A mother’s story of her son’s murder conviction - for a crime he was not present for.
Calum Farquhar was convicted of murder under Joint Enterprise law, after a botched cannabis burglary led to the death of Christopher Allbury-Burridge at his home in Northampton in 2020.
Calum was sat in his car outside the house when the murder took place, but he received the same sentence as two of the three men inside, including the man responsible for the single stab wound that ended Mr Allbury-Burridge’s life.
Guilty Bystander explores the dramatic stories of people convicted under joint enterprise law. They are in prison for a murder they were not present for, or even knew was going to happen.

    she’s in denial. her son was involved in organised crime, drove to the scene of the crime and his car would’ve been used to get away from the robbery. In a bank robbery, the getaway driver is arrested and charged and he was essentially the same role. A life sentence is harsh, however a person was killed as a result of their attempt to rob the house.

    100% was probably a gang member from the age of 16 like she said. Just got away with most things before. He should’ve got a lighter charge but still got 15 years anyway so it’s hard for them to complain

    so that soesnt make him guilty of murder because the narrative is he was in a gaNG not all people into gangs are preadtory county lines drug barons and involved in extortion and murder when in reality it was prob a music connection they did a load of guys fro same thing cause they made a drill video and portrayed that as a gang lifestyle thing and he got done under joint enterprise and its unjest and unfair and its not the same as inference where they could argue you were in on it cause we got survalaince to say you were in on it but joint enterprise is unfair and because someone knows someone in a gang like everyone does just through life and then is getting pulled in on a murder wrap just cause he knew the guys then thats unfair a lot of these young kids and the gang thing lot of its just a music thing and everyone they know is doing it doeasnt mean their doing it and its not inference and proof of con spiracy by survallaince and proving the burden of proof joint enterprise is didfferent

    @@djdarksidejungle559 he wasn’t pulled in just because he knew the guys??? he was pulled in because he traveled to the scene of the crime, was involved in the planning and his car provided a veichle to get out of the area. I get the temptation and circumstances can lead to being involved in crime and gangs, however this does not mean people should receive light sentences. In my opinion the mothers denialism most likely contributed to how he ended up in this position, parents need to stop being in denial that their once innocent children havent became involved in crime.

    Pretty sure the entire point of ‘joint enterprise’ is to deter people from being involved because they’re ‘only a driver’ or ‘only the lookout’. Without those people the crime may not have successfully taken place. Makes sense to me.

    Let’s be honest here. Even if he had no clue they was going to kill. What he did know was that the guys he was with were not going to pussyfoot on this mission. They had already drove 70+ miles, so if the mission flopped or plan b came along, I’m sure he was aware of the consequences. Yeah he may of not know that someone was gonna get killed, but he sure knew they was capable, otherwise he wouldn’t of done the move with them 🤭 your rolling round with dangerous guys & your suprised they killed someone? Ride your bird bro. You was happy robbing people on the street & now you got karma. Are we suppose to feel bad? Like Foreal.     Interesting to read the comments, because I’m in agreement with both the mother & the lawyer. The mother never once said she believed her son was innocent & should’ve got away Scot free, nor is the lawyer saying that. They’re questioning if sentencing should be the same for the perpetrator of the murder, & the one present who wasn’t aware they had a weapon or had any intention of harming anyone. I don’t believe it should. 26 years (whether he serves that or not is irrelevant right now) for something he wasn’t physically present for in the moment, & to be accused of murder, is very damning, not just because of the ‘life’ sentence (which would’ve been on par with the actual murderer), but the stigma surrounding that label when he exits prison will never leave him. He should absolutely serve time for his part, but 26 years for murder? Eh.

    I watched another video where a man was stabbed and killed in a honey trap murder for two Rolex watches. It was clearly a Honey trap operation but only one man was charged for murder the tow females and the other man were charged with manslaughter. It seems these judges pick and choose.

    I’m a criminal, I went to jail. Hate to burst your bubble love but your sons a criminal too. He went there to help someone rob someone’s house. Answer here is tough shit, you can’t do what u done then cry about it when you get caught. Wish these people would stop acting like their kids have done nothing wrong. If it was any of my kids I’d be like shit his going jail we need to get him out the country, I wouldn’t be saying oh no his innocent

    So if the same logic applys, if the CPS falsely prosecutes innocent victims who after are found not guilty at trial ,the CPS ,lawyers ,judges ,prosecution witnesses,court staff ,police ,and prison staff should all be held accountable for joint enterprise.

    At any second he could have turned the car round and said ‘I’m not driving you there’. He could have driven to a police station and reported them. He could have stayed at home and called the emergency services. Any of these things could possibly have meant that the poor man would still be alive and Calum may still be free. He only has himself to blame I’m afraid. His poor mother though who clearly loves him very much.

    The whole point of joint enterprise is to stop people enabling others and then getting off with it themselves. It's quite simple, if you don't like the idea of serving time for a crime, don't do it. Then you can't face a punishment you may deem unfair. The mother uses autism like some sort of excuse yet she knew he was "vulnerable" and hanging out with a nasty crowd so what did she do to prevent him continuing on the path to where he ended up?

I heard her mention he had mild autism, but that’s as far as it went. You don’t think as a mother she tried desperately to help him after she found out about the first set of robberies? You’re presuming she just let him roam the streets without intervening? Have you heard yourself? He’s a grown man, is he not? He’s capable of making his own decisions in life. He knows right from wrong. Short of locking him in her own home, you can’t prevent him from continuing to make the same mistakes if that’s the road he’s chosen for himself. You can not blame adult children’s behaviours on parents for the rest of their living days. However, he certainly was no murderer & shouldn’t have been sentenced as one, & anyone with more than half a braincell knocking around would agree to the absolute ludicrousness of joint enterprise. He should absolutely be punished for being part of a robbery & do his time, but to be hit with a murder sentence when he wasn’t even aware they were carrying weapons, let alone aware of his friends intentions of harming anyone; they even said on returning back to the vehicle ‘we didn’t know anyone would be home’ - so how was Calum meant to know of their apparent intentions of bringing harm to anyone?

    It's an 8 minute clip. That focuses on the issue of joint enterprise and the unfairness/injustice in that regard. The flaws in the legal principle and how its applied. This was not the place for where mother talks about her response or lack of in relation to his unsavoury peers. Don't be so judgemental and harsh. I've had over 15 years of seeing this stuff working in criminal justice with adults and youths. A lot of people like to take and a hard line law and order stance when they think they have the security of being so far removed that they will never experience the injustice or unfairness within the system.

    I speak to my son about oversight more than anything because that's what a lot a young people lack. I remember in my younger days working in a very busy London club and i was friends with a certain VIP...i knew where he lived and months later at work i get a call from someone i knew at work for being a big spender and tipper asking me to give the address of my friend for twenty grand...it was big money for a struggling student back then but it never crossed my mind because i knew that on judgement day nothing would have happened without me..i was at the center of all that would take place but then again it came easy to me because my father second highest ranking officer back home so i grew up understanding how things work than most so my advice to parents just talk to your kids about the importance of oversight and choosing better friends so far im lucky in both.

    I don’t think the joint enterprise law should be completely scrapped but each case, such as this, should just be reviewed extremely carefully and with caution. Unfortunately, the law is still needed for the intentionally guilty.

    It definitely should be the same for the driver. The driver is just as necessary for the crime to be committed as the others. What if drove someone to kill one of your family members, you think I don’t deserve life when I would of been directly responsible for the death?

    Unfortunately, knowing about several autistic people in extended family, they can become vulnerable to people involved in crime or be exploited in some way. They need to be safeguarded as part of social care, this is policy and councils have to follow it up. But with social care being what it is at present its not easy. Its probably quite hard for a mother to stop her son hanging out with dodgy people but that is what would have to happen and she would need support with that.

    Callum went to my secondary school and I honestly didn’t even know he had autism tbh. And I knew him fairly well. We were good friends especially in year 7. He was a naughty kid but never villainous. Like he wasn’t a bully or a thug . Just a class clown who wouldn’t keep quiet. He definitely wasn’t vulnerable lmao

    @@Richhfellas thanks, yes the word vulnerable is a tricky one and not easy to sit with. One of the people I mentioned above who is autistic is over 6 foot, broad and can handle himself but because he's too nice and easily led, he got coerced into doing something and got in trouble with the police. And unfortunately, it is a bit of a thing that manipulative people will target those who are neurodivergent or marginalised in some way or other

    If say several people for example were involved in the incident , and someone gets killed, and you don’t know who did it. Then joint enterprise should be used. And if say numerous people were involved, but didn’t commit any murder etc then their sentence should be different to the person who committed the murder. I do feel that joint enterprise is needed.

    I was just watching the Luton honey trap robbery/murder. The intention was clear to rob and the two girls drugged, held the door open, alerted and escorted the two men to rob the victim and one of the men killed the victim. Their involvement is in not doubt. But 3 of them got less than 10 years and the killer git 30 to life. I am here scratching my head. Calum got more than all of them including the actual murderer. How come ? I dont understand.

    Well you don't see all the evidence in the trial. If he argues complete innocence and not guilty verdict, and the prosecution found clear evidence that he knew exactly what was going on and had a knife himself, then the harshest sentence will be given if found guilty by the jury.

    You lay down with dogs you get fleas, you can also get a life sentance. If you knowingly put yourself in a position where a crime is going to take place then you should be held responsible for the entire crime. I getaway driver for bank robbery has been part of that robbery, they are not just guilty of double parking and speeding. Autism is not a excuse, perhaps if Calum got out of the car and called the Police when he found out someone got stabbed rather than drive everyone away maybe things would of turned out better for him.

    Ultimately he knew that he was off to rob a house, and that one of the people with him a knife. He wasn't sorry enough to refuse to drive the co conspirators home, or to rat them in. 26 years is light, considering he will probably do all of those years. Moral of the story, don't be a serial burglar, and hang around with people how carry knifes.

    Rather than deterring it, this law incentivises murder: Where there are two or more parties, each is legally culpable now, so none of them has any reason to NOT inflect the mortal blow as they will all get done for murder anyway. Seems heavy headed to the point of being illogical. I don’t buy the mum’s act by the way. He was a bad egg.

The point of the joint enterprise law is to deter people even getting involved and assisting in serious crimes under the assumtpion 'Ill get a lighter sentence as im no doing the serious act myself'

    Mmmm, breaking a window required a knife 🤔. A family will of course , always see the best in their children. This is a natural state of being . He was always a good boy , who just happened to be involved in burglaries with his friends before this incident . Well madam , a man died this time round . Your son drove people to the location of the murder . I’m sure he would have been more than willing to share in the spoils of the crime , if it had gone smoothly ,& no one had died . But someone did die . And just as your son was willing to take a share of the cannabis/ cash , he should take his share of the prison time . He’s not a little boy , he’s a criminal , who thinks nothing of robbing other people . Had something happened to one of your family members , how would you have felt about all the people involved in the crime . Had your son been killed in similar Circumstances , would you have demanded everybody stood trial for his death ? Or would you have said , oh he just made a silly mistake ?!

    In this case the law has been used adequately and correctly, if you are going to commit a burglary with others then an altercation / murder is an obvious and inherent possibility.. other cases should be looked at but for cases such as these the law needs to be kept

    You have 2 choices. In the dock with the perp or in the witness box putting the perp away. This should be taught in School.     Great short film reveals all that is wrong with our so called justice system. As for the ill informed commentators imagine how you’ll feel when a simple thing happens to you. If we ignore this brutality enforced by the State it’s only a matter of time when it becomes so normalised anyone of us will be doing life for not doing anything at all. Joint Enterprise is even being used on people who protest for a better world. Be careful what you wish for because life has a funny way of giving you what you ask for but not as you expected!!!

    Joint enterprise has been applied incorrectly for over 30 years. Supreme Court confirmed this in a landmark ruling in 2016. The issue is clear that the cases over them 30 years etc should be reviewed against the ruling. I don't believe this has happened which means many people are serving time for murder when they are not murderers. The ruling said the courts were setting the involvement etc to low. I think this is a clear case of the law being applied I correctly.

    if he had been told we are going to do a deal with a supplier but want 2 cars as the odds of both being stopped and losing the whole lot are very slim. However unknown to him they were going to steal the weed, would he still be guilty of Joint enterprise and murder.
