    Yep. But even before all of that since this is a planned development, the city had to approve all site plans, roads, lot sizes, homes, everything. So I’m not buying it. Thank you for watching and commenting.

    The city is playing games. They have a duty to ensure the building is built to standards. You have to take the builder to court, go to the court and file a complaint. They will help you do it.

    @@thesocialreset none of what he said is based in reality,. basically you can contact your notary who was checking the right of ways... and such. but if a builder fks up, then hires his own friends as inspectors, and you accept that inspection report, you are gonna be held liable for anything they did wrong as a group

    The inspection report and survey uses the original site plan as a reference point. If the city signed off on the site plan, before initial development, what is any inspector or surveyor supposed to think. If the specs was incorrect, the initial stage is where the problem should have been addressed which by the way was a year before build started.

    Lawsuit against the builder, inspection agency, and the city separately. They are covering one another, that house never should have been sold. They have to inspect each step of the build.

    @SheriffofKZread when we found the home, the build was complete; so we would were there to see every step of the build process. However we did get a survey, which would have uncovered any issues with the property, land, but not necessarily the zoning variances. Bottom line the information was not disclosed by anyone and all property properties on this matter has been addressed. We are currently waiting to hear back. Thank you for watching and commenting.

    Hmm ya the inspector, the city, everyone should have known, the builder, everyone.... setbacks is the most common zoning rule of all. I mean there's just no way you can miss the setbacks as it is so basic and crucial and essential you cannot do anything until you know the setbacks so I have no clue how the builder and city messed this up. I mean it's just so basic it's insane to me... and I'm not even a builder just a random fool who wants to build a house but I feel I know code better than almost any builders and almost as well my local zoning code... it's sad honestly I always have to correct the city on codes but they just bully me and do whatever they interpret the code as. I'm like man it's English you can't just make up your own interpretation 😅. They say oh ya watch me... I'm the final say here and I'll tell you how it's gonna be.... lol I'm just like oh lord these people are so lost 😂. You MUST research like an absolute madman because in everything in this world the incompetence is mind-blowing

    Whoever approved the property during the building is at fault. You should be able to make the seller pay for undisclosed issues.

    @@videofan1010 it is not the cities job to inspect new construction. they only inspect after to conformity to their rules or fines... they dont help you follow the rules when you are a builder or a buyer. the city has no reponsability for non conformity, for that reason, they do not help you conform, they regulate that everything is in conformity with the code AFTER BUILDING IS PRESENT, not before built or during build, for this reason exactly

    Even after the city approved the build, they have to inspect it during and after the entire process to insure it's up to code including development, the build, the HVAC and all other utilities. I've managed a county's building department and what I learned is that inspectors get paid under the table to over look issues like yours, many times not inspect the property at all yet, mark the inspection done. Girl sue them. They get sued all the time for this kind of mess. That director is trying to cover for them. That certificate of occupancy should never have been issued for this property.

    That what I thought. The city had over 20 times throughout the build to inspect and they never took the opportunity to do so. We reached out to the inspector, he has yet to return our call. But if this is at all the case, it will definitely be exposed. Thank you for watching.

    some cities make you show them between steps... and inspect basement footing and concrete pour before next step is approved, but not this town

    The builder is responsible but the city is more responsible. The city is suppose to overlook the builders from beginning to end. That's why permits are required by law. At least that's how it works in CA

    Yes, the City is the ones ultimately responsible. The site plan was signed off by the city and reviewed for compliance. So the math is not mathing.

    You might have to take the builder to court….The city is going to say we give the relevant parameters to the builder and we ask him if it was done, we don’t take a tape measure to follow up behind their work. And also sue the city for an exception.

    Yep, you need to sue!!! You will win. Sue them for cost of demolition, cost of rebuild, lost revenue (if it was going to be Abnb), any fees for getting inspected for fence permit, any fines you accrue from city, your court/lawyer fees. I'm not sure if you can get any type of "inconvenience" or "pain and suffering" damages, but a good lawyer will know the answer to that. Good luck! And I just hit like and subscribe.     They messed up big time. Setbacks are part of "house building 101". This error was missed numerous times by multiple people. You should have no liability and they need draw up some sort of legal document that gives you an exception. I'm getting heated up just thinking about how bad they are trying to screw you over.     Wow ! that really sucks. I hope you're able to straighten this out to your advantage. After all, it's definitely not your fault. It has to lie with the city or the contractor. Where I live all the corner lots are irregular sized. This was verified when I went down to the county and looked at their aerial maps. It verifies that this is true. The corner lots vary from 200 feet all the way up to 225 feet wide, so technically I could put my fence16 more feet towards the road. I tried to straighten it out with the county, but I was getting nowhere, so I just put my fence in line with everyone else's.

    To answer your question on how this happened, literally someone measured wrong and there were no checks and balances on the foundation layout. Do you know what inspections are supposed to be and were performed by the building inspector? Even though the response said they won’t issue a variance, I would apply for one. When it gets denied then I would file a lawsuit against the appropriate parties.

    Hi, it is understood that it’s an oversight. The problem is no variances will be approved per directors email. This is why so many people are involved now.     We have all of the documentation and the city signed off on the property with a 17 ft setback. We have engaged everyone involved in the process from the title company, contracted survey company, realtor, city council you name it. Stay tuned and thank you for watching.

    Sell and cut your losses. This is a Money Pit, a total disaster. The City will bleed you dry. You can sue the builder later for damages.

I’m in the process of selling my 4th and last property in New York State. I’ve learned my lessons. You never truly own anything. Your property can be taken at anytime.
