'Wrong in principle': Terence Cole slams the Voice to Parliament

Former NSW Court of Appeals judge Terence Cole has slammed the Voice to Parliament referendum calling it "wrong in principle".
"My view is it's entirely wrong in principle," Mr Cole told Sky News host Andrew Bolt.
"It will be divisive of our society, it will be difficult for people to get on together, it will cause animosity, and my personal view is it's just entirely wrong in principle."

The Australian Gobvernment currently allocates $34 BILLION per Year to Aboriginal peoples needs, this is DOUBLE what non Aboriginal citizens have allocated on a per head basis. There are currently 11 Aboriginal members of Federal Parliament, which is 4.8 % of the total number of Federal Politicians (227). Aboriginal people are only 3.1% of the total population so they are OVER REPRESENTED on a per capita basis. From July 2022 Aboriginal people own 49.3% of Australias total land mass, which will increase shortly as a further claim of 13.4% is approved, and rise to 62.7%. Pretty good going for a people who "need a voice".

    Labor's promotion of race based policies should not surprise. It is consistent with socialist identity politics ideology. Especially minorities. For that alone I hope it is defeated at the referendum. As KC notes, ALL Australians should be treated equally. The Voice is, by its own definition, a policy that provides one specific racial group with rights, representation and the potential for even more money than currently. The nation has spent over $30B a year for the last 20 years and more - and that has done nothing to improve the state of Aboriginal & Torres Strait Islander communities. BUT, you can be sure that most members of those communities demanding we give them this voice WILL profit if the voice gets up.

    This may sound harsh, but they are a conquered people. They are now Australians. They have all the same rights that all Australians have. Are they asking for special or preferential treatment? It's like saying that if this "Voice" speaks, everything and anything can be overruled. They are not marginalized or oppressed. They have simply failed to get on with the times and kept up with progress, so now they are raking up buried skeletons about colonialism. They want everything regular hardworking Australians have got without having put in the required effort. They tell you they hate the colonialism, but they want its benefits and rewards for free. It's the same rubbish as black reparations for slavery.

    @@BlackStump172 When Allodial land title is made defunct in Australia, it mightn't be the actual Aboriginals who stand to really benefit from this amendment. No special treatment here, just government manipulation of 'ownership' which then extrapolates into appropriated population and resource control. Remember the recent erosion of civil liberties and subsequent legislation during the pandemic? Once the $AUD goes digital, the Gov will have 'appropriated' control over how and where you can trade, invest and secure, depending on how you may conform socially and politically, based on your ethnicity. Already these changes are being integrated into International law globally. Recently Israel adapted allodial title. PNG did in the 70's under 'labor lawyers' purview and NZ is reviewing their 'voice' agenda atm, Hysterical? possibly to the myopic and naive among us. Citizen score communism is the new progressive ideology. Will the Voice smoothly integrate? Just relax and trust the integrity of the Pollies, everything will be fine in the great new and morally superior republic of Oz.

Really , what would you know honestly, your family came from other lands well after the fact and can also consider yourself an invader , as we in the western world have become interested in culture of other nations it’s hard to learn from a culture that was nearly decimated and the land that culture inhabited destroyed by bigotry and plain greed. Pack your bags and go back to your cultural homeland ,is what people who suggest denying indigenous peoples their true rights should do. Like it or not facts are facts: the black man has resided here for millions of years and had its own cultural laws and delegations for regions , even localised battles between tribes , but never did they invite a foreigner or bestow them any titles, therefore the lands were stolen by force with murder and slavery.     here in NZ we have the waitangi tribunal, which has only some of the powers proposed in the voice, it has been very very expensive, very divisive, and now has maori trying to take control of the water we drink, which they intend to charge us for.     If you are wondering about the fine print of the Voice and what will happen after the referendum - I have just been reading the UN General Assembly on the rights of Indigenous people. There are numerous chapters, but it essentially says that Indigenous people have the right for self determination. This is interesting, because when Gough Whitlam started campaigning for aboriginal rights, that was his main goal and various Labour governments have continued in this vein. Now, Gough is Albanese’s hero and he wants to emulate Gough and live up to Gough’s expectations or even go one better and deliver Gough’s goal and deliver the UN General Assembly goals. This also fits with the goals of the 1982 National Aboriginal Conference, where a draft Makaratta detailed requirements for self determination or Aboriginal Sovereignty. There are some pretty scary demands in this Draft (eg tax relief for 195 years, payment of 5% of GDP for 195 years etc- research it for yourself). Aboriginal Sovereignty was also the main driver at the Canberra Tent Embassy. Articles from this Makaratta appear also to be included in the Uluṟu Statement from the Heart. Marcia Langton and Patrick Dodson would be most aware of the 1982 Makaratta. And the kicker - 2022 an expression of interest was released by Penny Wong for an Aboriginal Ambassador to “lead indigenous perspectives experiences and interests into foreign policy and First Nations trade and investment” - I expect because the Voice has further un-mentioned goals. So, when Albanese says “trust us”, it will all be worked out after the referendum. Just like his pre-election promises - that has worked out too well. So why doesn’t the government want to give out further details on the Voice? In absence of any detail from the government, it can only be concluded that Aboriginal self determination or Aboriginal Sovereignty is the clear driver behind the Voice and these details are what is being kept from the Australian people. So a No vote would be appropriate.

    Already there is disparity. Aborigines have equality under the Law in Australia. The most recent review of government expenditure on Aboriginal and Torres Strait Islanders Australians estimates that direct expenditure was A$33.4 billion, an increase of around 23.7% since the first report in 2008-09 (adjusted). This equates to A$44,886 per person almost exactly twice the amount of direct government expenditure (per person) on the rest of the Australian population. So in terms of funding, they are more than equal. As of 5 May 2019, there have been 460 native title determinations, with a further 223 native title claims still moving through the system. Currently 40% of land in Australia has a recognised native title interest in it and this is expected to rise to 80% by 2050. . Once native title is determined, the Native Title Act requires the creation of a prescribed body corporate (PBC) to represent and manage the group’s native title rights and interests. There are currently 200 PBCs across Australia overseen by The Aboriginal Commissioner. Gaining native title over their land gives the group greater power to realise their social, economic and cultural aspirations and maximise the benefits of their native title rights and interests. Approximately 15% of Aborigines live in rural and remote areas while ∻85% of Aborigines live in Urban areas and fully 33% of those live in major centres with ready access to all facilities compared to 25% of the general population. There is also A Federal Government Ministerial Portfolio and a Department of Indigenous Affairs employing a largely Aborigine workforce and in 2022 10 Indigenous candidates were elected to the Federal parliament, and most of them are women. Labor MP Linda Burney is set to become the first Aboriginal woman to be Minister for Indigenous Affairs. So there seems to be a reasonable level of political representation that is able to effect policy and decision making for all Australians and An Aboriginal Justice sits on the Federal Court.

    We need to develop AI in ways that allow it to analyse argument according to the rules of logic and from base data that is grounded in empirical reality. By doing this it should be possible to expose fallacy and false argument by exposing the true/false conditions at every intermediate stage of an argument. In this post truth world we are allowing space for polemic and falsehood to flourish and contend for dominion. We have to put an end to this trend.     SORRY FOR WHAT? A lot goes on about criticising the past, where Colonialism was the global way of Life, where Humans were as Humans as they are today. Waking up is wOking out and realising that sanctity is not a Political concept and the future generations may have to SAY SORRY for being part of what goes on NOW.     When the Prime Minister made the announcement for a Yes vote for the voice because it was what was asked for and is the result of 'The Uluru Statement From the Heart'. I had to read the statement. I read the statement in fact, I studied the statement. It is a road map to Aboriginal sovereignty. Nobody can vote with understanding unless they have read the statement. In the statement are some nice words and meaningful intent, but it contains clearly a scorpion sting. I have decided to say 'No' because I have read the voice and listened to the argument for and against. It is racist and seeks an independent aboriginal government. Land rights was the first move. What is not acknowledged in the statement is any benefit to aboriginal communities, it seeks to remind everyone of the past. It is often said that you can't change history, and also means history should not be glossed over. However, an honest view of history cannot simply be focused on the unpleasant because our history is rooted in the oldest democracy in the world. The foundation of that democracy goes back to Magna Charter. It also brings Australia to being a middle power. Has anyone really studied what Australia would be like if not colonised by the British Empire? Because that is where we got the Australian Constitution in 1901.

    I think The Voice is ENTIRELY without merit - wrong in principle (racist and undemocratic), ineffective (its neither a new nor innovative form of consultation), it is socially and political divisive, and will be devastating to the aboriginals if it fails or if it succeeds.

    Bit disappointed discussion hete falls short of explaining why Indigenous Australians were not being recognised as citizens of Australia during/after the "undivided" world of Australia in WW2 period....or why returning Indigenous service men were excluded from government programs offered to other Australian

    Someone needs to highlight the NIAA. They are supposed to be a voice to parliament (since 2019) ,have 1500 staff and a budget of billions. What do they do and where does the money go. The Voice is just Optics to make Elbow and his deluded wacky supporters feel good about themselves. It also means they do not have to do the hard yack of sorting out the obvious rorting that denies help to the people who really need it. It is shameful gaslighting to the max. No to the voice.

    So as Migrant Australians y’all enjoy a barbecue on weekends in the parks, enjoying a game of cricket or just getting drunk, you know, to entertain yourselves. Now imagine what happened in Tasmania during the 1800’s when all of the landholders gathered with their families for a picnic down by the running creeks, they didn’t play cricket back then but they brought along with them, captured aboriginal men women and children for their entertainment. First of all they forced the aboriginal men and their sons to dig holes in the ground, then they first tied the little ones and placed them in the ground standing up, they then ordered the men and boys at gun point to bury them up to their necks, leaving their heads exposed. Then your ancestors loaded their rifles and proceeded to do some target practice, they used the babies as head targets whilst their families and friends urged them on if they missed their targets.They kept shooting to see who could blow the heads clean off their shoulders. Then they did the same with the children’s mothers, Buried them up to their necks, repeated the same as to their babies, then they did the same to their fathers, grandfathers and sons. These are the actions of your migrant ancestors, and down through white Australian history it was passed down through the colonisation of the rest of Australia and to this very day, not a mention. All babies are born innocent, and no matter what race, babies/ children will always play with each other no matter what until they begin to grow, and they all learn to walk the talk of their parents, racists are created and apartheid begins right there. But there is a difference especially when white people are slaughtered just like the Port Arthur massacre in Tasmania, it was a tragedy, so much, they disarmed Australia or assumed to. Nothings changed, y’all hate my people and after reading most comments on here, y’all seem to be following your pied piper, and to be honest, it is getting a bit boring, it’s the same responses, same aliases, same old boring drum rolls, over n over n over n over, it starts to get really boring, why, because bogans don’t know any other language, goo goo gah gah..
