Stupid Deputy Tries to Bully Law Student for ID

    I wouldn't go so far as to say that he was "bullying him", and yes, it's possible he knew the law in this matter. He even acknowledged that this guy has the constitutional right to record the jail from a public space, but he fell into the well-known trap of citing "officer safety"...     The cop never broke the law nor violated his rights. Cops are allowed to lie and this one did. It doesn’t matter what the cop says, if you give up your ID it’s considered “consensual”, you are being “cooperative”. Since the citizen never consented, nor cooperated, the cop walked.

    I understand the desire to abolish Qualified immunity. But you should be looking for reformed. Or really, back to the original intent of the policy then laws. We were always taught that so long as the Officer was within the law, and operated within the department policy, they were covered by QI. Once an officer was found to have violated ANY of the tenants were disqualified from Qualified Immunities. These violations were once Black and White. And not just from the Internal Investigations. Historical Newspapers are rife with cases against the Police in the olden days. Many were founded, take NYPD in the 60s and 70s. That was the extreme. Most departments were just plodding along, and in some cases, it looked like Mayberry. I grew up in Memphis, and until 1968, I never recalled Police being heavy handed. Not that it didn’t happen, just don’t have any personal knowledge. Things changed in 68. Not good either. But I digress. Qualified Immunity, a great idea. Abused. The idea was to force a municipality to get rid of problematic officers because of the costs. Now it is a test to see who they can cover. How this change in LIABILITY is being interpreted by lawyers is baffling. You would believe in most cases of validated Police Overreach, the community would be running for cover, not giving cover. This entire thing is out of control. Like the City, County, State do not have unlimited money…shit, wait…they got our damn taxes huh? Crap. Okay. They don’t care is the only answer then.

    They should have an app on their phones to immediately take them to the applicable laws for taking films of facilities, to avoid their own embarrassment or subsequent large payouts if found guilty of wrongdoing....Videos like this are good assignment subjects for all law students. With so many audit videos going around the police should have training in this area so as at least to avoid future conflict with the public.

    How many police officers have been harmed with a camera? Surely it must be a very dangerous thing because soo many cop's are going ape shit over pictures and videos. Toddler's have smart phones these days. I can't wait until I see a video of cop arguing with a toddler about recording from a public space 🤣🤣🤣. There was a video of a cop manhandling , i repeat manhandling a 6 year old little girl cuz she hit her teacher, she was thrown to the ground and handcuffed all in front of her classmates. Tho that cops did get fired and the family received a large settlement it still shows cop acting like thugs no matter your age or gender.

    I’ve worked for private companies and whenever something happens at another company in the industry, we all have meetings advising us “hey guys, so this other company XYZ, they said xxxxxx to the customer and they later learned they were wrong, so guys be careful to read the follow the rules.” It amazes me that this does not happen with policing and yet here we are years and years later after all these first videos and we still see cops acting this way.

    That and yelling “STOP RESISTING” over and over, even if the video clearly shows that there’s no actual resisting going on. Oh and giving contradictory commands, like “DON’T MOVE” and then following with “PUT YOUR HANDS BEHIND YOUR BACK”. Like which command do you want the guy to follow?
