It isn't always just a matter of appearing relevant. There are rules relating to introducing evidence. If the prosecution fails to follow the rules the evidence can't be used. For example, did the prosecution properly disclose the existence of that evidence to the defense? Was the evidence properly authenticated or is its authenticity in dispute? Was it legally obtained? In pursuit of keeping our criminal justice system honest and in compliance with Constitutional limitations they are denied the ability to use what is discovered by unconstitutional or illegal means.

Looking forward to the day when we can watch the News and current affairs WITHOUT ANY REFERENCE TO TRUMP. I'm sick to death of his name, face, voice, imposing brutish manner and any of his irrational rants. When can we all live in a Trump free world?!

In some cases, evidence can be conditional based upon what the other team brings in and what witnesses say. Regardless... all potential evidence is known prior to trial... both sides should be ready to argue for its exclusion or inclusion as well as counter it during trial.

Before 24x7 cable news, the media was more ethical (not saying there weren't problems) and understood that putting things like this out there ASAP could ruin a trial. All of them are more concerned about revenue anymore. There are strong first amendment protections (esp around journalists) but the rules around the court proceedings haven't been updated since before CNN started (that I am aware).

Sure changed their tune since Bill Clinton haven't they. Talk about a double standard. Btw, I could give shit less who is using the catch and kill, the fact that Trump did when he decided to run is what matters in this case. Seriously, who wants a guy in office who is running around on his wife and who has sexualy assaulted women. If that were your mom, sister, daughter or wife you might think differently about giving this little fellow here all that power.

Not all D's have double standard re B Clinton. However, L or R "leaning" news makes me sick/angry, and does come across as double standard and patronizing. I also hate the jovial, yuk-yuk attitudes/delivery and/or the foaming at the mouth type reporting. Where ARE the days of level headed, just-give-me-the-facts news?? Even if I agree with the subject matter, the overt dramatization actually diminishes the gravity of the situation before us. Maybe I'm just too old for all the drama/acting/hype of all of today's cable news.

@@briangandee8149 It is my opinion that all jurors in Trumps' case be sequestered. Seems like common sense. Even Edith Bunker was sequestered when she was on a jury.

Lawyers should have assumed texts and other evidence like that.

I read in the NY Times (?) that it wasn't the contents of the text that elicited the 'Whoa!' from Trump's defense lawyer, rather it was when the name of the text's author was inadvertently read out loud to the court, as it was supposed be kept under wraps.
