can have solar panels ONLY if the back feed to the power company. Soon enough having a well will be illegal too. There are thousands of people that have been evicted from there land because of the same thing. Finds and lots of them.

Consider too that we have huge numbers citizens of Israel dual citizens in Congress and U.S. also illegal. All millionaires. Not when they took first oath. We need to set term limits. Now more than ever. No more than 2 terms and never again. That would clean things up fast w accompanying laws like not hold positions as a lobbyist. Think we need to eliminate that position. More wealthy companies get the favors. They should not be able to swing back and forth between gvmt agencies like FDA and CDC either. Swinging door multiple times.. ludicrous it seems to me.     Thank you for your work. As a farm owner in Wisconsin, we have had to relocate because the area became too populated and even though we were correctly zoned, neighbors complained about our operation. You are doing valuable work.

    On my area a lot of people put up signs that state things like "This is a farm. It makes noise, smells, dust, and there is equipment around. If you don't like it, don't move here." "This is a rock quarry. Heavy equipment is operated here daily. We make noise and dust. If you don't like it, don't live here." Don't know how much they help, but at least people are more aware.

    With zoning laws (probably published 50 years ago) you're guilty until proven innocent. They exemplify that "ignorance of the law is no excuse". Before buying, you should to check with the local zoning office about questions and get it in writing. It wouldn't matter that it had been used for that purpose by the seller. Prior non-enforcement is not a valid argument. I feel sorry for this family.

    One city fined a family because their curtains did not match from the street in the front of the house. Say a living room on one side and bedroom on the other, they required matching curtains from the street!! A family had a huge fine they were having trouble paying, besides other nonsense fines..

    I side with the home owners, its bullying and BS profiteering.....BUT. When you're buying a property, it's very important to check with the town and even codes and make sure they are OK with your intended use. Might have to go before the town board and explain your plans, and get an OK from them. Just because prev. owners were doing whatever, does not guarantee that use transfers over to new owners. You are NOT automatically grandfathered in, despite what the neighbors say. Go to the town, not just the neighbors. it's up to the buyer to do Due Diligence! The fines and threat of jail time, is beyond what should be allowed in the USA.

    Had a similar situation arise in Rural Georgia. A cocky arrogant zealous code enforcement officer kept coming up with new things I had to do to become a compliant. Being nice doesn't work always with these people. I hired a lawyer and sued the city. Cost me $10,000 but to be compliant under the cities so called standard it would have been $35,000. He was also removed from his job.

    Good for you. It's obvious to me now there is NOBODY in a public capacity who is anything other than a predator and a sociopath. These cases aren't the exception but the rule. It's funny, not even five years ago I never thought of these things. I had political opinions but I never realized how vicious, rapacious and immoral those in all levels of govt are, and how revolting and shameless street cops are. A lot changes in a few years. These demons are WORSE than organized crime, because they pretend to be benign, when they are nothing BUT. They are as vicious, shameless and morally bankrupt as anyone behind bars or any member of actual organized crime. That's not being too dramatic that's the truth.

    Fortunately you could fight back, but not everyone can. I'm not saying there's no role for a public managerial body, but these people are filth and this is disgusting. So how did we stop it??? That's all I want to know. Only a total ban on ALL fees, fines, and seizures for any reason at the state level would bring an end to it permanently, and I doubt that will be forthcoming. There are enough rich people and rich businesses for these filth to fund themselves from but instead they would rather steal/extort/force the poors and averages to pay. It must be more fun for the Filth to target people like us, people they don't think can fight back.

    We're I live the code inforcement guys house was falling apart and he was fining people for the same until one guy followed him home and got video of his house and went to city hall and raised hell about it. The guy ended up lossing his job. 😆

    Integrity?? Are you kidding?? The only ones with integrity in Wisconsin are those being fined and attacked by the city. Wisconsin is full of spineless trouble makers hide their identity behind the communist pricks on the town board, city council, and state representatives. Even in liberal Minnesota it is not this bad because the busybodies know there is a chance they might get shot. The real issue is, someone wants their property but didn't make an offer on it when it was for sale because they want it for nothing and if they can force them out through fines they cannot afford they can pick up the property for not much more than the state property taxes.

    Watch your speed while driving through Eagle. There is a speed trap on Hwy 67 coming into town by the cemetery. The speed limit drops from 55 to 35.

    That “profit motive” the lawyer speaks about is why red light cameras had to be removed from several jurisdictions. The courts found that the private companies enforcing the red light cameras were violating the law themselves.

    I used to live about a 1/2 mile away from this town. Believe me, it has absolutely nothing there. This property is actually on the backside of a industrial park. Then a builder put a small subdivision in. Guess who the town is siding with. Keep in mind, this town doesn't even have full time police/fire. One small diner, two bars and pretty much nothing else.

    I have snowmobiled through this town many times. I even bought a snowmobile trailer from someone in this town. He lived in that subdivision you are talking about. I have drank at those two bars before while snowmobiling. Looks like they don't deserve my money anymore. BTW, I am from IllAnnoys and have snowmobiled from Illinois to Eagle. The sled trails in the surrounding area (The Kettle Moraine) are absolutely beautiful in the winter time.

    There doing to me in fondulac county town of lamertine 13 acre farm 2 acre residential still under construction stuff in yard pens and animals tools and belongings tarped we are behind woods cant see from highway a mile away or rd in front of house on dead end in the stix they do what they want it keeps up I'm going to jail because I don't believe in communism town lawyer is going out to pasture to crooked heel and cops say they don't want it to escalate it already did with town chairman assaulting me and putting Mark's on my arm cops did nothing and called right away someone's getting paid off I think.

    This type of thing is very common where I live in MA. If the town doesn’t like you, for whatever reason, they will literally try to drive you out by fining and then having hearings you know nothing about.

    I lived in South West Geensburg PA . They operated the same way . I changed insurance company , they stopped my wife and said car was not insurer and tried to physically tear off license plate. They didn't want to see the the proof of new insurance company. We got the hell out of that nightmare ASAP , to this day I will never go there for anything.

    FIRST, let me say this..... I know what it's like to go through this. The policy of Minimum housing / Building departments, including mine says every single person on your road could have dozens of violations, but they( the building department) wouldn't do anything to anyone unless a complaint was made. And the complaint could be total private & the complainants name need need not be left. Which then made the town the plaintiff when it came to you facing your accuser. The inspector would go to the property in question and no matter what direction they came from, they could pass 50 other properties with dozens of much worse violations each of them, but because YOUR PROPERTY was complained on, You got the violation. Then in 2010 the scum at city hall in Warwick R.I. UNFORTUANALEY were given a taste of their own medicine FIVE PEOPLE DIED AS A RESULT. In 2010 the head of the Building Department of Warwick R.I. was renting out a home owned by her & her husband ( the Warden at the R.I. ACI prison ).     I once had to talk my way out of bank fees. They had failed to send me any notifications whatsoever that they had been hitting an account I forgot existed every single month for some BS $20 fee. The account was set up with just enough money in it so that this would supposedly not be a problem (roughly $150 originally), but apparently that didn't matter. So they come to me, finally sending me an invoice telling me I had negative $19.99. I told them flat out "that means you're trying to charge me $20 over an account that had one penny in it? I'm blatantly not paying that after you've already drained the rest of the account." They didn't even argue, they just dropped it. Amazing what companies/banks try to get away with, even more amazing how quickly they drop the whole act when you call it out for the theft that it is.

    Yep "leagalized" used VERY loosely. Statutes and codes are not law. But Martime courts don't recognize the constitution. It's a big Fat rigged system.

    Yes, unfortunately the courts are set up under "color of law" MARITIME. No common law courts system. Maritime courts do not recognize the constitution.

    @@gmaws.7492 Court cases start in local courts. Then proceed to appeals court. Then to district court. Then state level court. Then to federal district court. Then the appeals court at that level. Then to the U S Supreme court if the plaintiff has the cash or knowledge to get it that far. Any case takes years. However, for those who have their constitutional rights violated, it's "Who wants to be a millionaire?" for real.

    We are so thankful for IJ. We felt as a family something had to be done. If it isn’t us, it seems like this Town finds someone else. If we stand up the hope is change will come for the better. We are asking for $1 in return...think about that!!!
