However, an occupied territory have the right to defend themselves from occupier. Therefore, palestine or gaza has the right to defend themselves. The 2 conditions are different, one is self defense of one independent state towards a military aggression of other independent state, the other is self defense of occupied territory towards their occupier. Don't you know the West Bank is also part of Palestine and is ruled by the Palestinian Authority (different from Hamas)? Gaza is not a state, it's a territory and under International Law, a STATE has to attack another so the latter can claim self-defence. Anyway, those technicalities are not what really matters in her argument. What's relevant is the fact that Israel has been occupying Gaza since 2007 by doing a blockade that has kept the territory in inhumane conditions. Hamas attacks are a response to that occupation and under International Law, Israel cannot claim self-defence in that case. It makes all sense. Let me give you an example: In the XIXth century, Spain was the colonizer of the now Latin American countries. The indigenous people of those territories attacked Spain to become independent. If the UN existed by that time, could have Spain claimed self-defence?

Gaza is 'occupied' territory (occupied by whom?). Technically, if you follow this lady's argument, Hamas is a gang of thugs fighting for control over turf and wanting to expand that turf. So, with no legal status any and all acts of violence, physical or otherwise, are criminal acts, making Hamas a crime syndicate with the crime boss tucked away safely and lavishly in Doha Qatar. And a very well funded one at that, because the UN has a commission supplying aid and funds just for them.
