Hello it states that if you have no documentation, Submit an affidavit from a indivdual who can attest to your residence in the United states. Where do I find such affidavit? Do i just type one up and get it notorized?

Hi, Trina, If you have an attorney, they can help you prepare an affidavit. Otherwise, you may be able to find samples online.

Good video! I opened my Uscis account and saw that i have an RFE on my application for employment authorization. It says i need to send them the photos but I'm not sure if i have to physically mail them the photos or upload them online since there is an option to Respond with evidence on the USCIS website. And if i upload the photos online what supporting documents do i upload with it. Could you please guide me in understanding the actions i need to take?

Hello, please what could be the reason why we have not gotten any response from the USCIS after we have responded for RFC. The due date was march 2024 which we responded February 3rd 2024. And till now we have not hard anything from them. Please what could be the problem, it’s still saying delay in process and pending cases

Hello, USCIS takes different amounts of time to issue a decision after submission of additional documents - it varies by case type and a few months such as what you’re describing is not at all uncommon. Additionally, it is very common for the online case status to remain out of date after submission of additional information. It is important to maintain proof of delivery of your documents in case there is a mishap in the future and USCIS claims you did not provide a response to the RFE. However, the information you’re sharing about this case is not at all uncommon in our experience.

Hello, In our experience, all I-130s filed while the beneficiary is in removal proceedings get scheduled for interviews. This is because the standard for proving bona fide marriage is higher when the beneficiary is in removal proceedings. In terms of processing times, they can vary quite a bit depending on the service center and field office handling your case. In our experience, I-130s filed for beneficiaries in removal proceedings do take substantially longer to adjudicate than those not in removal proceedings. You can check general processing times here and if your case is outside the published time frame, you may be able to request a status update: egov.uscis.gov/processing-times/.

Great video but I have one question if you could please respond. I submitted the K-1 visa for my fiancee and just the other day I received a RFE letter saying that they needed more proof of our two year relationship because photos weren't enough. They said to add plane tickets and text messages. I didn't add plane tickets the first time we sent our documents because I couldn't find the booking number but just found screenshots of the tickets. So I wanted to know if they would accept a screenshot of the plane tickets even if you can't see the booking number on there but everything else is on the screenshot with the dates times ext. Please let me know if that would be acceptable? Thank you

Hello, Thanks for your question. In our experience, evidence of flights that show the couple has traveled internationally to meet in person is important to include, and booking numbers for flights are not necessarily required. Additionally, credit card statements showing international purchases during the trip and sworn statements from friends and family regarding confirming their knowledge of the couple’s meeting could be helpful.

Hello, i received an rfe from my 129f i filed myself. The evidence they are requesting made me realize that the original question on the 129f i answered incorrectly. The question was if i ever had a temporary or permanent restraining or protection order, which i have not, but my beneficiary has. I thought the question was for the beneficiary, so i answered yes. Now they want court records of this. How can i go about responding to the rfe?

Hello, Josh, In this situation, we would recommend providing a sworn statement explaining the error, along with a local criminal history check and a letter from the court in your area where protective orders are processed stating that they searched their records and found nothing for you. If someone gets an RFE for the Medical Exam, does it mean that the interview will be waived?

Hello, The RFE for medical exam is sent separately from the interview notice, so an interview may yet be required even if the medical exam is requested and submitted in response to RFE. However, USCIS has been waiving interviews for more cases than was historically typical, especially in cases besides those based on marriage.

@@aheat3036 Hello, We have actually seen some marriage-based cases receiving interview waivers recently. USCIS has indicated that they are waiving some marriage-based interviews, but not all.

I've a RFE about my photo guideline. There is an option to upload documents in the system as well. Do I have to send documents by mail or if I upload my documents online which documents do I need to add?

When you do so, the system will give you the opportunity to identify what kind of documents you are submitting. However, without seeing the request for evidence, we cannot say for sure which documents or photos you should provide. Hi, Sabra, Congratulations on the approval of your wife’s petition! Without seeing the correspondence, it’s difficult to say for sure, but if this situation occurred with one of our clients, we would probably send the approval and the post-dated RFE back to USCIS with a letter explaining that we are confused about the status of the case and asking them to re-affirm the approval. If the evidence requested is easy to provide, we would probably include some of that along with the cover letter. We have actually seen this happen before, so you’re not alone - USCIS deals with millions of cases each day and crazy things sometimes happen. I hope this helps!

URGENT- I had an agent that works with an immigration attorney fill out my I-485. After 5 months waiting I received an RFE because she failed to answer few of the questions like “if I’ve ever sold or dealt with weapons” or “if I’ve ever been deported and denied to leave” those 2… and now the office isn’t answering me and I don’t know how to respond. Do I just write a letter with the responses? Or do I have to submit the I-485 ALL OVER AGAIN?? Please help!

Hello, Daniel, If we were handling this situation, we would create a separate document with the requested information, and then have the petitioner or applicant provide a self-notarized signature, meaning we would include the following language prior to the signature: “I, [name], swear under penalty of perjury according to the laws of the United States that this information is true and correct to the best of my knowledge, understanding, and recollection.” We have a video on self-notarizing documents for immigration, which we recommend you check out. Hello! In our experience, the RFE response should not include anything previously submitted - unless the RFE itself clearly asks for documentation that we know was included in the packet. In general, we never re-submit the entire filing.

Hi there. I am currently awaiting decision on I-485. I have recently received my 2nd RFE with completely different evidence requested. Last time I sent it back online, but this time they are requesting photo evidence of our marital life since I got here and letters from people who can attest to our marriage (these are done and notarized) and I thought these would be better sent by mail, the RFE states we can do either online or mail, I was wondering which (if any) is better? Also there are a couple of affidavits that are taking longer than I would like, I believe I have enough evidence to send now, should I wait on the other letters or send what I have now. Thank you in advance. This has been such a long and frustrating journey.

Hello, Fiona, It is a long and frustrating experience for many people! In our experience, for cases that have been digitized, filing evidence through the online portal is best. However, if you are handling the evidence and feel that sending it via postal mail is the best approach, our recommendation is simply to ensure that you have clear copies of everything submitted and use first class mail with tracking so that you can print confirmation when your package is delivered.

Hello, For DNA testing, here is a list of accredited laboratories that may perform the test for USCIS: www.aabb.org/standards-accreditation/accreditation/accredited-facilities/aabb-accredited-relationship-testing-facilities. You must make the appointment, and the laboratory should provide the results directly to USCIS. The lab will ask you to provide the information required to coordinate delivery of the results.

Hello!! I submit my case for 1130 and 11485 on June 2023, on October 26 got a RFE asking for the medical exams, the same week got the Work Permit and the Travel aut, I sent the RFE on Nov 7, got delivered on Nov 9 but still no notification from USCIS letting me know if they got It!! Normally how long it takes??? Thanks in advance

The RFE was sent to Lees Summit, my concern and biggest fear is that expire the limit date and they don’t change the status to received, I have the notification from FedEx that was delivered and Signed!

Hi, Luisana, This is an excellent point you make - USCIS does not send a notification via mail when they receive an RFE. Many times the case status will update to say “We received your correspondence” or “We received your additional evidence,” but it does not always update in this way. In our experience, USCIS often takes 45 - 90 days after an RFE response to issue a final decision. If the case continues to linger beyond the published processing times, then you will likely need to submit an inquiry to prompt them to finalize the work on your file.

Hello! In our experience, it is important to read the RFE carefully to understand which documents will satisfy the request. If the RFE lists the birth certificate and an explanatory statement as items that could be submitted in response, then we would probably recommend that, plus anything else that might be required. Whenever there is confusion about a person’s full and correct name, we do provide the birth certificate, a passport if available, and an explanation of the different variations of the name that may be used on different applications.

I-485 Citizen spouse, is medical RFE from lees summit different than RFE from local field office ? Which is better for us ? USCIS I-130 account is showing processing time of 6 months. Does that mean we ll get decision within 6 months ?

Hello! If you get an RFE from the Lee’s Summit office, that may be because you will receive an interview waiver (meaning you will not be required to appear for an interview). This is good! The processing times are an average for 80% of cases. Therefore, it’s not a precise timeline for any case, but is supposed to give you a general idea. In our experience, we typically receive decisions on cases within 45 days of responding to the RFE for the medical exam. Good luck!

Hello, If the RFE was issued in the case of an I-130 that was filed online, then the response to the RFE must also be filed online. If the I-130 was filed by mail, then the RFE response should be submitted to the address indicated on the RFE documents.

Hello, The RFE should contain instructions regarding how and where to send the response. If an email response is permissible, the RFE will indicate that and provide the correct email address.

Hello, Given the amount of time that has passed, we would recommend calling the Customer Service Center again and tell the automated system the word “Infopass.” That should get you to a human being, who can then either schedule you for an infopass appointment to speak with an officer about the issue, or request that the RFE be reissued to the correct address.
