    If a lawyer doesn't contact a 'witness' they have likely done their due diligence and the credibility doesn't add up, or they don't have anything to contribute to the case, or can possibly hurt the case.

    Doesn't mean anything. The lawyers might not think it's relevant to the case to even contact her. Or they might be waiting until further down the line to contact her. In the Johnny Depp trial they literally had one witness who was contacted the night before he stood infront of the Jury. Doesn't mean anything at this point mate

    Power dynamics are a bitch. Lets say Xeno texted you at 3AM saying "Hey, I think you are so cool and I need someone to talk to. Can I come over?" Most people are going to say yes even in this much lower risk situation. (And Xeno is a majorly upstanding dude.) When its a boss/manager, when its someone in your field who can help your career, etc. the ability to say no is basically stripped away because they cant afford to miss the opportunity and cant afford to risk the potential damage. In an office environment there is training and regulation and protection... in streaming there is nothing.

    Quite honestly, and this coming from a woman, if you've been assaulted sexually in any shape or form, especially if this person is already under investigation, you should go to the police. Not the f****** internet. If anything, this person just sounds like they are looking for some sort of attention, whether it be good or bad, I don't know. Also, the fact she came out with this online, and not to her lawyers, already puts things in question. It's very likely a judge would ask why she did that instead of contacting law enforcement? She's really not helping anyone out by doing what she has done.

    More people really need to look at this things way. I get that going to police can be tough, especially since they don't always do anything, or do things properly. But the simple fact of actually filing a police report in situations like this is a HUGE positive for any future legal issues. Anyone that goes to the Internet first really need to have everything they say to be viewed with a giant pile of salt. Their allegations may absolutely be true. But trying to have someone judged by the court of public opinion is NOT the right way to go about things. Anyone that sees a lawsuit filed against someone, and feel that they had the same thing happen to them, and goes to the Internet first instead of talking to a lawyer also really needs to have everything they say looked at skeptically, and not just instantly believed. *Especially* if they are making allegations against someone anonymously. I know a few women who have actually been sexually assaulted, and the *LAST* thing any of them seem to want to do is go blast that fact to the world on the Internet. Reiterating what Zora said: Women, you are not doing ANY victims of sexual assault ANY favors by dogpiling on people on the Internet. Go to the police. Go get a lawyer. Twitter will likely hurt your case more than help it.

    @@AeriFyrein I must echo this sentiment. We really need to make women understand, as well, the extreme value of a rape kit. Many victims (and plenty of false accusers will take advantage of this behavior) will wait until after a rape kit exam would be useless before making their accusation because they think the process will be just as traumatizing again, or want to run away from it, but I guarantee it's so much easier to get a conviction in court when a rape kit exam is done, it's unbelievable. Not to mention, police will take your case more seriously if they can get a rape kit exam done off of you. The exam is to collect evidence that will be lost with time, and it rapidly turns into a "he said, she said" dispute that the police can't do as much with if you wait. So please don't wait, please don't delay in going to the authorities when something of the sort happens.

    @@AeriFyrein This needs to be said more often. This person is causing more harm than good, and making victims seem less credible than ever before. Crying wolf publicly never helps and only hinders, especially when it's done for attention. I'd also like to say that, like so many other people who have been abused or victimized, it is often embarrassing and shameful to admit to ourselves, let alone the public or anybody close to us what we went through. Heaven Knows it took me months, if not years to be able to speak about the fact I had allowed myself into an abusive relationship. I cannot imagine what it might be like for somebody who went through sexual assault.

    I'm not saying I believe her, but the timing is not the suspicious part. If you don't have the courage/will to go forward with an accusation yourself, then somebody else doing it first handles the difficult part for you. You are also more likely to think you will be believed.

    a lawyer might not contact a potential claimant if there is a jurisdictional issue in doing so. but it should be said, in Richs defamation filing his council reserves the right to add litigants to the defamation suit which means that both parties are at least aware of 2 or more potential claimants against Rich. the fact that one is remaning anonymous is the smart thing to do.

    This girl....I don't see how this is a thing at all? Where is proof? Why did she never talk about this in the texts with Rich? Just said she "doesn't want to keep a relationship private cause it causes drama" or whatever? This whole thing between all parties is just ridiculous. And he'd be right in telling her not to go public, her character and personal life would be shit on just like the original girl. any woman who accuses someone with a fan base basically knows their own life if going to be dragged through the mud complete with death threats, harassment, and possibly legal obligations.

    Which is part of why I believe women and victims at their word. If its just spouting shit off I might not take it seriously, but when a lawsuit is made these people are basically signing up for their lives to be ruined, I absolutely applaud their bravery but theres a reason why like 9 out of 10 women who have been abused and assualted choose not to report and not to take legal action. Speaking as someone who has been abused, the idea that we dont take our abuser into account is ridiculous. Its actually a major part of why I didnt make anything out of it, I was pushed up against a wall and there was an attempt to coerce me into sex after I had already said no. I said no again and they backed off, and later they apologized profusely; we had dated for 3 years before this and there had never been any real red flags other then emotional immaturity (We were both kids from... complicated homes who got together right after high school.). My faith in them was rewarded btw, they are now happily married and have 2 great kids. Even after MeToo it is so hard to prove SA and R@pe, and the social retaliation is still so thick and extreme that most choose not to press the issue just on that. To be clear Im not saying we should jump anyone's legal rights, buuut yeah if I had any idea who this dude was I would stop watching his stuff. He will get his day in court, the odds are in his favor, and he will or will not see legal consequences after he is found guilty or not guilty.

    I think this makes rich look more guilty. His messages are persistant and he insists everything be in person or via voice/video calls where no evidence can be recorded. Also his pushy nature and absolute disregard to these womens boundaries leads me to believe he absolutely COULD be attempting coercion in person. Which btw IS sexual abuse. Any physical contact without consent, any coercion is abuse full stop. Kissing someone without consent, putting their hands on your genitals without consent is all sexual assault. You all need a fking lesson on what constitues sexual abuse and consent. In no way does this make rich look less guilty. It makes him look more guilty. The only thing we cant do is instantly take it as truth.

    @gr33dl0cknein3 look at what coercion is and you'll have an answer. Coercion is what I'm focusing on here. There's many reasons women continue to interact with dodgy or abusive men. It's very common to keep contact with a creep, a main reason including fear of consequences. Coercion and manipulation take place. It's never a completely nasty violent experience pal. Look it up. Educate yourself. Please.

    From my understanding women on twitch have really really struggled hard to be taken seriously. (Just commentary on that one tweet.) A friend of mine has been on twitch (I dont bother with it) for years and shes.... displeased with a ton of people whose content really more borders on OnlyFans. (And to be clear her issue is less that it's on twitch and more that its on the front page half the time.) Alt opinions. I tend to agree with the tweet... but it makes for an interesting irony. Thirsty and shitty guys treat women like shit and get less chances to view breasts. Its like the pick up crap, before about 2010 most girls I knew were open to meeting someone at a bar, or club, or out; afterwards most of them will trade numbers but you are no super suspect. Me personally, never been my thing. I didnt know who Rich was till I opened this vid. ... guys and gals if someone says you are playing games or it feels like you are playing games the response is "I'm so sorry. Let me make my intentions clear." basically anything else.... and my advice to them is to drop you, if you cant be honest about your intent then you wont be honest about anything else. Also if someone isnt willing to talk to you on discord but wants to talk in person... red flag. Also the refusal to text is also a red flag. Her story just on how he has persued her would elicit from me "Girl this dude is bad news, even if you got a pushy bad boy thing... this is not that." On her maybe shopping the texts, yeaaaah but most carriers tag messages and the like. There's some digital sleuthing to disprove that kind of thing. Opening herself to testify would mean she's either telling the truth or she's on a collision course with false evidence. Its fairly rare for women (or men) to make up these kind of allegations... and even rarer for them to be willing to take them to court. (It's already a nightmare trying to get rapists and other predators convicted the system is slanted in their favor.) And this is all even assuming the carrier didn't save the exact messages. Also if they are on his phone then he can enter his phone into evidence and she would basically have to do the same, not every case can afford to get phones examined... but this one almost definitely can. That she was willing to hang out with him after his sexual assault adds some... incredulity. Plenty of victims get trapped in relationships, but that's usually a bait and switch where the abuser acts "like a nice guy" until their victim has given them access. For this where they are more in the flirting/"dance" stage... it makes it unlikely, not impossible but... odd. Also again if someone refuses to talk over the text much less the phone.... red flag. Id stop texting someone who said that (At this level of interaction. A tested friend or family member would get a sure, but someone I barely know much less someone whose already tried pushing me on themselves would be a flat no to meet in person. Like that sounds like im about to get Taken and I dont have a Liam Neeson to murder his way across Europe for me) Annnd I like that I was down here writing this when I heard your talk about his lack of response and in my head predicted exactly what you were going to say. If you, dear reader, ever find yourself on the legal defensive SHUT THE F*CK UP. It is your golden rule. "But Im innocent" doesnt matter shut up, "but the cop says by not talking I look guilty!" sweet heart every cop in the precinct is your enemy when you are in custody, especially the nice ones their goal is to solve a crime and they have already picked you as the person to pin it on. Lawyers are even worse, they are looking for ANYTHING to break apart your case and the legal standard of proof is different then the scientific or cultural norm standard of proof and it is easy to kill someone's aliby or story when they are flapping their gums. Now there are reasons for this, a clash between constitutional rights and a need to solve crimes has lead to a.... defenitely flawed at best justice system it DOES ussually get the right people, when it gets the wrong people its because those wrong people failed to properly use their Constitutional rights. The only thing you say to anyone is "I am invoking my 5th Amendment rights and I would like to speak to my lawyer." Physically you must comply with the police, but you do not have to say anything (And they also have to have a warrant to be on your property or to search your property unless they can physically see an illegal or criminal item or activity.). The Cops, the DA, the Judge even; dont really care about the truth the cops want to solve a case, the DA wants a win, the Judge is 50/50 but plenty of Judges err on the side of the state. And this includes for civil suits not just criminal. Yeah, it is fairly weak evidence. It at best is fodder for evidence of behavior. Some of it checks out or can check out, and the defense will have a reasonable chance to challenge (For example if his texts show a very different story). Sadly with SA and r@pe there is very rarely a smoking gun, and even when there is a conviction is very hard to manage. (Despite what Redpills have deluded themselves into believing. The actual fallout of MeToo was almost nothing. Most of the big cases walked, and the handful of people who had real consequences.... it was really more a slap on the wrist.) Do I believe her? Yes, SA and rape has the best report statistics. It is more likely that someone comes into a police station and says they were mugged when they werent then it is that someone falsely claims rape or SA. Could she be lying? Course, but it is unlikely and that she is willing to go to court makes it even less. I dont know this guy to cancel, but yeah I believe her. Separately its nice that we have similar taste in 2 hour music youtubes. :p

    A bit more on law enforcement. The reason LE is so aggressive is because it is very hard to get a conviction. There are a lot of laws and rights meant to protect people from incarceration and other punishment. The State has to have a solid case to convict.... if at least you are a Male WASP the further away from that you are the easier it is to convict you because of Judge and Jury prejudice. When these groups say that our criminal justice system is broken... it demonstrably IS.. BUT if you are a Male WASP or close to it, it does generally work in your favor... so long as you follow your rights. And that is by design, the Founding Fathers definitely erred on "It's better to let criminal walk free then to put an innocent in jail." For victims over the years that has been frustrating and it has been frustrating to law enforcement and to judges... so they play hard ball, they know the rules and they are going to use every trick they can. Unless you are the victim of a crime or reporting for one you should NEVER talk to the police and you should only communicate what you have to. If you saw a white guy with blonde dredds assualt a baby, you say that and only that. You don't speculate, you don't add details you report only what you are certain of. If the cop is trying to ask you about other things use your discretion but after you have adequately communicated what you are certain of "That's all I saw, and hey I have to get home for *true reason*, so unless I am being detained I gotta get out of here." Because every cop you talk to is looking to pin the crime on someone... and you are someone. If you are a victim, you can say more... but the further you are from WASP the more critical they are going to be, and for women you can walk into a precinct with a recorded SA where you are clearly screaming and crying "No, stop I dont want this", with a sample of his semen collected by a medical professional and still walk out with the police doing nothing for you.Yes even after the MeToo movement. (This is very rare, but it does happen.) back to criminal rights- The moment you are being detained or in custody "I'm going to exercise my 5th Amendment right to silence." You do have to state that, if you just sit there not saying anything the police can use that as evidence. If you say it and the police continue to question you "I'd like to politely remind the Officers that I am exercising my 5th Amendment rights and will not communicate further without legal counsel." If you cant remember that "I am using my rights to remain silent, and I request my lawyer be present." The idea is that with how comprehensive our criminal protections are that the only way the state could bypass them is if the evidence is clear... but that only works when these rights are use appropriately and a lot of the time they are not. Plenty of criminals walk free and Im not saying that an innocent person didnt follow these exact tips and was convictred anyways... but generally if you use your rights, its hard to convict you.
