Apple River stabbing trial: Prosecution questions Nicolae Miu [FULL]

Nicolae Miu was cross examined by the prosecution in the Apple River stabbing trial on April 9.
The state pointed out Miu's false statements in his interrogation video compared to what he testified to on Tuesday.

    I think Miu's guilty, but I do believe that the 2nd group (especially that Maddie chick) really, really, REALLY escalated all of this. Which is funny (dark funny, morbid irony), as they claimed "oh, we have experience in bars de-escalating things, we can help"

    The defendant approached the teens in the river. He grabbed their tube, and he was clearly the aggressor in all of it. It was not self defense, he's a murderer.

    Who is Maddie, the river police? She has zero authority to make someone leave and she certainly has no right to physically push or touch him, she wasn't even involved with the original interaction. Who would not be irritated or angry if someone is yelling at them to leave regardless of wether it's a female or male.

    Glad you said it - this was the start of the assaults. Watch the video and see how far she had to walk to come over and then got in Miu's face. This arrogant aggressiveness turned the situation into a powder keg waiting to explode. Anytime you see a mob gathering, there's always one instigator who'll try to escalate.

    Yeah, but Mr.Miu lied about his knife. In the the interrogation video he said he took the knife from one of the kids. Then he ditched his knife after the stabbings & tried to play it off like it was one of the kid’s knives. I don’t think innocent people ditch their weapon like this & lie about it.

    @@houhou71or maybe if he would have just waited a few minutes for them to float passed and clear the area, not invaded their personal space, accused them of stealing his phone, assaulted a girl, oh and probably if he wouldn’t have brought that knife to confront them dam rowdy kids.. and him being drunk probably didn’t help his decision making, I guess he’s not a responsible adult, and he’s obviously not a reasonable person but at least he doesn’t have anger issues, he stabs multiple kids that were minding their own business until he barged in and planted himself in a perfect scenario to unleash all that built up suppressed anger while he’s drunk and found a group of kids having to much fun minding their own business.. yep but he’s the victim.. you people are sick.     It also seems he doesn't remember all the bad life threatening decisions he made towards others but yet he remembers every detail in what they did to him. Even if it was a lie. He still remembers only how he was brutally attacked, with no bruising or river rock marks on his body. It's weird how his memory works. He didn't even remember telling his group to leave, but he remembered being afraid of the guy in the forest holding a bat.

He simply was too proud to go back empty handed without snorkel and phone to his group and wife because he would have had to endure the shame of being backed down by rowdy, disrespectful, teenagers.     I feel for everyone in this situation. As someone who has been jumped by three men at work, unprovoked (I work in an industry that leaves the customer on high alert), I can assure you that it is beyond terrifying. You are not aware of what your assailants are capable of, when they will stop assaulting you, or how the situation will end. I did not have a weapon on me and anytime I stood back up to get help, I was then pushed down again and punched and kicked, so I was in no position to defend myself - but with fear, adrenaline and pain coursing through your body, I can absolutely attest to how disoriented you get and how all train of typical thinking flees your mind. I was unable to think of how to protect myself properly, such as covering my head or vital organs, to give credit to the fact that you don't quite have all your faculties. Add 10 other people who are screaming and laughing at you, plus alcohol, and you get this case. He will have to pay for his actions that day, especially since multiple people became intentional targets, but everyone involved in pushing this man down and harming him should be held accountable for their assaults and aiding the situation to occur in the first place.

    exactly has I see it, the 2 sides here were horrible, the group could not hold a better posture they responded like animals, and with this east type of people "nicolae" they are there for the kill when things are personal, that is more or less the culture take justice by their hands witch is criminal thinking and behavior and can be shown here, just the mindset of going to face a group like to give them a lesson with a hiden knife u can see the mindset...luckly I live in Europe and this concept of an individual carrying knives or guns is not present, but hey in Europe there are a lot of criminal to, so the gun does not make u a criminal, but it surelly helps to then finalize the mindset...and the group they are already almost adults at that time education has already had to be ingreaned , because when its not groups act like hienas...pure animal kindom madness witch was what was displayed here, its a pity this like Einstein one said, when u have a military kind of mind and atack is all u see, surely you have been given a brain by mistake...

    That fact makes him the aggressor. These kids were right this old man is mental and dangerous and was a threat. Once he stabbed that young lady anybody had the right to restrain him. He left without a single mark. The law is clear and it corresponds to moral compass. You should never stab four human beings for yelling at you in a public park.

    The problem with the prosecution charging him with first degree murder is that they are trying to argue and twist things now that Miu intentionally brought his knife over with the intent of stabbing people. It's absolutely stupid and not believable based on the video evidence and everything else. They needed to charge him with something lesser. The prosecution put themselves in an extremely difficult position to argue.

    If you watch the video, and the prosecution pointed this out, Miu KNEW he had the knife on him and kept feeling for it on his side as he's running up on the teenagers in the first place. WHY IS he running up the teenagers and WHY is he grabbing their legs then the tube forcing them off the tube? WHY wouldn't he leave and instead of leaving when everyone was telling him to leave? It was their area to begin with. Instead, he pulled out a knife then gets a cocky look and half smile on his face. NONE of the teens made threats against him or said attack him. HE initiated the contact and multiple witnesses said he punched Madison. He said he only pushed her. Either way, he began the aggressive physical contact. Yet he's completely innocent?

    He ditched the knife, floated away, lied through his teeth when questioned by the officer. He "heard there was a stabbing, and he fit the description". Wowww... nobody was completely right in this, but you cant claim all of that was self defense and then ditch knife, act like you weren't part of it.     He knows he's left many living witnesses with his by now signature stab wounds on thier young bodies that are on their way to the hospital to be surgically repaired and will never be able to forget his face .😮This slew of lies removes all credibility . His own group indeed knew he was over with the teens as well. They warned him not to go over there a couple of times. His wife obviously knows he doesn't handle the booze and can become aggressive she wanted him to stay away and knew he'd be of no assistance, finding anything but trouble. The fact that he drank lots was the only truth he told. "I think we all were drinking alot"

    I’m so fallible. I watched the defense earlier and said he was being unjustifiably convicted. Now I watch this, and my opinion has changed. Don’t believe anything before you have the full story. Lesson learned for me.

    Right? I'm so confused. Like it's FIVE people he stabbed. How can that be defendable by so many people. I could see it differently if it was one person and he retreated.     Late to the part, the noise is whitenoise. In courts, they play this in the room so no one can hear the discussion between lawyers and judges. It is kept in the recording so listeners are aware the audio is ok and that it has not been lost. Background: I use to be a court AV technician for 10 years

You find yourself in this situation, ask for an attorney. In fact, once you request an attorney, it’s a violation of your rights for them to continue to ask questions.

    You dont know if he has any regret.. when your getting charged with murder all you have time for is fighting for your life on trial.     Thank you so much Christina for such analisis...the best and most professional I've seen so far about this case. I was already disgusted by the verdict but you just made it much more clear. This is a case that should be appealed 100%. While I'm very sorry that a life was lost, this sets a very bad precedent in so many levels, from Justice system to bullying to unpunished teenage aggresion and much more. This verdict was as deceiving as the one on the Casey Anthony's case and the OJ Sympson's case. It makes you wonder where does the Justice really stands in this country.

(To name a few) You cannot concentrate nor process things the same as you may otherwise when your body is in “fight or flight” mode. It’s a built in survival mechanism that we all have.     Most tube river floats are like that, you are stuck on the river until you get to the end point where you either catch a shuttle back to your car, or you had a shuttle that drops you off further up the river and you float back to where your car is. It’s a day float… most of the river goes thru the woods and most is not accessible to just “walk out”. His wife stated in her testimony they were just quiet finishing the float.. but I doubt they knew at that time that a kid died or he did that much physical damage.

    The physical altercation… it was seconds, not minutes. It’s really nice to sit, removed from all emotion, and break everything down frame by frame.. but that’s not how the brain works. He is, in my opinion, clearly traumatized. This whole thing is awful.

    As potential future jurors, our job is to look beyond BS, including bad performances by defendants whose lives are at stake, and understand the facts of the case, and make a solid decision. For instance, the prosecutor focused on his “anger scale” because the ONLY hope they have to winning is that he was “angry” and started stabbing people. For us, we know that given the mob he was surrounded by, he needed to defend himself after they repeatedly attacked him, especially after calling him names, and that being angry doesn’t wave his right to self defense. What, should he be happy while defending himself? Should be scared? Yes, he should be scared, but you can be angry and scared at the same time.

    I'm surrounded my engineers, and have been for 30 years. You must live in the twilight zone. An engineer's memory is like any other person's memory, some good some bad. Nevertheless, I know from experience that when in a high stress environment, and the adrenaline is surging, a person's memory of detail will not be the same as sitting taking notes in lecture, with a text book with the purpose of memorizing detail.

    @angiejorah - Didn't you wonder why the 17 year old's body & Miu's hands were blocked off in that 3-part picture that SUPPOSEDLY proved he was being strangled by the 17-year old??? It was because Miu was stabbing him to death AT THAT MOMENT!!! You can tell because you see that Riley in the background has already been stabbed. That's why her mouth is open like she's screaming and she's looking down at her side. What would YOU do?? Just stand there? Miu had ALREADY punched Maddie, stabbed Riley, and one other person. This poor kid just tried to push this psycho away and got killed for his actions. In fact, NO ONE had assaulted Miu in ANY way before he started attacking everyone! Miu also took his knife out LONG before he began the attack, just hoping someone would provide a justification for him to start stabbing. When they didn't, he punched Maddie, and started stabbing everyone. He did not know there would be video. You have to watch the whole video. In addition, at least 3 out the 5 or 6 people he attacked, didn't touch him aggressively in ANY WAY WHATSOEVER (before or after his attack), including the first 2 people he attacked. So NOTHING was self-defense for Miu. But for anyone who did punch or push Miu, that was obviously self-defense because he was stabbing everyone. And since Miu was the first person to physically attack anyone, it's actually the victims that are defending themselves, as much as they can by pushing him away or punching him. His defense team did a great job muddying the waters by cherry picking moments in the video where Miu was either "assaulted" or the "victim" an apparent assault. They didn't SAY the instances were BEFORE Miu started attacking everyone, they just let you assume it. The problem was, people only started pushing / punching Miu when Miu began stabbing everybody. Miu came over to them, refused to leave, initiated the violence, then took it up 100 knots. Then he casually left like he could have at any other time.

    @@wvrjl If you watch the video at .25 you don't see Rylee stabbed until after Mui got up from being pushed into the water, slapped, and punched. Rylee and Madison had their hands all over Mui. He didn't punch Madison. Madison lied and said she had pics of her face. The police are able to recover deleted pictures. The picture never happened. The drunk and high mob say that to justify attacking him in the 1st place. All of the people who got stabbed punched, slapped, had their hands on him, prevented him from leaving and tried to push him under the water. 100% Self-Defense against a drunk and high mob.

    Let’s be honest here. This is a case of “when assholes collide”. Throw in alcohol and other intoxicants, and this whole ordeal was just a shit show waiting to happen. I think he was near the kids looking for the phone and they got an attitude with him. They felt like being assholes to some older guy and eventually he thought they were possibly holding the phone to fuck with him. He wasn’t sure if their behavior was locker room behavior or intentional so he kinda messed around by flipping their tubes around. They got up and everyone started surrounding him, taunting him, and bullying him. Of course he could have walked away, but if you watch the video they essentially keep trailing behind him as if he’s trespassing. He appeared to be grabbed by a couple people and ended up hitting that girl. You don’t see her be “hit”. At that point he’s shoved into the water and assaulted. That is when it appears that he starts stabbing anyone who comes up on him. Again, alcohol really played a role in this whole saga and is a clear example of why alcohol is truly one of the worst examples of a drug you can intake in public. Nothing good comes from it. No one is innocent here.

    Yeah, this is pretty much it. What sucks is if he hadn't dropped his snorkle and goggles, I'll bet he would have moved on pretty quickly. He came into the area because he thought the phone might have been there and maybe the kids had it to mess with him, but he didn't want to leave because he knew his goggles and snorkle were there.

    Regardless of who started it, he went for the kill. He didn't show them his knife, announce he had one, or command them to get back. He used lethal kill shots against unarmed young people, even young women, and didn't even try to leave when he had his entire back in the clear. For that he is guilty according to state law.

    When you’re in that situation getting pushed down 2-3 times feels like 9-10 times. It feels like every time you stand up you get put back down. Then you add the water aspect to it too, the group is yelling and taunting. I’m 100% sure Nic Miu felt like he was in serious danger.

    The killer had already taken out his knife, opened it and had it in his hand before anyone started pushing him. In fact, while having an open knife in one hand he that initiated the physical contact by pushing a female. The boys responded by pushing him a few times and someone slapped him. Their actions were restrained. It was after mui then stood up that he started stabbing people. If you feel afraid to the point where you take out a knife, why escalate things by pushing females rather than making moves to withdraw from some a situation? As the prosecutor said "you went with ylur knife prepared for violence and then initiated it".

    If Nicolae had already cut the girl, why were the kids laughing and acting ridiculous while one boy slapped Nicolae?     @@ronarprefect7709 Even the idea that they "surrounded him" is not true. Gathering around is not the same as surrounding someone. And if he felt surrounded, why didn't he just walk away? If you are "surrounded", it means you cannot get away. The very reason theybwere gathering around is because they were telling him to go away and leave them alone. You see multiple hands pointing him away in the video. What is that man doing there? When does he tell them what he was doing? So of course people would gather around to see what is going on.

I wouldn't. I would be too busy condemning the person that gutted your child. Plus, in the video, the girl barely touched the killer and it looks like more of a block than a push. Blocking him from moving further foward. Remember, the girl and several others are seen pointing him away. He is refusing to leave them alone. And even before that, the sick killer had alreadly pulled out his knife opened it and had it in his hand. He was waiting for the pretext to use it. That is when he instigated real physical contact by pushing her. At that point, she had no idea that the man standing in front of her has an open knife in his hand. To me, that tells me that she was justified in putting her hand on the killer in an effort to get him to leave their space . She must have sensed that he was a madman. Even the first time he walks up to her she takes a step back. No one knows what this madman wants and she was obviously concerned for her safety.

    Manslaughter and aggravated assault seems more likely than 1st degree murder and 4 counts of attempted 1st degree murder. And I feel some of the young men should have been charged with assault & inciting violence. Possibly charges relating to use of alcohol and illegal substances. Both sides could have and should have walked away from any confrontation early on.

    Charges of under age drinking should have been given to the underaged teens drinking, whoever supplied liquor to the teens, and harassment and assault charges to those who laid hands on the defendant. While this situation is heartbreaking, there certainly are others that should also be held accountable for their actions as well.

    The irony of this whole thing is he alone was looking for a phone then judged by a mob of 11 and attacked, alone.     What the teens did was clearly wrong but Mr Miu took it to the next level, not just threatening with knife but actually stabbing teens... He could have just defended with arms or run away... Come on people, we cant justify stabbing people (teens) over mostly words and some mild physical altercations from the teens... Its very unmanly to start violence over words, specially when it comes from teens. Even adults need to learn to control emotions also. Mr Miu should take the guilt and the consequence like a real man and I think he will but remember he lied a lot in the trail, which is a big indicator of what he did was over the top and to aggressive for the situation. That being said, I think we all agree on that the teens need to learn proper behavior, respect and humility. And also, I think Mr Miu should learn communication skills also, if he had respectfully communicated what he was doing in the first place, then maybe the teens would understand the he was looking for that phone and not for underage girls.

Before that he was minding his own business and the drunk mob escalated the situation quickly.     No, did you even watch the video? I don't get where you got that from... it's clear the prosecutors established that Miu had no reason to even initiate the contact, which he did, with the teens. He initiated FIRST physical contact by grabbing their legs and then the tube. It seems a good explanation is Miu was searching them for the phone, and refused to leave them alone when they were telling him to leave.

    Sad part is when I read these comments every one thinks he did this in self defense,but the defendant himself knew at the time that he was not acting in his defense, hence his actions like getting rid of the weapon, not approaching police forces , lying to deputes about the incident.     This is actually correct - if this was a straight forward fight for survival - you would want to tell everyone what happened and to ask for help to be saved and you would want to get authorities to capture and detain your attackers.

    It's called fear of going to jail, because he knows he stabbed people. He was trying to avoid the potential. We have no idea whether it was because he was truly trying to hurt people or because he was defending himself. It's common behavior, if not honorable behavior for someone to fear when they kill someone even if they did it in self-defense.

    Think about it. The guy managed to gut another full grown adult, nearly gutted a female who was in the hospital for a month, stabbed two other people, and managed to kill Isaac. Nobody knew he had a knife and there's no confirmed serious injuries and the only thing he complained about was his butt hurting. Later, he claimed his throat did but never said that anyone until today.

    When those kids grow up and eventually start feeling like this is their fault, they will be right. The court can tell us its his fault, but we all saw the video. This guy is guilty of being a liar, not especially bright, and having an average at best defense team. There were a couple of crimes committed by him here. None of them were murder.

    How weird that Americans so often feel sympathy for the accused. I know there is little faith in our legal system here but it does not mean a grown, armed man with loud mouth drunk teens, as he identified them immediately afterwards, has the right to claim self defense. He expertly used a weapon against a group of drunk teens and gutted one and slaughtered another. He stabbed two others and then washed up and lied about what happened for days afterwards.

    You could ask the people you are mentioning about unarmed black people being shot & killed by police. This question was presented to college students as to how many this happened to in I believe 2019 & they would say hundreds or 1,000. The actual number was 19 & the vast majority were fighting with the cop trying to get his weapon or taser. Out of the millions of police interactions there were less than a handful where the cops were at fault but the narrative pushed by the media & activists is that cops are blood thirty & go looking to execute innocent blacks. Ask people about Kyle Rittenhouse & a lot of them will say he was a white supremacist who crossed state lines in order to murder innocent black protesters. A frightening percentage of Americans believe these insane narratives & now we have this case where people bend the facts to support their equally insane narrative.

    He lost my support around 1:14:00 when he straight lied to the cop in cuffs in the squad car saying he didn't see anyone injured and he saw the fight and wasn't involved. He won't be able to recover from and defend that this alone could be the reason he's convicted. You can't stab multiple people and lie about it when it's on video to a cop. Bad move lying.

    So the prosecutor wants us to believe that Miu armed himself with snorkel gear and a utility knife with the intention of taking on 6 young men, two of whom were college level football players. This prosecutor is full of it. Mui should never have been charged. By the time that knife came out Mui was being violently assaulted by a jeering mob and feared for his life. Not guilty.

    I agree. It’s simply as you say, no premeditation. Just a case of self-defence. They pulled out a rusty knife when they searched that portion of river, and then the nurses husband dropped his knife in the river after he cut the ziplock bag…because many people regularly carry a knife down that river. It’s just so sad that those boys set up the pins and those two girls knocked them all down. Once he was trapped with deep water behind, 13 people in front and around him, and Madison pointing down river when his group was upriver…oh and how could we forget that everyone thought he was a pedo because of the name calling. What a clusterf**k

    Would it be best if Miu comes clean and says “I lied because I was afraid, I acknowledge that it was a terrible choice. I wasn’t thinking clearly. The truth is that I was legitimately scared for my life at the river and I am saddened for the consequences of their attack on me” He would come across way better, and jury would be more sympathetic.

    Yes. I think this would have been the right approach.....or...even better, he shouldn't have taken the stand because of his inability to articulate in English, what he was feeling during the time they were jeering, poking and pushing him down. Who knows? He could have been triggered....bullied as a kid. English isn't his second language. It's his 5th language. A lot of bad stuff happened because a lot of folks were drunk, high and behaving obnoxiously, to say the least. Did he over-react? Who knows? Did they have the right to touch him? Keep your hands to yourself. I think he was made angry by the punch in the throat....who wouldn't? Maddie, all in his face poking him. He's European and appears to be short tempered, but that could just be the DA getting under his skin...........I think you're spot on....if he had been able to communicate that he lied because he was still in shock, afraid, hadn't really processed it all....and...expressed deep remorse, he probably would have faired better......but he's Romanian.....not British. In that part of Europe men don't express themselves in that way. I wonder what would have happened had they all been completely sober. They poked the bear and unfortunately, the bear poked back.

    Heaven forbid you should raise your child not use drugs, get drunk and bully. There really is not children in this, 17 is almost an adult and at least 3 were over 20 years old. There is no innocent person in this case, they all behaved very badly. The fact is you never know when you have conflict someone what their history is, you start someone with PTSD and assault them then you are likely to get an extreme reaction. It is excessive force and unnecessary force but it certainly was not unprovoked.
