If anything, his thorough and detailed testimony did wonders for restoring TMZ's brand and integrity as a news publicist & he makes it clear that the video they received was edited in an unfavorable light due entirely to the original source, aka Amber Heard.

    It’s liberating to see many many people 99 % who still care about justice and truth in this society, there’s always 1% of people like AH . I am just so glad that majority of people in this world still go out of their way fighting for justice and truth. JD is very luck to have a great legal team and amazing people behind him . I can see he is very grateful and thankful.

    I actually really like this judge. She sustains objections so politely and when that Elaine argues with her ruling the judge also shuts her up in a polite way.

    Well, not always. During the testimony of the former TMZ employee, she admitted that this Elaine insulted him by saying he was getting his 10 minutes of fame. And she dismissed Camille's objection. I didn't understand that at all.

    And now he's testified, it becomes clear why they were so desperate to stop him! He avoided all hearsay objections & just explained the difficulties in getting copyright on videos they are sent, unless the video has been sent by the person who made the video & they have verification of that, in which case they can publish within about 15 minutes. "how long did it take you to publish the video of Johnny slamming cabinets (as filmed by AH)?" answer "about 15 minutes" Ouch Amber!!!!!!

    This appears to be a desperate attempt by TMZ party for damage control to further salvage the company from upcoming possible future lawsuits they may face after this A.H. - J.D. trial I guess. 🙄Afterall that transpired from this case, it seems that J.D. has some good valid reasons to possibly file another case.. this time to TMZ.... That's why TMZ's Legal Team is initiating immediatel legal remedies to contain the scenario. 🙄 Just my thoughts... not sure 🙄

    1. They're a tabloid. 2. They got the video from a first party source to obtain copyright. 3. TMZ is such a litigious 'reporting' entity that they wouldn't risk the chance of being sued over the quick 15 minute submission of the private nature of this cabinet video. (2 party consent laws pending) With these points to consider it's hard to not believe that it would either be JD who'd have submitted this video to TMZ or Amber. I have a 99.999999% belief it to be the latter.

    Heard’s team seems to be completely one level lawyers. They act as if this is a closed doors summary hearing, just trying to win on technicality. Depp’s team realizes that the optics are more important

    TMZ's lawyer deserves some credit here. He was thrown into this chaotic case at the last minute, argues his client's interests cogently and intelligently, loses his argument gracefully, and still asks to reserve some rights to protect his client. Compared to the craziness coming out of Heard's team, he seems like a star.

    It makes sense now why Johnny didn't list TMZ as a co-defendant for the defamation suit because TMZ could easily invoke Journalist's privilege. However, since TMZ is not a party, and a former employee is willingly volunteering to provide the information, Journalist privilege isn't applicable in a civil matter. In regards to the NDA between Morgan and TMZ, that's an employment issue that TMZ will have pursue separately. However, if TMZ decides to pursue the NDA case, then Johnny's team can definitely get involved as the issue relates to their defamation case assuming he's proven that he was defamed. This strategy is genius.

    How he testified is also an interesting "tactic" I would say, very genius too. But I don't think Depp's team would necessarily go after TMZ for the defamation case as a follow-up. The media and public opinion these few weeks clearly favor Depp, hence he's probably gonna get film contracts back in hand.

    @@gagecarlsen3872 It's really hard to sue a publication for defamation or for anything really. The 1st Amendment is much stronger than the 2nd Amendment. That being said, if TMZ willing and knowingly published false and damaging information, then they might be liable as well. But in this case, I don't think they knew that AH edited the kitchen video clip.

    Supposedly NDAs signed with your former employers are perpetual and last for your entire lifetime. No one has really challenged it in court so who knows, this might be a first!     There's probably a NDA included in his employment contract that lasts well beyond his time of employment. It's mainly meant to protect company secrets and anything else that's confidential. It's a common occurrence in news outlets

    Her total net worth is 2.9 million even if he wins she doesn't have the money to pay him no movie deals in the works no beauty brand deals nothing he is spending the money and his time to prove she is a bald face liar he wants his reputation back he wants his life back he is certainly guilty of a wandering eye he was smitten and divorced the mother of his children biggest mistake of his life who gave him 15 years and was faithful and loyal neither of which Amber is or was he likes his booze and drugs like alot of folks but he is no wife beater he is clearing his name she will have to declare bankruptcy if he wins his judgement and enforces the judgement.

    I honestly don't think TMZ is there for Amber. Their concern seemed valid at the time. They thought an ex-employee would leak a confidential source. If that would have happened TMZ would have more difficulty getting confidential sources to say stuff in the future. In the end he didn't leak the name. Just insinuated TMZ owned the copyright or a license to the video which typically only could be granted by the one who made the video (who was Amber). But he never named Amber.

    JDs team should have submitted an aerial if the LA County courthouse -- it literally takes up an ENTIRE city block and has at least 11 exits that I can remember (there may be more than 11, but I'm sure of at least 11).     The TMZ guy was a class act....he never divulged sources....simply spoke of the process.....which clearly showed the video could only have come from AH due to how quickly it was uploaded to the TMZ website from time of receipt....copyright can be received within 15 minutes if yr dealing with the person who owns the video.... video was loaded onto the TMZ website 15 minutes after receipt !

    @@npcimknot958 That's because Camille guided his testimony in a way that would protected him from a possible lawsuit if he even dare to break TMZ's NDA and without enter on hearsay territory bc she (and I guess the rest of Depp's legal team) knew that it was the only way they could get his testimony in front of the jury, so, instead of revealing the source he describe the proccess, steps, etc they take at TMZ in his area if expertise, thus revealing who was the source without explicitly mentioning that it was Amber all along; that *it HAD to be Amber and no one else.* And the Jury understood what Morgan Tremaine (TMZ ex-employee) was trying to tell them with his testimony, they got the message. *Sorry for my bad english.*

    Fun fact: even though the witness is JD's, they knew nothing about the subpoena, as their lawyer claims. Guess what, the subpoena came from AH's team the night before as a trick, so they could claim reporters priviledge on the spot, trying to torpedo the witness.

    AIUI the ex-TMZ employee did not identify the source but simply explained the process by which TMZ obtains permission to publish. Something that is generally public if not common knowledge. Given the speed with which it was published it is clear that the only possible source could have been Amber Heard herself.

    I don't think he was trying to attack him or vise versa, it's just their job. Also if you heard in the beginning TMZ lawyer greeted Ben (Johnny's Law) by saying "Hi,it's good to see you". Which explains why Ben said he's known him for years when he apologized I'm sure they don't take anything personal since they're there solely to represent others. He prob just said that so the judge knows he didn't meant it as a personal attack.

    The TMZ attorney from Ballard Spahr (a well-regarded law firm, btw) presented his arguments in a very clear and professional manner. Honestly, he seems more competent than Amber’s lawyers. That said, I’m glad he lost the motion to intervene because that ex-employee’s testimony was really compelling.

    Except he cited criminal cases that would have got him an F in law class. Though he could intimidate a Judge would be cowered by his $2500 hourly rate. The Judge politely stated you have no case, not relevant, get out of my court room.

    So interesting to see another PROFESSIONAL lawyer enter the arena & see the tone in the courtroom, with the judge & Depp's team both professional, but also relaxed & joking around with them & the issue, clearly a lot of professional respect there & an ability for all to just act in their normal professional way, instead of needing to respond to the ongoing circus that the other side in this trial keep creating

    @@scottbecker4367 From the sound of it, the ex-employee isn't held back by an NDA otherwise, I feel that TMZ would've mentioned it like Depp's lawyer said. It could have already expired- or in other words, the validity of the NDA no longer stands. Would really love to definitively know if Heard is her own leaker.

    I watched the former TMZ employee's testimony. As a former journalist myself, it didn't seem that he violated any journalistic ethics. Whether he violated any non-disclosure agreement (NDA) with TMZ is unknown, but would not be within the purview of this court in this case.
