Cops arrested him in his driveway for a traffic violation-then they crossed the line | PAR

Shawn Bresnahan, a resident and local mechanic in Greenbrier, AR had his world turned upside down after taking his newly repaired car for a test drive. Due to a clerical error, Bresnahan had a suspended license at the time. Local cops were all-too-quick to take advantage of this by confronting and arresting Bresnahan in his own driveway. Not satisfied with publicly humiliating Bresnahan and placing him in handcuffs, the police also impounded Bresnahan's $30,000 vehicle, a decision which Bresnahan says has cost him dearly. Stephen Janis and Taya Graham of the Police Accountability Report investigate the case as an illustrative example of the lack of accountability in small town police departments.

    @chd176 Hello fellow pedant, I'm Fasil. I think we may be witnessing a shift in American English when it comes to the word _loose_ as opposed to _lose_ . It's similar to people writing _could of_ instead of _could have_ or _could've_ . I've also noticed the dollar sign moving to the end of a number _20$_ rather than _$20_ .     all this what? suspended license is automatic arrest and tow in the vast majority of jurisdictions. anything other than that you've been very spared. suspended license isnt just a term. it is a prohibition to drive. you are specifically barred from driving while suspended.

    Resist is the wrong word. They will add a resisting arrest charge. Only a court can decide anything, if you get there later. You can win no arrest argument at the scene; and you would liklely incriminate yourself saying anything in a useless defense. Because a cop is not a judge or a jury,. A useless virtual deaf ear.

    Yes they can resist but by definition they have been arrested.... which means they have been taken down to the station or jail charged with resisting and booked.... there can be no resisting without an arrest.... also if it was unlawful then the arrest should not have happened and the charges would be dropped no matter what the Supreme Court says..... what needs to be done in my opinion is to hold the officers accountable for their actions without the protection they have afforded to them.... if I did something like that in my state I would be charged with kidnapping which I believe is or can be a life sentence

    THIS MAN HAS TO BE STOPPED!!! This VERY OFFICER pulled me over for out of date tags! Clean driving record, VALID insurance and wanted to conduct a full search of my car, in which I refused and he then proceeded to bring the DAMN DRUG DOG & sniff the car! I have audio recording of the stop! But no video 🤬

    Lol then most policing needs to stop because this behavior is pretty common. Most cops are ID cookie monsters and hungry hungry hippos for obedience... sure this level of egotistical unprofessionalism is wide spread but maybe not the norm. However the so called "good cops" violate rights just as much as this guy but just do it more calmly. The good cops are snakes with a smile. Tyranny with a smile, handshake and a sunny disposition is tyranny nonetheless.... You notice the other officer they called a good officer who helped them did nothing to stop the bad officer and even backed up the bad cop? A good cop who allows bad cops to do bad things is not a good cop. And since all cops back up all other cops by default regardless of their bad behavior, there is no such thing as a good cop.

    10 years ago and further back, we didn't have cops like this here in Greenbrier. There was never this kind of BS here. The clerical error isn't uncommon here either. I had an unknown suspended license due to the clerk at the city hall not recording that I had paid my speeding ticket. Nowadays, they let speeders fly through town but stop someone for their opinion of "loud exhaust".

    I dont get the 7000$ what kind of lawyer did the family have that's death, in a lawsuit were theres is clear negligence on the the part of the Employer like Amazon you should see settlements in the millions, 7000$ would be a small down payment for lawyers fee just to take the case. Cases like this render a lot of questions, did the family accept a offer from amazon , did they even have a lawyer, did amazon send council to his home and say this is our offer take it or leave it. Family's that dont have money, live from paycheck to paycheck 7000$ is like hitting the million dollar lottery to them, they never seen those kinds of funds before. Amazon has attorneys that do nothing else but this, they look into your entire life, family, is he the only one working, whats the family income can they afford a lawyer ,many cant and just take whats offered.You can get a lawyer on a pro bono case like this for free because the outcome will be substantial , whats sad is this is a very common thing. It's been around for many century's its the Rich abusing and taking money from the poor, *always contact a lawyer never ever sign anything with out a lawyer, consultations are free.

    The cop violated the wife’s 4th amendment rights and the City of Greenbrier should be held accountable. To the tune of about a million and the officer should be dismissed with prejudice. And, the relationship between the police department and the tow company should be investigated. There is so much wrong with this overreach of police power that it is disgusting.     The 5th amendment talks about not being compelled as a witness against yourself in a criminal case. This means that pleading the 5th is anything you say acknowledges criminal activity. This guy didn't need to plea the 5th bc 1) he's not in court & 2) he wasn't committing crimes.

    "Plantations are still a thing". At 73, I've lived in the south my entire life and traveled throughout Georgia, North Carolina, Mississippi, Tennessee, Alabama, Louisiana and Texas. I've only seen a few 200 year old plantation "homes" which were maintained as historical "museum" pieces. Please, tell me where I can visit an actual plantation.

    Quite a few years ago my husband (long hair siding contractor) was pulled over 3 different times in 3 different vehicles, the last one in our own driveway, and each time he was told they were 'looking for a vehicle that fits this description" the last time I was with him and told the officer I needed to speak with his superior . I then told that officer that if either one of us got pulled over again in our driveway we would be getting a lawyer then gave him our friend's (local attorney running for judge for the 4th term) business card. No more being pulled over.

    Well, he didn't even "pull him over"! He followed him into his property and didn't even get there until the man had gotten out of his vehicle and had opened the hood and begun to inspect... There was no "traffic stop" because the man was on his own property working on his vehicle before the police put on his emergency lights or arrived at the man's property!

    wrong. if they saw you drive on PUBLIC road and then you pulled onto your property, it dont make a difference. they can still pull you over, in your proverbial garage. brush up on the laws. what the cop did was legal 100%. he was nasty but what he did was by the book. in cases of conflicting papers ie his system telling him suspended but some court papers saying not, he has to go by the system and send the case to the court. it was up to the court to notify DDS to remove the suspension! this is not something you can do yourself. at the very least you have to bring in the court documents to the office to see if they will initiate the process and contact the court themselves to verify the removal of suspension. it is what it is. everybody here is blaming the cop for being a cock. yes he was a cock. but what he did was by the book.

    That is what some of our founders intended, at least in principle. A people more armed or at least equal to and as organized and engaged in regards to their common defense and interests as the central government. The federal government was never supposed to be the all powerful and ubiquitous bureaucracy as it has become. It's made up of departments and interwoven appendages so numerous that they are not easily accounted for by the people they are supposed to serve, so the natural course is tyranny trickling down to all levels. Make no mistake, that is exactly what it is, a culture of trickle down tyranny, because we as Americans have lost all three of the points I listed above. Equality of arms, organization and engagement.

    I've seen a few cases, usually in no knock warrants, where the home owner not only survived, but killed a couple officers and didn't face charges. I don't advocate for killing anyone unless you're in immediate danger, but perhaps a number of protections should be removed from police.

    sorry to say this but driving with an expired tag, suspended drivers license and no insurance is not a "minor infraction" - a Judge will tell you this; an attorney will tell you this; police will tell you this. go drive with an expired tag, suspended drivers license and no insurance and see what happens. the reason why is not to "monetize" the legal system but to help protect the public from motorists who wreck their car, injure people and has no ability to cover the damages. irresponsible people who do this also drive drunk often killing themselves and others.

    I had law enforcement do this exact same thing in a similar situation. My mother owns her home. My brothers car was parked in her driveway when he got arrested. LE was specifically told when he was arrested to not impound the car, that it was on private property and it was fine to stay. My brother lived here and the arrest was over a domestic disbute. They left that day without taking the car. We went to work the next day, when we returned my brothers vehicle was gone! The police came back after being told not to take it from private property, and left it, then returned when no one was home, and stole his car!!! You really can't make this up! Its so absurd and down right criminal! This happened last year btw

It was in our driveway in a rural area and they left it there that morning and didn't return until the next day when no one was home. It was WRONG. And when I say domestic, it wasn't an assault. It was a dispute between family members.

    This is an injustice on every level. How is it possible that this cop's superiors would allow he to not only violate Sean, but also make up his own laws. There is nothing, nothing, that warrants what this cop did, and if the roles were reversed, this cop wouldn't have suffered the same fate. I don't care if he didn't have insurance.     My vehicle was stolen over the summer. I had to pay over $400 to get it out of the impound lot. I felt like I was being fined like I had done something wrong even though I was the victim. I was lucky enough that I could afford the impound fee plus a tow because the fee goes up every day. Great system.

    It amazes me how traffic stops work in the land of the free) I'm from a corrupt country in Eastern Europe and a traffic cop approaching you while you were working on your car is absolutely unheard of. If you are outside your car they have zero right.

    They had the legal right to be there, they saw the guy driving onto the property from the roadways so they legally can do a traffic stop. I like where your heart is but its called "hot pursuit".

    miranda doesnt apply unless arrest takes place. you can ask anything at any point prior to arrest without reading miranda rights. detainment is not arrest, cuffs or not.

    Damn this is one of the most corrupt cops I've ever seen!! He doesn't know the laws and he pretty much threatens these people into doing what he wants. This guy is crazy. This cop needs to be arrested himself.

    Wait…..where is the victim? When the cop decided to make contact, who/where was the victim that this man allegedly victimized? Or is there none…..? It’s absolutely disgusting that our public servants pursue victimless crimes. Unless someone is harmed, unalived, or their property is stolen or damaged, there should never be gov intervention (especially cops).

    The officer is wrong ! As an officer at one time. Currently disabled. I had the same situation. A man showed up as suspended. He produced paperwork from the state and a seal from the state. Showing the system was incorrect. The system was not updated. Someone did not do their job and didn’t put it in the system. He was free to go. These folks are on the curtilage of their home. It’s the same as being in your home. SCOTUS has stated under the 4th Amendment. Your home and the perimeter of the home is included under the 4th Amendment. Phone being seized immediately is illegal search and seizure under the constitution. His wife does not have to do anything. She is taking video, the officer is retaliating against her for exercising her 1st amendment rights. We have numerous civil rights violations. The officer is escalating the situation. Not good for the officer. Who cares if the officers ego is hurt. There is enough case law about situations such as this. Towing his car is in retaliation.
