The plaintiff says her younger brother got mad at her and banged on her ceiling, damaging it. She’s suing for reimbursement. The defendant claims the plaintiff is actually trying to steal their family home from their mother, who has dementia. He’s countersuing for emotional distress.

    Well written! It's unfortunate that greed, selfishness, ego/pride and resentment make people forget what's really important. A mother's love is usually unconditional but more often than not the same can't be said vice versa especially when money and/or property is involved.

    As a parent this is my worst nightmare my kids fighting over my property. I have to find a way to fix this before it's too late. This is why I love this show I learned everyday.

    Having a will formally drawn up is a good start. Not some notebook you scribbled things down on, but something drawn up and notarized, makes it harder to dispute.

    This happens more often than is comfortable. As the other commenter mentioned, having an attorney draw up a Will is helpful but being very clear with exactly what you want each child to receive ownership of is so important. If you own a home and want it shared equally, being specific is so it's not left for interpretation by a court. This applies to all assets and even debts. Just be as specific and if you can afford it, consult an attorney. Also maybe having a family meeting and clearly expressing your concerns and expectations to each of them together can also help. Being a parent is never easy and I think for the most part good parents all share these type of fears. Best of luck to you and your family 💛

    My auntie did this exact same thing, took over the house stop paying insurance on the house cashed in all the insurance policies, moved in an addict and he burnt 🔥 the whole house down. Something that my granny left for her grand kids n family. Some people are so ignorant n cruel only out for themselves

    This rings so true. Hubby's sister did that to him and his other sister. She was worried that my hubby would have the house, with him being the eldest but he had told his mother that he wouldn't take anything from his sisters. The sister made sure that she got absolutely everything and her brother and sister weren't even allowed a momento of their parents and she did all this while my hubby was fighting cancer in hospital so he wasn't fit enough to fight her.

    @@marys6800 I've seen it happen in other families including my next door neighbor, a wealthy man (retired lawyer) who recently died of covid. One branch of his family came (a niece and her children) and totally cleaned out the house (he had lots of valuables---lots), took everything they wanted (I watched them out my kitchen window), then had an estate sale to sell the rest. Then they told me they hadn't even told his sister (who was the closest person to him in life) yet that he had died---after they cleared out everything he owned. She will get absolutely nothing. They even tried to have his dogs euthanized until they found out it was cheaper to give them to an anmal rescue.

    My aunt did the same thing to my grandma, who passed away a few months ago. For some reason my aunt has my grandmother's will and refuses to give it up.

    My mother does the same thing with the doctor, and when she realizes that she is at the doctor's office, she fights and screams. The doctor provided a mobile doctor to come to the home. It is unfortunate. I love my mother, and it breaks my heart to see her like this. She was diagnosed with dementia; there is no indication of Alzheimer's.

    I'm sorry, Beth... I know that there's probably not much that can be done once the diagnosis of dementia is made, but I do hope that your mother is able to find some peaceful moments and that you are doing alright and have the strength and patience you need.

    The holes in the ceiling look very much like drywall nail-pop holes to me. 🤷‍♀️ I don’t think her broom aim could be that perfectly straight. And drywall nails (not drywall screws) pop out. Especially in ceilings. Even more especially when some dufus is banging that hard on the floor above. And the notch out of the bottom of the beams looks like something that someone did to hide a wire or something. Not legal, but done by crappy “contractors” all the time. I dare anyone to put holes like that in a ceiling joist with a broom handle. The broom handle would give first. I love JM. She’s my spirit animal 😂 But I disagree this is time.

    Came here to say this. My ex had nails like this popping through in a wall. (I was blind to the red flags okay) The fact that they were in a straight line and directly lined up with the beams also speaks to the fact that they were nail holes. What was the lady supposedly doing. Using a stud finder and then precisely hitting them with a wooden broom (plastic or aluminum would bend or break after one hit).

    Judge Milian was right they should have their own house and money instead of waiting for their mom to pass so they can fight over what she is leaving behind. I see this way too much--it's sad and embarrassing!!

    A broom handle won't make that level of damage in the wood beam, but the rest of the read was probably right on. The holes are popped nails and spackle from pressure, from above. The dude is a loser with no where to go - bad life choices got him in this predicament.

    First, the holes in the ceiling were not caused by a broom. They are where the Sheetrock mud covering the nail heads popped off due to the vibration from above. If you look at the holes, they are perfectly lined up with the beams indicating attachment points for the drywall. If you put a piece of drywall at ceiling height over your head and hit it with a broom, the holes would be in random places including between the beams. No matter how hard you try, you could not hit the beam locations every time with a broom. As for the notches in the beams, they are perfectly in line with each other which would be impossible to do with a broom. That’s not to mention that a woman her size couldn’t possibly, holding a broom over her head, penetrate the Sheetrock and make notches that deep into the beams. The notches were most likely put there by the builder to use as a wire channel. He then changed his mind and went through the beam as shown in the picture. The originally intended channel was then covered up by the Sheetrock. No harm, no foul. Sorry Judge, you got this one wrong.

    I'm so glad you said this. The worst evaluation of evidence by the Judge I've ever seen. You can clearly see the nail head in the center of the circles. I'm shocked she was so quick to come to the wrong conclusion and the plaintiff was too uninformed to argue her case. Shame.

    The sister flames the fire by calling the family home her home. It appears she may have coached the mom into signing over the house to her and forfeiting the other children rights to an equal share of the property.

    The judge was wrong when it came to the sister. You can tell that the holes from the bottom were perfectly evenly spaced because of the nails holding the sheetrock. He was banging on the floor so hard that the sheet rock would recoil from the impact and everywhere that there was a nail it would cause I divit and a dimple. And then when she made the judgment about the marks in the wood itself. There is no way that a broom could even touch the wood, because you would have to go through the sheet rock first. And there were no complete holes all the way through the sheet rock. Remember we were only able to see the wood because the sister has had the sheet rock removed. You would think that the judge being in the construction business or at least growing up around it. She would be able to make that deduction correctly. Then she shuts the sister up so fast to the point of not even being able to prove her point. That is what I dislike about the justice system sometimes. They moved to quick to make their judgments and they can be wrong. Take a look at the holes in ceiling and you see what I mean. No one could jab that perfectly and symmetrically to make dents in divots in perfect lines, somewhat evenly spaced. Judge Marion is usually on point but she dropped the ball big-time this time. Also the holes that judge Marion focused on were recesses cut in the Beams to allow the electrical wiring to go from point A to point B. And the brother got caught red-handed and tried to lie about all the stomping that he was doing. Sheet rock will break down like that when you bang on it too hard. This is the problem with the few being able to govern the many because they don't have all the answers. I noticed she said that the holes were already there in the video. That's because he had been stomping already so the sister decided when he stopped again she was going to videotape it. Do you think she had a video camera ready for the first time he stomped. Of course not. I know it's easy to be influenced by things that you have done thousands of times. But we still need to keep control over our emotions when in places of power. I think the Judge on was affected by the fact that their mother was dying and they were fighting so it caused her to lose sight.

    The problem with the sister's story is that there was damage to her ceiling (looked like broom holes) and then sues brother for damages to same ceiling. Did the broom handle do that damage probably not, but when she is damaging her ceiling it should not be up to a judge to decide how much was damaged by her and how much was damaged by him. One would think the brother would be running his mother to the dr. to prove dementia or Alzheimer, without a diagnosis means if she sold the house to the sister it will stand.

    I doubt that's broom damage. 1 she would have to have perfect aim along the beam. 2 a broom can't do that damage to the beam. She would've been better off busting through the drywall and hitting the direct floor if she was wanting to make noise or just yell upstairs. Those holes are where putty was covering the drywall screws/nails and his vibration upstairs was making them fall out. You can see the screw/nail heads in each one.

    Those were screw pops. You can tell because inside of the drywall holes that happen when the screw starts pushing through, you can see the tiny hole where the screw once was. Additionally the holes were in straight lines, another indication that they were screw pops. Those are not something she did with a broom.

    Family disputes like this is so damn sad. As a mother, my heart would be so broken if my children were acting like randoms from the street towards each other. Most parents spend their lives investing mentally, emotionally, financially, and otherwise into their children only for them to grow up acting like they hate each other and make life intolerable. This happens way too often when a parent is in their elder years or passes. It can get absolutely disgusting and I truly wish this family (and others alike) much healing.

    There’s a part of the video that clearly shows the nails perfectly in a row that was not caused by a broom hitting the ceiling. Either she took a ladder and look for nails with a magnetic stud finder and hit with the broom on the nails perfectly centered or the brother actually did the damage by hitting the floor. Obviously the brother cause the damage with the hard banging.

    Judge was wrong !!!the dude was stomping, as all the plaster was missing on all of the nail hole areas . The so called damage on the beams wasn't caused by a broom handle as you can see all the wiring of the old school BX wire was installed by drilling and the so called beam damage was a result of a mistake that the electricians made from long time ago running wire directly inline with that junction box for the fan notching the beam . This has been hidden under the drywall all these years and was only discovered when the drywall was removed.

    Those holes could be the drywall nails popping. Or the improper nails were used and were popping from the force of the banging from up above.

    There is NO WAY a broom can do that to wood, they look like a drill hole groove for passing cables or something. Sometimes the judge really shows her ignorance, does she really think a beam that is strong enough to hold up a floor can be damaged like that with a simple broom? They are also the same size grooves and all in a straight line...

    Agreed, they are from old wires ran to, or from the junction box. Being the daughter of a contractor should have qualified the judge to make a better ruling than that. No broom on the planet can cause damage to douglas fir or pine ceiling trusses (joists) like those.

    After some thought, I’m glad both plaintiff and defendant came out “losing” in that no one gained any money. What money could be of any good when two siblings are already fighting over property? To the dismay of their ailing mother. Alzheimer’s and dementia is NOT easy, and their mother needs love and attention from all her children to ensure she’s comfortable, the same way I’m sure she gave her blood, sweat, and tears to her children to raise them. I believe they’re both wrong in some way, and need to grow up!

    The problem is the brother. The sisters there trying to take care of her mother. The brother is enabling and causing unhealthy life choices and he's destroying the family property as well. This is another attempt of the sister trying to make it good for the mother and the system is still failing her. The sun is not therefore his mother he is there for what he can get. If he was he would have taken her to the hospital to get it checked out already. You noticed he has not. He is a proven liar. If it wasn't for him all would be well. Now they have to spend thousands of dollars to attempt to keep the family estate in a decent manner. Who does that to their own family?

    For the most part I agree with the judge but this time she was way off the mark. You can clearly see if you look at the drywall you can see that the drywall popped at the nails or screws from him jumping on the ceiling. Also a broom handle wouldn’t damage the lumber. That “damage” the judge was referring to is for where the wiring went for the ceiling fan. Which is shoddy electrical work from a ceiling fan installation.

    Exactly......You stated exactly what I was about to write. I would be livid if she had passed the judgement against me. She's always stating " expert witnesses". The judge should have talked to an "expert witness " before making her judgement. That judgement was SO wrong. She should have never made that judgement if she didn't know what she was talking about. You can clearly she the holes at the bottom of the beams are drilled. Never seen a broom handle do a perfectly round hole,lol....SO CRAZY JUDGEMENT.

    Buuuuuttttt the "holes" in the ceiling are in a perfect row plus there are several that bulge DOWN. If the judge had looked into the center of each hole and found a screw, well, that damage came from above. I think the sheetrock screws were rattled downward, they do it on their own sometimes anyway....

    Judge is completely wrong here. Bottom of beams is from being drilled out to run wires. The holes in the drywall you can clearly see nails-this is caused by movement popping out the spackling

    @ 14:00 That’s the plaster popping away from the nails and NOT upward impact. He’s not stomping his feet it sounds more like a heavy dining table or ‘that dresser’ being lifted and dropped up and down. That poor elderly mother.

    The judge, plaintiff and defendant were all wrong. The ceiling damage was NOT from a broom handle. And, was I the only one that saw the crack way on top of the first picture??? That beam was cracked. Who cracked it? We see the damage just for a couple of seconds, though it is there.

    An acquaintance gave some money to his parents and purchased their home without his 3 siblings knowing. That home is worth millions and the siblings didn’t get a dime. Some people are rotten to the core.

    I have my doubts about the sister. I think she influenced the mother into signing the house over to her. She keeps talking about it being HER house. It should be the grandmother's house until her death. She also has control issues, like turning off the WiFi and coaching her mother during the Zoom meetings. What I find strange is that the brother must be living in thr grandmother's apartment. What about the nephew and two nieces smoking weed in the grandmother's apartment. The poor lady. I bet she just wants some peace in her home.

    No the holes in the drywall are from the plaster falling out from him pounding from above. They are perfectly in line and have a drywall screw in the center. Take a closer look. Judge got this one wrong.

    I thought the same thing. But if you look at the holes they are in line with each other. Also in the center of each hole is a nail. You can see the black tip of the nail head. Those holes are where the ceiling dry wall was put up. Very possible his stomping from above loosens the spackel in those holes.

    The son should man up and live in his own place. He is the type that tells everyone that he is living with his mother to "take care" of her. The daughter doesn't want him there in the house, in the first place. If something happens to the mom, he is as good as homeless.

    very sad I love the judge but she's completely wrong this time, by the location of the "holes" you can see that it's drywall screws going into the trusses. no one would pound a broom in a persistent line with the truss.

    The noise was going on while she was videoing it. This damage was from above. They need pictures from the floor above. This all happened from above, you could see hole after hole appear while she was standing below and videoing. He is creating havoc because he wants to live rent free off his sister, and living off his mothers money. I bet he does not have a job. The judge should have asked him that.

    Absolutely no way a broom did that to a 2x10. If a broom could do that all houses would be falling over. Those were drill holes for wires most likely for a light. So the sheet rock can sit tight to the rafters/joists. I just lost all confidence in judge m making correct decisions on cases involving and construction. Neither one hurt the beams.

    Why or how did the House get in Sister Carli's Name? As a person that use to do Construction...the perfect circular holes he said was from a Broom handle that she done....NOT!!!! those are where the pounding caused the Nails and or Screws the plaster falling off of the drywall...with that said...the perfectly round dents, could be from a broom. As for the Holes in the bottom of the Beams as they call it....those are Trusses and they are made of Pine which they have Knot Holes and the knots have fallen out probably before the drywall was even put up whenever.

    If the picture she took, was of the damage from the brother, then she says "no, that hole was from the hanging fan.". Which is it, proof of damage or where the fan went? That was a very crooked hole for a fan. 🤨

    Ok, first off the ceiling is not from stomping in the top floor. If that was so there would be an awful lot of apartments with ceiling damage. Looks like broom holes to me.. Send, who is paying for the WiFi? If she is paying she can turn it off whenever she wants! Update.. I thought so.

    This is sad and ridiculous all at the same time. Stuff like this should never happen amongst siblings especially when the legal owner of the home hasn’t even passed yet. The childish drama the plaintiff and defendant are bringing on this poor mother in her own home should be labeled as elder abuse. For the plaintiff to constantly refer to the home as being hers would set any person off. If she is responsible for the mother as in POA and MPOA then she should be taking her mother to get diagnosed. If these things can not be provided for her then I think it would be in the whole family’s best interest to just sell the home and use that money to put her in the best nursing home with a full time professional RN to look after her. If their mother was able to say and could have her way she would never allow her children to start hating each other over possessions she’s worked her butt off for. I bet she’d give it all up just for peace and love between siblings. I bet they’ll all be regretful and shamed when their mother passes and all they have left is each other. Right now the only fussing that should be happening is who and how their time with their mother is being spent. Life is too damn short to worry about material things. Love hard and deeply now and share all those feelings you have with those you care for because any second that passes is a second you’ll never get back. Get your priorities straight and grow the hell up!!This whole mentality of thinking what your parents have is owed to them as their children. No way!! Take some accountability and build your own assets. No grown ass adults should be fighting over their mothers house. They should be self efficient enough to have your own damn house not leaching off a elderly mother. I so wish that mother could have a hour worth of clear normal thinking so she can throw both their asses out after a ass whooping. That crap with the banging and destroying the ceiling is toddler behavior. Then coming on national television expecting sympathy or whatever but getting nothing but disgust. Get ‘em JM.     For any reason, a tenant can NEVER take justice into his own hands by not paying his rent. Judge Millian is wrong on that one. If a tenant suffers a prejudice, he must turn to the Rental Borad to obtain a compensation and/or a rebate on his rent. Otherwise, the tenant can be evicted for non payment of the rent.

    Any good carpenter will tell you the damage is from the flexing of the beams from heavy pounding from above. The holes are from "popping" of the screw/nails in the drywall. As far as the damage holes in the bottom of the beams, if you think thats made from a broom handle, you know nothing about wood. Thoses ROUND holes are made by a drill to pass a wire.
