    My wife and I were getting married and the planner worked with us on the contract. When it got closer to the wedding (a week before) the planner started to say we wouldn't get certain things and couldn't do stuff like keep the space till 12am and we had to be out by 11pm. Wouldn't provide utensils and the like and wouldn't provide a bartender and tried to charge us more. We referred her back to the signed contract and she threaten to refuse to do the wedding and refused to refund. We threatened a lawsuit and contacted a lawyer as it was such short notice. Long story short we got what we wanted and she had to follow the 4 corners of the signed paper. She was also released from the people that used her services at this place. It was a fire house that a good friend of ours worked.

    Which is absolutely stupid on thier part. A chance to crowd source all the creativity and writing etc.. They just had to create the platform and facilitate the authors creation. Total win win. Greed is not good. Blizzard made the same mistake with the map maker and starcraft 2. Developers went indie after that. So Steam and the mobile game markets owe blizzard a huge thank you🤣 You dont profitize creative fields, you profit from it. There is a huge difference between those 2 concepts.

    @@greylatern Yeah, and it looks like Bethesda is queuing up to make the exact same mistake, by trying to enslave the mod making community and force them all onto a paid mods system where Bethesda gets a cut. Literally killing the golden goose. Modders are the only reason any of their games since Morrowind are worth a damn, they can't even fix their own bugs without modder help. Imagine having a community that does all of that vital work for you, for free, and then alienating them because you just can't sleep at night without figuring out a way to make them pay you for the privilege of fixing your messes. The next Elder Scrolls and Fallout will bomb because of these new policies, you mark my words.

    Not a read the contract moment, but a fact about consumer goods contracts many people don’t know. Ever seen a warranty contract that requires you to use a manufacturer-approved service center or the warranty gets voided, or a label that purports to void the warranty if removed (usually covering a screw that must be removed to open a casing)? Those contract terms and labels have been illegal and completely unenforceable in the USA since 1975, under the Magnuson-Moss Warranty Act. Companies regularly try to slip them in anyway, banking on US consumers being too ignorant to know any better.

    What are consumers realistically going to do? Companies are so big now the best you'll get is 4 dollars off a class action.

    Applied for a job at a mobile phone company going door to door years ago (turns out I would have been selling phones to people in areas not covered by there mobile towers at the time). Did a group interview with a dozen other youngsters. Towards the end they dropped the contract in front of us and gave us 5 minutes to read it. It was 2 inches thick, not many people can read that fast. I quickly skimmed over it until I found the pay section. When I read that it said they could withhold my pay for up to 45 days, for no reason, I asked if I could take the contract home and read it over fully. They refused, I got up and walked out on the spot, much to the chagrin of the interviewers. Got a couple strange looks from the other people being interviewed and only one other person walked out after me. (I guess he thought me asking to take it home and being refused was enough to walk as well.) Two things stood out: 1. Why would I sign a contract I havent been able to read? 2. Why would I work for you if you can decide on a whim not to pay me? Hope those other kids never signed it. I would have hated to be walking around in summer in Queensland going door to door and then waiting a month and a half to get paid anything...

    The car dealership story is classic bait-and-switch. If a business offers a product at a certain price, amd then tries to sucker their customer into a higher cost replacement, they have to give the other priduct at the same price.

    Just remember. If a thing in the contract violates state or federal law. It doesn't matter if you sign the contract and agreed to it. Since it's still violates the law you still have grounds to sue.

    Ah, yes, memories. Had a foreign firm looking to hire IT contractors, and there was some sketchiness about them. I told the (local) recruiter that I didn't want to sign a non-compete; he replied that the company didn't have one. The contract arrives; it's longer and denser than expected, with basically no paragraph breaks, and, yep, sure enough, a one-year industry-encompassing non-compete is buried deep within a tangentially related section. I wanted to tell them where and how far to stick it, but I did really need the money at the time - and then I realized that mine was the first signature. Two can play this game. I used PDF editing software, changed the "one year" to "one day", put in an extra space elsewhere in the section so the character count was the same...then signed it and sent it back to them. When the copy with both signatures showed up, I checked, and it was my revision. Lo and behold, they were in fact terrible to work for, pretty much reasoning that I wouldn't want to take myself entirely out of the business for a full year after leaving them, and obliquely threatening me with the clause when I said I wanted out. Instead, when the time came, I dropped the resignation letter, took the next day off to play a few video games and enjoy a nice fruit smoothie...then after the contractually mandated 24 hours were up, I sent the resume right back out and was back in business. They must have read it at some point, because I never heard from them again.

    Story 5, I find to be next to impossible to believe. It is plainly written in the sales agreement and is standard across all 50 states and territories that absolutely nothing written, spoken, signed for, or otherwise said by a salesman is non-binding as the salesmen does not act as an agent for the dealership. Only the dealerships authorized agent (manager) is allowed to sign off and agree to any deals. And that anything not on the purchase agreement, in writing, signed for by the manager and the buyer, is entirely null and void. This has been taken to court hundreds of times and almost every single time it has gone in the dealers favor.

    If you are talking about the tailpipe story, I think you might have missed that OP and hubby were going to pass unless the written contract included something about all modifications being under warranty. If that required a manager to do, then a manager must have done so, because they got it in writing.

  • @bergmanoswell879

    @bergmanoswell879

    2 ай бұрын

    The dealerships win those cases because salesmen are not authorized agents of the company. But a manager IS an authorized agent, and the people in the story DID have an in-writing contract, which proves they were dealing with an agent. It is a bedrock principle of contract law that anything an authorized agent says is part of the deal IS part of the deal - the only obstacle is proving it if there is no written contract. That’s why agents HATE being recorded on the phone, because the recording creates the same sort of record a written contract does.
