    Yep, you need to sue!!! You will win. Sue them for cost of demolition, cost of rebuild, lost revenue (if it was going to be Abnb), any fees for getting inspected for fence permit, any fines you accrue from city, your court/lawyer fees. I'm not sure if you can get any type of "inconvenience" or "pain and suffering" damages, but a good lawyer will know the answer to that. Good luck! And I just hit like and subscribe.     They messed up big time. Setbacks are part of "house building 101". This error was missed numerous times by multiple people. You should have no liability and they need draw up some sort of legal document that gives you an exception. I'm getting heated up just thinking about how bad they are trying to screw you over.     I've been struggling allot recently with worrying about what a new group of friends think about me, constantly trying too hard to be liked and feeling like I'm not good enough. Particularly because I recently left an abusive relationship to which the smear campaign made people abandon me. This video helped me so much, thank you ❤

    Glad to hear you were able to get coverage!!!! It's happening here in California as well. I purchased my home 15 years ago, picked up an insurance policy with a well known company, added Earthquake insurance to the policy through CEA, purchased water sensors and an alarm system with a monitoring agency, and had my home retrofitted (bolted) which costed $7,500.00 out of pocket--JUST to make sure I was protecting both my home and my policy. Welp, October, 2023, California had a CRAZY hurricane type storm that came through. It took our 3/4s of my rear/side fence and ripped 1/4 of my roof off like it was absolutely nothing. I contacted my insurance company and filed a claim. While waiting for an inspector, rain began to leak into the house, I had didn't have time to wait for the claim's adjuster inspector, I had a licensed contractor out fixing the leaky area to mitigate further damage that was $2,200 out of pocket. Five weeks later, after insurance adjuster approved the claim, my roof was repaired and my fence was replaced. After paying my deductible, insurance company paid $8,700.00 for the fence and roof claim--I didn't add the $2,200.00 to be repaid I took it as a necessary lost. My policy covers $120.000 storm/rain damage and $825,000 for dwelling lost. $8,700.00 is less than 10% of my policy coverage. I'm thinking, I'm good. Two weeks ago, (eight months after the Storm and filing a legit claim), I received a non-renewal letter for my policy "due to me not residing in the home." HUH???? Wait, what???? I called them to inquire and to dispute their claim with supporting evidence---my mortgage and utility bills; however, they have NOT returned my calls, but keep sending me to an automated voicemail that says the mailbox is full. Last week I started calling insurance companies only to find out my insurance company has divided the storm claim as TWO separate claims with TWO separate claim numbers. They sent the information to C.L.U.E. as TWO separate claims; therefore, making it almost impossible to become insured outside of going through a Non-Admittance Carrier (located in the U.K. and have obligation to follow USA guidelines as they are not bound and can make up rules to a policy every other day). This Friday, after meeting in person with a well established Insurance Broker, I was told that NO insurance company is willing to offer me a policy because of the ONE filed claim that appears as TWO claims. This is unfair because the insurance company is not being honest with me or with the C.L.U.E. report with the only recourse being --- NOTHING. I now have NO coverage. My home, if it suffered fire damage today, would cost approximately $625,000.00 out of pocket to rebuild. I asked the Broker what are my options. Her reply, "Prepare for the worst. Save as much of the $625,000.00 as you can, keep your credit score in good-to-excellent just in case you need to secure a home renovation loan OR sell the home and rent for the next three years until the two claims fall off the C.L.U.E. report and start all over again." 😫 It makes no sense; however, it's happening everyday in California, I'm not the only one getting "the boot." It's just frustrating to see the insurance company not living up to their end of the policy contract just to keep their share holders happy.

    Thank you for sharing your experience. It's incredibly frustrating and disheartening to hear how you've been treated by your insurance company after taking extensive measures to protect your home and ensuring you had proper coverage. It's clear that you’ve done everything right - from retrofitting your home to mitigate earthquake damage, to having a contractor fix the leak immediately to prevent further issues. The non-renewal due to a supposedly false claim about not residing in your home is particularly egregious, especially when you've provided ample evidence to dispute it. It's alarming that they would also report your single legitimate claim as two separate ones, making it difficult for you to find new coverage. This seems not only unethical but possibly unlawful. It's deeply unfair that after all your careful planning and investment, you're left without coverage.Thank you for shedding light on what's happening in California and I hope you are able to find coverage soon.

    You all are killing it! I'm paying off ALL consumer debt before I even think about buying a property again. I bought a property almost 2 years ago that was supposed to be a light rehab. I had an excellent inspection report but made the initial mistake of not getting accurate estimates for ALL of the work noted. Turns out the rehab was way more than estimated and the property turned into a money pit. I sold the house and made a little bit (not profit just enough to pay some debt) and am STILL paying off the rehab loans. I'm so debt adverse now I don't want anything I can't pay cash for! I learned a lot from that experience for sure.

I remember when we were renovating the property in NC, it was a total nightmare and so many unexpected things kept popping up. We honestly at one point we made a mistake taking on long-distance renovations.     Nice home! Just went and visited my son at his new apartment in Dallas. NOT impressed. It was NOT left clean! I'll have to remind my son to check his filter...I doubt it's clean due to the condition of his home. But, he can make it better for the next tennants.     You might have to take the builder to court….The city is going to say we give the relevant parameters to the builder and we ask him if it was done, we don’t take a tape measure to follow up behind their work. And also sue the city for an exception.

    To answer your question on how this happened, literally someone measured wrong and there were no checks and balances on the foundation layout. Do you know what inspections are supposed to be and were performed by the building inspector? Even though the response said they won’t issue a variance, I would apply for one. When it gets denied then I would file a lawsuit against the appropriate parties.

    Hi, it is understood that it’s an oversight. The problem is no variances will be approved per directors email. This is why so many people are involved now.     @@videofan1010 it is not the cities job to inspect new construction. they only inspect after to conformity to their rules or fines... they dont help you follow the rules when you are a builder or a buyer. the city has no reponsability for non conformity, for that reason, they do not help you conform, they regulate that everything is in conformity with the code AFTER BUILDING IS PRESENT, not before built or during build, for this reason exactly

    The builder is responsible but the city is more responsible. The city is suppose to overlook the builders from beginning to end. That's why permits are required by law. At least that's how it works in CA

    Yes, the City is the ones ultimately responsible. The site plan was signed off by the city and reviewed for compliance. So the math is not mathing.

    Wow ! that really sucks. I hope you're able to straighten this out to your advantage. After all, it's definitely not your fault. It has to lie with the city or the contractor. Where I live all the corner lots are irregular sized. This was verified when I went down to the county and looked at their aerial maps. It verifies that this is true. The corner lots vary from 200 feet all the way up to 225 feet wide, so technically I could put my fence16 more feet towards the road. I tried to straighten it out with the county, but I was getting nowhere, so I just put my fence in line with everyone else's.

During a home inspection, various aspects of a property are assessed, such as structural integrity, electrical systems, plumbing, roofing, HVAC, insulation, and overall safety. As for the surveyor, their role involves assessing and documenting property boundaries, dimensions, and physical features to ensure alignment with the original site plan. However, if the site plan was incorrect from the outset, even before the builders laid the foundation, it raises the question of whether the surveyor would have been aware of this discrepancy.     Even after the city approved the build, they have to inspect it during and after the entire process to insure it's up to code including development, the build, the HVAC and all other utilities. I've managed a county's building department and what I learned is that inspectors get paid under the table to over look issues like yours, many times not inspect the property at all yet, mark the inspection done. Girl sue them. They get sued all the time for this kind of mess. That director is trying to cover for them. That certificate of occupancy should never have been issued for this property.

    That what I thought. The city had over 20 times throughout the build to inspect and they never took the opportunity to do so. We reached out to the inspector, he has yet to return our call. But if this is at all the case, it will definitely be exposed. Thank you for watching.

    some cities make you show them between steps... and inspect basement footing and concrete pour before next step is approved, but not this town
