To clear something up before people mention it. Yes a Strike is placed on an account after a DMCA take down is placed, and the studios technically aren't 'giving' the strike as it's KZread's rules. The thing is, the studios at this point know that a DMCA take down = Strike with KZread system in place, so they are giving you a strike.
There's more we want to add, but that will have to be for another video.

Great video, the abuse of the KZread's dated copyright system has to end. I've had my fair share of copyright drama but I can't imagine what it's like to deal with stuff for channels such as yourself. You've got my support and KZread has a lot to answer for.

I'm pretty sure one or two of the videos that have mysteriously vanished from my Watch Later playlist, before I could get to them, were yours, Mark. I'm hopeful that they're things that were restored for me to stumble across later. Unfortunately, I know that there's a lot of good content from smaller channels that no one will ever see.

+Markiplier great to see that you are on this as well Mark. But i do wonder if KZread will ever change it's copyright system. I mean in the beginning it was "Broadcast yourself" not "Get shot down by greedy studios" maybe KZread should overthink their whole copyright system. But in the end they will most likely stick with what makes them the most..money :/ #WTFU

This sort of rampant abuse of youtube's systems is getting way out of control and they really need to answer for it or put some better measures in place to protect its creators. It's scary to think how a youtube channel/career could be ended without notice or any sort of process. I hope things change soon and get sorted for you :)

I once made an animation that used a royalty free arrangement/public domain Beethoven song.. It was claimed as a completely different song. I had to look up the song in question it was claiming.. What I found was a techno song that played a succession of "thud thud thud thud thud thud" and then stopped to play THE ENTIRE BEETHOVEN SONG, then went back to "thud thud thud thud". The shit smear who made that trashy song was using it as a way to claim monetization off anyone who used a fucking Beethoven song. This whole system is so broken and is absolutely laughable.

+schmoyoho Greed is what makes people complete assholes. Sure money is important, especially for buisness, but it doesn't mean it should be only thing that matters. What matters the most is making other people happy. Helping those who trully need help. Saving childrens lives by giving some of the money to charity. People treat money like it's the only thing that matters. But people with greed forget what it trully means to be a true human being. We all have our own streinghts and weaknesses. We all make our own choices to make us and other people happy. But with greed, we will never accomplish that. :/

As an animator who is working towards a career in animation, the fair use system is one of the scariest things for us. It's so broken that we can't use various songs or particular sound effects in animation without getting rampaged by copyright claims, and it's the worst feeling to ever get. Animation takes so much time, editing takes so much time, and when people take away the money that you rightfully deserve after so much work, it's terrible.

+Jacob Crawford Actually, there are a number of bogus companies out there, making content ID claims on Legally public domain Apple loops and images. They get the benefit of the doubt, of course, but they always back down when you state why the claim is bogus. Probably because they know while you wouldn't have the money to legally tear them down, they don't want to mess with a huge litigious company like Apple. And you know I would easily throw the claim at Apple, if they tried to press on and let them face that kind of music. I kind of hoped they did, in a way. It would end them.

***** Funny enough. In almost all cases, (when it comes to Apple clips) it's a false company making claim on legally public domain Apple loops. They have in full legal document form, that they have no claim to the material once it's used in any kind of work. They expressly forbid to make money on *only* the loop without something with it. I just wish Apple could go after those companies since they are the ones breaking such TOS.

+The Man Who Beat You honestly i think it depends on what company youre using copyrighted material from. its obvious at this point that most large hollywood companies likely use either underpayed employees that may not know english to find and flag videos, or a bot that crawls youtube, searching for certain keywords and demographics, or a combination of both. its probable that lewtoons has just been lucky, or his network has done a really good job at taking care of that stuff before it becomes a problem (if he has a network)

I just got a copyright strike for using a 5 second ko clip. The rest of the 5 minute video was me and my friend breaking it down. In response I decided to take down over 20 videos that use clips from the same company and am switching my format entirely. I just need to believe the new format can work, I'm not willing to lose my channel and all I've built. The saddest part is I have contacted several copyright lawyers to explore options and gotten no replies. They all specialize in pursuing copyright claims for large corporations, not defending them for the little guy.

Hey man! I just gotta say you have the best martial arts breakdown channel on KZread. I know you do mostly boxing videos but in my experience the UFC is the most petty, desperate company when it comes too copyright claims. My friend uploaded a 1 minute fight entrance of Donald Cerrone that he filmed from his tv. Absolutely no footage of the actual fight and they claimed it and got it taken down. Like do they really consider that stealing their content? Seriously what harm is that doing to them?

Years ago I had a video taken off my channel and had my entire channel shut down by Fremantle International Media because of an original song that I wrote that satirized The American Idol TV Show. If you think that KZread's system is broken now (And it still is) you should have experienced how broken it was like back then. Luckily the EFF intervened for me and got a person to actually watch my video and I got my channel back. But I still had a lot of restrictions on my channel and eventually had to give it up and start over. You are guilty until proven innocent in Google's eyes and I am glad that you made this video and that others are spreading the word.

I've dealt with claims in the past. I'll admit I've been rather fortunate when it comes to claims, but I've also had crazy things like AUTOMATED CLAIMING third party websites try to claim some of my video content. They go around and claim your video saying you used some copyrighted material (which was all fair use in a review), they had specified what they had claimed but it was a bull shit claim that had nothing to do with my video (some song I never even used), they also never even specified where in the video this apparent stealing took place. Luckily the issue was resolved, but that company took probably over a month's revenue from that video just because of the system in place, and that was when I was barely scraping by. You know when there are literally websites and third party companies designed to take advantage of this loop-hole for easy money that THERE'S A PROBLEM.

Tell that to every big copyright holder around the world. People can't even upload clips without a holder blowing the whole thing out of proportion. An example of such would be clips from the anime "Bleach". Content from that and many other anime tend to get targeted on a regular basis. One of the channels I've subscribed to had previously been taken down due to the flawed copyright system. Said channel had uploaded videos of the Fire Emblem Awakening support conversations. Said videos got me interested in that game and getting a 3DS. Even the people who run the ScrewAttack channel are having trouble with copyright claims.

I posted a video critiquing an episode of Adam Ruins Everything. I played a few seconds of Adam Ruins Everything and then paused it and discussed the argument for a few minutes, then repeated. They filed a copyright claim, and when I challenged it, the copyright holder said, "Nah, I'd rather keep the ad revenue." So I took it off KZread and posted it on Facebook, which doesn't have an absurdly slanted copyright process. But it also doesn't have monetization, so I didn't earn anything either.

It's those greedy company execs thinking they own the Internet but US copyright law says otherwise. My theory is if you CHANGE the content at all and are uploading it for fun or parody or just a karaoke etc, it is not a violation because copyright ONLY exists to keep the owner from loss of revenue and my upload does not cause them a loss of revenue.

It isn't as if most of the people are selling this stuff bootleg. We're just uploading for fun or education. or criticism. So, if a company thinks I have infringed, just take me to court. And when I counter-sue for damages, don't cry. It should be fair both ways. You don't auto-criminalize a YT user and put some bullshit strike on their channel. Then later Playboy released a video on the same level. KZread's automatic claims systems found the prior let's player's videos, and the robots decided that they were the same footage as the latter's (because the level always plays the same) and suspended the former's videos, even without the latter asking for it.

Hey-- I would suggest watching Jim Sterling's video on "copyright deadlock." It is a method he came up with to protect his videos from being unfairly claimed by companies and seems to also be what you have come into unintentionally. Receiving multiple claims from different companies on the same video is actually much safer for you than a claim from a single company and if I am correct you should not have much to worry about. Hope this helps.

Rather than blaming the owners of the content in this case, it's more like KZread's system is awful and needs to be fixed to let the creators protect themselves.

+Iris in a Bottle It doesn't matter which country made the content, if intend to make that content in another country, they must abide by that country's rules. If they don't, that's illegal. TeamFourStar is an American company based in Texas. Any claims made by Fuji TV or Akira Toriyama must be made through the American court system, which has fair use.

And Hollywood, here’s some advice: If you’re that scared of content creators taking all your fans, maybe stop assuming what people want in movies, allow your own creators to make something good, make better movies and such to attract your fans back, and stop burning every bridge you come across. In reality, content creators help you more than they hurt you. So stop being a spoiled pretentious child and start looking at the bigger picture. Idiots. Love you Channel Awesome!

This is just a never-ending battle between the creators against the machines run by big companies (I could have just said the big companies, but that would require actual people doing something). The big problem is not that the companies randomly claim videos, it's the way that it's built that, no matter what happens, the creators end up with all the punishments while the companies get away with all the rewards with no consequences happening to them. I think everybody would know for a fact that something is wrong on that level. It's even worse than the notion of "Guilty until proven innocent". In fact, to prove this case further, 2 days after this video, I got a strike on my channel because I used clips of Michael Jackson's Smooth Criminal owned by Sony Music Entertainment in a documentary video about Will Vinton. Clearly, it's under fair use because the clip was meant for educational purposes, but SME don't care, or at least SME programmed the machines to not care. So, while I have to carry this stupid burden, I'll be spreading the message of #WTFU until KZread wakes up from their stupidity and realize there's a problem

What KZread is doing is absolutely bonkers. I remember when KZread used to be much more lenient and there was tons more freedom. When you take away this freedom by putting a copyright claims on almost any video you upload, it takes away the fun of making videos and growing your channel. And speaking of growing, isn't that what KZread should strive for? If KZread wants to be a growing media platform, then why constantly put these limitations. Some people, like myself, just want to post videos for pure entertainment. Those type of people own nothing, aren't doing it for profit, and don't want to settle such a very minor issue in court. This needs to end now. KZread needs to give us our freedom back and needs to stop abusing the power of free use. And, I never thought that I would ever say this, KZread also needs to bring back the dislikes button. I never thought that I would miss something in the "negative category", but the dislike button has actually been more helpful than anything KZread related. Now I have to watch every video of pure chance. Yes there is the comment section, but even that can prove falsehood or be disabled. It's 2022 and we need the future of KZread the change for the better and we need to have it start right now. #WTFU

Captain Io Music isn't quite the same. Copyrighted music cannot be used for that and will be claimed. You need to make sure music you're using isn't copyrighted before using it. There are tons of artists who make music and don't put copyright on it and some who even just ask that you donate before using their songs. Using copyrighted music is like featuring films in a video that are copyrighted. They can legally be claimed.

+StupendousRecks 65 I'm sorry but until true competition is established, there's little reason we should all hope for KZread to start serving us truffles on a silver platter. Google knows _exactly_ what they're doing, they just need a good enough _reason_ to spend their precious money to back-peddle out of shit creek.

+BUILD THE WALL They have. Nobody goes to them. Making all this bitching halarious. It's like trying to "save the penguins" with facebook likes. You want ACTUAL change? That takes effort, sacrifice, and cooperation by many. Instead, everyone is rallying behind videos that amount to nothing more than one more "stern letter" to KZread that is tossed in with the trash and ignored. Also, "big KZreadrs". Pretty sure the Nostalgia Critic and IHE are NOT "big KZreadrs" when you start hearing CNN, PewDiePie, or VEVO talking about this, then maybe there'd be momentum behind this "movement". This country is so big that these movements feel "big" when they're just a loose collection of people. The big masses that make up 90% of KZread's userbase, don't give a fuck or even know about this.

TB even went on and made a video expressing the problem with the system, and that he was lucky because he was big and had a company behind him. Every false claim should cost the company that claimed the video, should at least have to pay 1$ for every subscriber that channel has to the content creator. This might happen once, or twice, and viola, no accusations anymore. But the companys bought the law, so something even remotely close to it wont come.

I lost a channel i had worked on for 12 months exposing scammers, i was using fair use guidelines, even going as far as consulting with a lawyer who specializes in copyright law, like only using clips from the videos, then i would interject at relevant points, but the scammer filed a copyright infringement notice on 3 of my videos claiming i was using his image, voice and name without his permission, i was shocked that could happen so quickly and my appeals were pointless, like i was dealing with a bot (surprising) and my fair use defence wasn't even considered, even though this scammer had 9 channels deleted for false or misleading information in his videos, the very same info i was exposing, its crazy!! I have a back up channel that i maintained for this very reason, but it's not the point. FAIR USE SUCKS!!!

@@bradyd.6332 How much is too much? There's literally no textbook answer to that question. A court would have to decide while taking other thiings into account as well. IMO the most damning thing in his videos is his catch phrase "I remember so you don't have to" which could be interpreted as "I'm showing you this copyrighted content so you don't have to go buy it."

I know several people who have decided not to watch a film simply because the NC covered the whole plot. That isn’t fair use at all, it’s downright piracy.

I'm a very small let's player, who does not use music, film content, or anything from major media - Hell, I don't even cover many if any large scale games! To date I have had 41 videos content id matched due to the youtube system deciding that game music with my voice or background noise is another copyrighted song, and have even had two manual claims, although I did mange to successfully remove one trike and get the other claims removed, I have had to stop videos from staying public due to no monetization far too many times. I make JUST enough to cover my bills and support my fiancée that is working towards her masters degree before soon starting her PHD. I can't imagine what It's like for you or other channels that use hollywood grade footage, but even little channels like I and many many others are being effected. This needs to end, It's slowly strangling the life out of content producers TRYING to make this their living who just want a fair shot.

You wanna know what's the real problem caused here? It's the fact that the SOPA, Viacom and the rest of the people who're take control of KZread, including the owners of whatever being reviewed cannot understand or accept other people's opinions. Instead of listening to the reviewer/critic about what they've done and learning from the negative things that had being said in the review, they're being very immature and decides that whoever makes an review on a movie, show or episode that he's a bad person for not saying very good things about them and deciding that this guy should never be on KZread, and that he doesn't have any right to show his feelings about an episode, show or movie that he doesn't like. KZread is a public website, and when it comes to reviews, everyone have any right to share their feelings and opinions about a movie, show and episode that they're seem to like or dislike. You cannot removing the negative reviews just because the creator don't wanna people saying bad things about his projects. And yes, they can go too far (I used to went to far with my opinions), but it's just because they care. If the creator sees a video who negatively reviews one of his works, he should at least listen to the reviewer's opinions and feelings, and to learn from the mistakes that had being made in his works, according the reviewer, and if he is saying harsh things, he should understand that it's because he cares. Removing those kind of videos not only show that you don't care, but it'll also make you look like immature people who can't accept people's opinions about your works. I say it for everyone's benefit, bring the Fair Use back, listen to the reviewers who just want to show their care, opinions and feelings about the movie/show/episode, and let KZread be again a public website who acts fairly to it's users and letting their feelings being shared with the world. #WTFU
