‘Ridiculous’: You don’t have to be a lawyer to see ‘problem’ with Voice

You don’t even have to be a lawyer to see the problem with the Indigenous Voice to Parliament, says barrister and constitutional lawyer Gray Connolly.
“It’s just ridiculous for me to see someone saying that the Constitution is going to be amended - something we do very rarely," Mr Connolly told Sky News Australia.
“And there are serious people who are asking you to believe, I think, unseriously, that an addition of a new chapter to the Constitution will not change much of how the High Court understands the Constitution."

    The AFL, Cricket Australia, Rugby League should stay out of political and social movements. I haven't watched a cricket game since the time the cricketers acted like losers and bowed down to the violent and anti-social BLM movement. I have also stopped watching and following AFL because they keep sticking their noses into the same social areas.... Sport should be sport.

A definition of "Allodial Title" should be made more readily known, so more Australians understand what the 'yes' vote will, in the future mean to them ! !     What amazes me about all this is that the Labor government is just doing whatever it likes and it thinks that it can play roughshod over the electorate as it sees fit.     All Australians are currently equal. The proposed Voice will provide special rights to access Parliament and the Executive to Aboriginal Australians, which rights are NOT available to the rest of us - thus, not all Australians will be equal and Aboriginal Australians will be a different, and more ‘important’ group, based solely on their race - this is racist, and wrong. Why is it that those who normally bleat loudest about ‘racism’ in Australia (the ABC, sporting codes, unions, corporate and business leaders, NGOs, the churches etc) are now all fully supporting a Voice which is based solely on the race of the beneficiaries ? If we divided the seating at a footy ground into one section which said ‘Aborigines’ and another section which said ‘ Other Australians’ there would be outrage (rightly). It’s hard to see the difference with the Voice.

    Once there was a family which left Australia when the White Australua Policy dominated the population, early after Federation. The father was Chinese and his wife was an Aboriginal woman. It was a very hard decision, but thry got on the boat. Three generations on, their descendants are Chinese, but with an Indigenous heritage. The descendants have been part of the Communist Party of China for decades, and have moved back to Australia. With indigenous blood, they automatically got an Australian passport and all the benefits provided to Indigenous people. But they want power, so with CCP money they go and buy Indigenous support across the country, setting up 'representative bodies' etc. Having the run of Australia and China, they decide to try for more formalized power, and this is what this referedndum is about. The indigenous people at the grassroots level don't know they're supporting the political aspirations of one ethnic-indigenous mix.

    This proposal is very poorly thought through. As an example, the qualifications and disqualifications for Members and Senators are regulated at section 44. This section with section 64 sets the terms of appointment of Ministers of State, while section 72 provides for disqualification of members of the Judiciary. The proposed constitution alteration to establish the Voice makes no provision for qualification or disqualification of Members of the Voice. This would be subject to Federal legislation. This could create a legal minefield as did the disgraceful section 15 referendum left us. (In this particular case because it just doesn’t work as promised)!

    I think it will just end up perpetuating the "victim status" of indigenous people in Australia. Don't get me wrong - they *do* have problems but I just see this as *patronising and belittling*. I think Maori here in NZ are in a similar situation - there are "Kura Kaupapa" here that teach only in Maori. "Kohanga Reo" too. There are Maori electorates (seven of them) just for Maori. Maori this, Maori that. Maori *everything......* Every government department seems to have a Maori name as well as an English one - heck, it's a FACT that Maori is actually an "official language" here and English ISN'T! I kid you not. ( That has *got* to be changed. ). All of this is *so belittling* to Maori that they don't even have to TRY - they get all of this stuff "handed to them on a plate". Does that help them? I say *NO*. They have had the Maori electorates for over 100 years (IIRC). What have they *really* done for Maori? Stuff-all if you ask me. There WERE the charter schools a few years ago that showed HUGE promise (and where the students making the biggest gains were Maori and Pasifika students) but dumb old Labour in its "infinite wisdom" AXED them because the unions told them to.     You're ignoring chapters 4-8 (Finance & Trade, The States, New States, Miscellaneous & Alteration of the Constitution). These being their own chapters do not fundamentally alter the functions of our Government.
