It may be possible for you to request an appointment at the nearest U.S. consulate as receive assistance there, or you may need to file a request with Department of Homeland Security, along with documentation of your situation and a request to expedite the issuance of your parole. We recommend reaching out to a trusted immigration attorney for guidance and assistance.

    Hello, In our experience, it is permissible for a U.S. citizen to petition for their family members while living abroad. However, it will be important to demonstrate that your parents intend to live in the USA at least half the time, as doing so is required to maintain permanent resident status.

    Hi, @Cindygarcia8555, We believe it will be possible to file for PIP and adjustment of status even if your waiver is approved, and even if you decide not to attend the appointment in Ciudad Juarez. It is important to note that changing your strategy for achieving residency at this stage of your case may actually add significantly to the amount of time you’ll be waiting for your green card. However, for some people, the additional time and expense will be worth it if they do not have to travel outside the USA to finalize the process. This is a decision that each applicant and family will need to make depending on their individual circumstances.

    Hello, In our experience, 10 years of W-2s should be very helpful in proving physical presence for the required time. However, in addition, USCIS in our experience likes to see documentation showing presence on or very near the critical start date that they have set. For example, with DACA initial filings, they wanted evidence from on or near June 15, 2007. For this program, we expect they will want something dated on or near June 17, 2014. A Form W-2 typically does not issue outside of January, so we would recommend using some supplemental documents in addition to the W-2s if possible.

    Nice Information. It would be very good of you to let us know regarding filing I-751, the USCIS mentioned to give federal and state tax return . Tax accountant gave the tax return client file which include all.Should we submit the client tax return file given by tax accountant or should we submit the tax return receipt from IRS ? Moreover IRS has not state tax return and how to get state tax return ? Lastly two Money orders separate for biometrics & form or one money order for togetherMaam ?

    Hello, @samarpanacademy3813, Glad this is helpful! Regarding the tax filings, in our experience, USCIS likes to see transcripts from the IRS as proof that taxes were not only prepared, but actually filed. However, they will also accept copies of prepared tax documents, but may provide less weight than they would to a transcript. Regarding fees, it is important to verify how and what amount to submit to avoid rejected filings. We recommend looking them up using USCIS’s fee calculator, which you can find here: www.uscis.gov/feecalculator. Please note that separate biometrics fees are no longer required as of April 1, 2024.

    @@jlw.immigrationlaw Thank you so much and well noted, one last question we do have my wife opened the uscis account for me when I was abroad to file the case from USA and she didn't get USCIS online account number option despite reseting password and opening. Now while filing I-751 the option of USCIS online account number box should be left blank or N/A at this time. We would be obliged to get this answer ?

    Hello, @Karenmoreno9545, Right now, it is not clear if people who naturalize after June 17 will be able to request PIP for their spouses. Once the regulations are published, we should have more clarity about this. Also, in the past, we have seen eligibility for certain programs expand over time - for example, when the I-601A Provisional Waiver of Inadmissibility was introduced, it was only available to spouses of U.S. citizens. Eventually, however, it opened up for everyone who could potentially qualify, meaning spouses and children of residents, parents of U.S. citizens, etc. Hopefully this will be a similar situation, where after the program gets started and overcomes legal challenges against it (if any), eligibility will open up for other people. That is what we’re hoping, but of course, only time will tell.

    Hello, @SaizadSunesara, As far as we know, if the petitioner was a U.S. citizen on or before June 17, 2024, then their spouse should be able to apply, provided they meet the physical presence requirements and have no disqualifying criminal convictions. A naturalization on June 10 should work!

    Hello, When a joint sponsor files taxes jointly with their spouse, they are required to submit Form I-864A. The spouse must also submit the same documents as the sponsor - three years of tax returns, three recent check stubs (if applicable), and an employer letter (if applicable). A marriage certificate is probably a good idea as well. If you require more specific information, please don't hesitate to contact us.

    Hello, In our experience, having a prior asylum application filed is not necessarily a problem, but it is important to ensure that the application contains information that is true and correct, and that it remains pending and has not yet been referred to the immigration court.     Hello, @lanteTV1, The DS-260 form “locks” once it is submitted, which is a little stressful when you discover there’s an error like this. Fortunately, what you are describing is not a serious error in our experience. You should be able to easily correct the information at your interview by telling the officer about the mistake.

Ellos entraron legal a este país con visa de turismo y por la situación tan crítica de comunismo y pobreza que hay en nuestro país de origen tuvimos que permanecer en este bendito país de EEUU.     Hello, Without specific research, it is difficult for us to say whether a conviction for breaching the peace would interfere with your visa waiver eligibility. In the USA, this kind of case is typically called “Disturbing the Peace” and it is usually a class C misdemeanor, meaning it is not treated as a serious criminal issue that would make someone ineligible for any immigration benefit - so long as the applicant can provide all relevant police reports and court documents. We would recommend gathering all of the documentation related to your arrest and conviction, and trying to apply for the visa waiver. If that does not work, you should still be able to qualify for a visa, though it will require an interview. If you are able to share with the consular officer that the interview is extra challenging for you because of your diagnosis, then they will have a little context and hopefully empathy for you as you go through that process. At risk of TMI, I will share with you that one of my daughters is autistic and also has Tourette syndrome; she had a tic and made an obscene gesture at the consular officer interviewing her for a replacement passport in San Jose, Costa Rica last year. Thankfully, the officer just brushed it off immediately once we explained the health situation.

    Hello! Technically, yes you can. However, your wife will need to participate in the process and sponsor you for the affidavit of support and adjustment of status after the PIP is approved. If she is willing to do that, you can move forward, but it would definitely be good to consult with an attorney to ensure you avoid any misrepresentation findings or any other kind of problem with your case.

    Hello! Typically, it is important to seek to terminate proceedings or register an objection to the NTA as early in proceedings as possible. Courts have indicated that objections raised before entering pleadings to the NTA should be considered timely, so as long as pleadings to the NTA have not already been entered, you should be able to object to the lack of time and date information on the NTA.     Hi, I’m 30 years old and just applied for naturalization. I’ll be 31 in 2 months (possible before my interview). Am I facing any chance of denial since I’ve never applied for selective service? Or because they’ll interview me when I’m 31, I should be fine?

    Hello, If you are a man who was living in the USA between the ages of 18 and 26, you were required to register for selective service before your 26th birthday. However, many applicants for naturalization did not know about this requirement, and didn’t register in time, but they’re still approved. In our experience, failure to register for selective service is not a barrier to approval if you can demonstrate that you are willing to serve the country however you can, and if you can explain the reason you did not register before you aged out.

    Hello , what if i sponsor 2 adult kids at the same time , do i put 1 for part 5 #1 and part 5 #5 1? To make a total of 2? Considering i will fill up 2 forms (I-864)

    Hello, If an adult child is the beneficiary of an I-130 that was filed just for them, then they will need a separate I-864. If their sibling is in the same process and is not yet a permanent resident when the I-864 is filed, then that other sibling would not be counted in the petitioner’s family size. If the adult children are applying as derivatives of a parent’s I-130 and are “following to join” that parent, then the family size on the I-864 may need to increase to include the entire family group that is immigrating under that single I-130.
