Bullying Cop Gets Outsmarted by a Street-smart Traveler
The interaction begins with the officers asking the man to leave the premises and inquiring about his vehicle's license plates and state of origin. Under the Fourth Amendment, which guards against unreasonable searches and seizures, the legality of the officers' initial approach hinges on whether they had reasonable suspicion of criminal activity. The officers' inquiry about the man’s vehicle registration and plates could be construed as part of a routine check if justified by specific observable facts leading to suspicion of criminal behavior, such as expired plates or erratic driving.
The escalation appears when officers request the man’s identification. The request for ID in itself is not unconstitutional; however, it requires a lawful basis. Here, the man's refusal to comply without reciprocal identification from the officers brings up a critical discussion point about the balance of power during police encounters. Legally, citizens are not required to provide ID without just cause, and police must provide identification upon request, fostering transparency and accountability.
The label "free inhabitant" used by the officers is peculiar and incorrect in a legal context. It likely refers to fringe interpretations of legal status by sovereign citizen movements, which are not recognized by any court. This misidentification suggests a misunderstanding of legal terms, which complicates the lawfulness of the encounter.
As the man invokes the Fourth Amendment, he underscores his right against unreasonable searches. His refusal to provide ID without first seeing officer ID is grounded in a reasonable desire for mutual legal compliance. This standoff pinpoints a frequent area of conflict in police-citizen interactions: the assertion of rights versus perceived non-compliance.
When officers mention potential charges of criminal trespass in a publicly accessible shopping center, they touch on the nuances of trespass laws, which generally require that an individual must first be asked to leave by the property owner before such charges can be valid. The man’s insistence that he has every right to be in a public space underscores the legal protections against arbitrary police enforcement.
The eventual decision to let the man go reflects a de-escalation technique that also implicitly acknowledges the lack of a clear legal basis to detain him further. This resolution, however, leaves open questions about the adequacy of the officers' training and their understanding of the legal standards governing their interactions with the public.

Unless he was told to leave repeatedly by the store manager AND he only did so when the cops were called… the store manager should only have to tell him once to leave. Granted we don’t know if that happened.

You got to be a pig to understand their logic, love how that pig keep saying “that’s not how it works” when he don’t even know how it works, no crime no authority over us is how it works, asked to leave is not a crime until you return.

The cop admitted there was no charge, thus no ID.

Cops damn well better know that you cannot trespass somebody unless that person has been told to leave and they said no. You cannot trespass somebody before that process, and therefore you cannot use it as an excuse to get their identification. But that’s not gonna stop a cop from lying to you.

Washington DC or Washington State? What an idiot. Then he tries to make it seem like he knew, but he was just asking. Yeah, right.
You have to be asked to leave and given an opportunity to leave before being charged with criminal trespass.

That's the worst dressed cop I've seen in a while. Name tag offset, gun on the front of his belt, looks like a security guard instead of a police officer.
It's amazing how cops don't know how trespassing works. They clearly don't know that one must have an opportunity to leave BEFORE a criminal trespass.

Yep, but unfortunately, TOO MANY tyranical Thugs don't care!
I find that suspicion is an opinion not a law
"Sir, do me a favor, get on your knees and beg for my forgiveness. Prostrate yourself before me, peasant. My ego doesn't appreciate you believing you are in any way equal to me."
Isn’t it horrible when citizens behave in such a confrontational, evasive, or obstructive manner? But… we wouldn’t have to be that way IF cops were not ALLOWED to LIE to us! Just imagine a situation where the cops HAD TO be honest about their intent. Where the cops, instead of fishing and attempting to intimidate us, and trying to put words in our mouth. Instead if a cop was compelled to be honest with a taxpaying citizen, then the citizen could speak freely without fear of reprisals. I say, and will always say, SCOTUS making a decision that cops can lie to us, is the stupidest, most backwards way of Representing Law!
law enforcement has no rights,,, they are public employees
Da bluegum OAF-icer did not know the difference between Washington D.C. and the state of Washington? I hope he can find his way home after his shift is over!
Is there anything more excruciating to watch than a cop trying to look clever?
This guy is amazing! I'm surprise cops don't know about the US constitution and how a criminal trespassing works.
The proliferation of cameras is an absolute game changer,
This is called entrapment.
Lol, he took the cops on a VERY long walk, and they never even realized it 🙄🤣
In the end the cop did the right thing, which is better than most I guess. I'm thinking he knew what the right thing to do was the whole time, but chose to attempt to violate the man's rights.
Yeah you put your silly blue note book back in your top pocket cause you've just been outsmarted.
Cops always want their cookies, as they're constantly looking for power tripping psychopaths.
Why oh why did you sit on the ground like a good dog?
Why do we think that because you are a cop, you have ALL THIS POWER.
Failed as soon as he sat down like a good little doggy.
CRIMINAL Trespass??? See I thought that was wrong? I thought you first had to be asked to leave? Which is being trespassed. Only if you Refuse to Leave OR if you Return, that’s the only way it’s Criminal Trespass (unless you had committed a crime).
@johnshaddick6858
Ай бұрын
Yes , you are right. That is the way it works. Cops can not trespass a person themselves, unless there is a formal trespass by the property owner. Also , cops can not solicted a trespass.
@fourgotten
Ай бұрын
In addition, even if they could trespass, they are only warning g of trespass - it is not criminal trespass unless the subject refuses to leave. At this point, they have no basis to detain (as a matter of fact, they must NOT detain him, as he is willing to leave) nor have they any basis to compel identification, especially in Texas, where the law states that you only have to identify when legally arrested.
@johnshaddick6858

@@fourgotten Very true. Unfortunately cops come up with their own laws. They are nothing but tyrants. Only we the people can stop their behavior.
They solicited a trespass to get back at travis. Retaliation. He should call walmart and see if they requested that. And also foia all calls on the case
lol. Travis has this cop explaining "tron" in the middle of his investigation. Straight up verbal judo.
Travis is a great auditor and a hoot, as well.

He shouldn't have sat like a Dog!
Hasn’t been properly trained Is misinformed Is uninformed Is lying Is stupid Is corrupt Pick one. They’re the only reasons this chatterbox cop does what he does.
How can we call these clowns officers of the law when they don’t have a single clue about the law, and what’s more they don’t care about the law it interferes too much with their mission to arrest any one they can regardless of the law.
Must be a slow day.
Cop's "form" does not alter the law.
The ketchup is "HEINZ" and not "HEINZE"
Travis wore them down again. Good job.
Those aren't are cops They are soldiers of an army of occupation.
What qualifies as tyrannical government?
Texas 38.02 states one is only required to ID when lawfully arrested. This ignorant thugs abuse Travis endlessly (ID, dob, sit down, etc) NO ONE needs to provide ID when asked to leave a property.
Travis out copsplains cops till they get irritated and leave😂😂😂 shit never gets old
"A free inhabitor" 😂 I suppose that decribes Travis pretty well
Typical tyranical behavior.
The cop didn't realize he is on the show Punked.

Tell them to eat crap snacks
The pigs are there and they have their 6 weeks training behind them
Travis is too fuckin nice to these tyrants.
This cop is as ignorant as it gets. If he's not being charged with a crime, they have no right to demand his ID.
I don’t think they can trespass unless you refuse to leave which they can’t say you did because they are detaining you from leaving.
Texas penal code 38.02. (a) A person commits an offense if he intentionally refuses to give his name, residence address, OR date of birth to a peace officer who has LAWFULLY ARRESTED the person and requested the information. (ID) (b) A person commits an offense if he intentionally gives a FALSE or FICTITIOUS name, residence address, or date of birth to a peace officer who has: (1) lawfully arrested the person; (2) lawfully detained the person; or (3) requested the information from a person that the peace officer has good cause to believe is a witness to a criminal offense.
Like always you can tell he is the boss
@ 5:30 is the perfect example showing officers don't listen when citizens talk. Travis spells his last name slowly with clear annunciation and because the officer, who is not listening to him, gets it wrong. Shows the continual disconnect with "law enforcement", or as I call them, revenue agents.
When a cop asks for a citizen's ID it will include confidential information, when a citizen asks for a cop's ID it will not include confidential information, only the cops name and badge number.
Dude Travis has come a long way since the olden days of KZread. He is NOT an auditor, he never was. He used to approach police when he saw them doing illegal things. That was a long time ago. Now he just travels across the country being incessantly harassed everywhere he goes. It is insane that he has lived this long without being murdered by the police.
This cop is really bad at analogies.
Oh wow...the cop didn't know what a Washington State license plate was!!! And they don't know the trespassing laws either???
Excellent content thank you very much God bless you sir
Texas cannot get ID unless you are arrested. 38.02
In order to trespass him they have to allow him to leave.
How did he outsmart them? He complied and they won.
no one ask him to leave first
He spins them in circles and they don’t even realize it😂😂
Looks like Travis got a new car. Good for you!!!!
This guy didn't outsmart anybody. He gave his name & sat on the curb. Loser
Too bad the guy only had a modest understanding of his rights. They wouldn't have gotten shit from me.
