Making Mom Mad

The plaintiff’s son was fatally shot at his girlfriend’s house. The plaintiff says she asked her other son, the defendant, to pick up the car from the house and bring it to her, but he refuses. She is suing for the value of a car. The defendant says he was close with his brother and had the title to the car and thinks his brother would have wanted him to have it.

    She fails to accept the effect that she negatively affected the lives of her kids. 2 years in foster care...even 2 days in foster care, she has no idea what was done to her children and its because of her addiction. Sure, getting it together is great but when they act like the kids have no right to complain because they fixed themselves eventually its truly sad and disgusting.

    @@Nevaeh1 That I did know from the disclaimer often shown at the end about an amount of money put to the side to pay an appearance fee to the litigants, with it being distributed unequally to compensate the winning litigant. Does Judge Mathis not have the same thing? I find the people on his show are a little... trashy... to put it politely. (Not always, but frequently.) On the other hand, Judge Judy makes me actively uncomfortable because of her aggressive and confrontational nature... And hence, Judge Milian clearly comes out on top for me. I love her quirky personality.

    I love how recovering addicts like to spin things. If the son is saying they were in and out of the system I believe him. I suspect family members raised him. Suing the only son for a car that cannot be registered, has no plates or insurance, the mother doesn't have a license all for a car probably worth 2 grand.

    Neither one even has a driver’s license! A 2000 Nissan Maxima? At 22 years old it will probably cost considerably more to make it street legal in California than it will ever be worth. Either one of them will have to spend money to go through Probate Court to get it, then getting the proper paperwork will be a pain if even possible. That car will eventually be impounded and scrapped because it will never be street legal again.

    I can understand the brother wanting the car. It's a 20-something priority, but the mother? She puts her wants and needs above those of her son's. She would rather fight this senseless battle for a useless vehicle than emotionally connect with her grieving son. My heart breaks for them, but I hope the son gets the maternal relationship he needs from his aunt, cause his mother seems too self involved.

The likelihood of either one of them actually getting a driver’s license, insurance, and making the car legal in California is beyond slim. It will result in another unlicensed, uninsured motorist driving an unregistered vehicle putting innocent lives in danger. The son wanting to make the car a show car? There are only so many ways you can polish a turd, but it’s still a turd.

    @@brucecoleman7412 I could be wrong but I interpreted "show car" in a more commemorative way. Like having some type of gathering where loved ones could be around the car while celebrating him? Personally I wouldn't, because as you stated, there are costs to storing the vehicle. But some people have a difficult time thinking logically during the grieving process and it sounds like there some resentment towards the mom for not being very present or nurturing.

They choose men, drugs, and the street life OVER their children then want to act all offended and hurt when the kids grow older to resent them and call them out on it. I believe every word her son said about the childhood he was subjected to because of her choices and behavior.

    I disagree on one point. Being a "baby mama" has nothing to do with it. There are millions of kids from 2 parent homes with married parents that are just as fked up. I am a pediatric RN and can tell you some stories, especially about many men committing murder/suicides of their wives right in front of their kids or fathers who moles* their own kids with the wifes full knowledge. Happens way more than you think.

    @@Childfree334 but on average that's not the norm. for example, you can't say most drivers get into car accidents because a small minority of drunk drivers cause the accidents. children from broken baby momma homes on average have poorer outcomes thank two parent homes.

    I grew up in foster care with a selfish mother, the best thing I did was cut contact with her and stopped her from wrecking my life. I hope Rubin does the same. This "mothers" mentality reminds me so much of my own. I love his auntie I want her in my life lol!

    Being a former foster child and child of a recovering addict & alcoholic, I totally resonate with the defendant. The fact this mother cares more about this vehicle than grieving the loss of her child is so damn sad. I truly encourage everyone above the age of 18 to set up any type of Will possible. Even if you don't have many assets, as you see here, simply leaving a car behind can cause a rift between loved ones(so damn sad but greed really takes over so many folks). Be very specific and if your family dynamic allows it, speak openly or have family meetings about your wishes if anything were to ever happen. This can possibly avoid conflicts or just plain messiness should something unexpectedly ever happen😢

    The judge is right, without a wife or children, parents are next in line to inherit the estate. Give her the car and let her deal with the issues that go along with it. Such a shame these kinds of things are so common.

    Girl what the hell are you talking about 22 years old doesn't mean a car is not worth shit, I've had a 2007 an older car for the last 5 years the one car that I had that was a 2010 and cost $13000 the transmission went out 4 months later....     It isn't about the car....he was only 27 years old and it sounds like he had very little assets to keep hold of. The brother wants it because while the mom was "having troubles" they had each other...so he wants to keep it. I don't blame him...he doesn't want her to have it because she would drive it unregistered, non licensed...and uninsured...it would get towed away and left in an impound lot until crushed at a junk yard. He wants to make a memorial out of it... I can only hope that the mom gets something of her sons and that his brother can keep the car and someday make it legally his own.

    This case hits very close to home for me. I understand and empathize with the defendant. If I was him I’d give the car to his mother and walk away from her. I learned a long time ago as a child that the people who claim to love you unconditionally can be the most toxic people in your life. Even now with a son dead and only one left living she’s choosing her needs over his. The defendant seems like such a good soul and I’m so sorry for his loss. I wish him all the best in life. As for the plaintiff, I have no pity for someone who is more bothered by ending up with a car than trying to heal a relationship with her only son.

    Nobody bothered to research anything before coming to court. Technically, the car wasn't even registered or titled in the dead son's name. It still belongs to the previous owner. Each state may differ, but in most states the seller and purchaser fill out the form on the back of the title, in front of a notary public, so that the new owner can get it titled in their name. Some may be more lax and all you need is a notarized bill of sale. Without any of that, they're fighting over a car that technically wasn't the dead son's.

    If anyone is buying or selling a vehicle, that title should be transferred to the purchaser before they even take posession. The seller shouldn't let the buyer drive off with their plate on the car. If the buyer gets parking tickets or is in an accident before the title's transferred, that will all fall on the seller. The buyer can play dumb and after an accident say that they just borrowed the car. They're not going to insure that car until it's in their name, so you'll be on the hook.

    She has no right to down play how he feels about his childhood. I can't believe she just kept going on about how hard she tried and how much she was in their life well in foster care. Obviously it wasn't enough and your making it worse lady. I feel bad for this man.

    Like most addicts and non-present parents, she’s minimizing the situation. She thinks that just because she sent birthday cakes and stopped by to see him that she was present, when in actuality, she wasn’t. The aunt seems to have been present in his life more than her too, which is why he views her more as a mother than his own mom. That said, the mother does have a legal right to the car, simply because that’s the law. However, since it appears the son has a closer relationship with his brother than she did, he has more of an emotional right. I understand that he wants to save, preserve, and rebuild the car instead of having it be used for driving which will only break the already old car down more. Worse, the brother didn’t have it registered, so even the legal right the mother has may be complex to enforce. Just sad all around. I’d say maybe her son or her sister can give her rides, but it seems those relationships are broken down so deeply. Sad.

    this goes DEEPER! than what ANY! Court can handle, plaintiff sounds broke (financially); son is hurt (emotionally) & sister/aunt (?); if plaintiff thinks getting the car will make her whole?, i'd let her have it, sever ties with her & move on with my life! SOME! family has to be loved from afar, this seems the situation here, they will just continue to hurt each other emotionally if this continues, Sadly.

    I can very much tell that she's a recovering addict and it appears to have affected her personality and her brain function, unfortunately. If I had to guess, the aunt may have had a larger part in raising him, which is why he isn't as "ghetto" as the 'mom'. She can't even keep her mouth shut while he's talking. He's more respectful than she is. Neither should get the car. Any mom who would sue over something like this is ridiculous. Though the other son shouldn't get the car either if it wasn't even registered to the brother that died.

    It's so sad that some families become petty after a death☠️😢. I've seen it in my family 😞. When my grandparents passed my maternal side sat down and worked everything out completely civilly 🙏. Unfortunately it was the complete opposite on my father's side. Terrible to witness and seeing the pettiness of people who "love" each other?! It's difficult to look at so many of them the same. BTW the people in my father's family live very comfortably and are in no need of money 🤷🤦. So once again proving the point MONEY can't/doesn't buy you love. Love comes from within YOUR own heart 💗🙏

    People need to start writing down and getting their wish notarized. You don't have to have a will. Keep it in a safe place or your bank. And you can give a copy to the person you trust to handle things right.

    This is a really sad case. It's unfortunate that people fight over money or material things that never belonged to them in the 1st place. I must say that however this turns out, I hope they keep the deceased in mind and his memory is kept alive in the most positive and loving way.

    After losing my grandmother in 2018 I've realized that it's not the material things she had, given or owned..it's all about the love we shared.. that can never be found in material things .. its still standing strong in my heart. I pray in time this mother learns that lesson. God bless them all.

    I understand that the mother wants something tangible of her son's for his memory, but I don't see how (especially since she cannot drive) she wouldn't be happy knowing that her other son feels closer to his brother. As a mother, you think about your children and their grief before your own.

    Material objects will unfortunately break a family apart. I'm sorry, but if I were the mom I would gladly let him have the car for the simple fact he was in foster care. That's the least she could do. If I were the son I'd at least offer to take her to appts to help her out.

    I feel for the surviving son. I understand the sentimental value. Whoever the mother should get the car🤦🏾‍♀️ they all need to get registration, license and insurance on order. It's not fair to other drivers having to assume the financial cost when you get in accidents with people like this. If you can afford registration, plates, license, and insurance take the bus🙄

    This is the saddest case I've ever seen being it that I had the best relationship with my mother until she passed. So this is completely unimaginable to see this mother/son here in court over a dead relatives vehicle. My mother was the best thing to ever happen to me in every way possible. I'd give anything to have her back now. What an embarrassment.

    The car is sentimental to the brother. He's not ready to let go of it, especially to a mother that doesn't have the ways and means to maintain it, nor even has a driver's license to begin with. She is not a good parent, and he wants to keep what is left of his brother's memory. I get it.

    Sorry for your loss. To the brother- keep your head up, You have your aunty! Hold onto her, she’s your mom as your mother said to her. I do believe your maternal mother is only out for the car. To ask for it Before the burial even. She was just trying to snag up a free Car. It’s not about the memories for her. But for you it is, god work in mysterious ways, which is why your mother didn’t win this case. Even though you didn’t win either, you are left with the opportunity to continue forward.     They are in California. Before either one of them can register the car, they must have the proper paperwork and the car must pass inspection, a smog test, and be insured. My guess is that none of that will ever take place from either party. More than likely, a 2000 Nissan will require expensive repairs that Mom can’t afford to be legal. If she gets the car with no drivers license, no registration, and no insurance, she could take a lot of Uber rides for less than the heap of trouble she is heading for.

Giving all the love they can give to a child 2 then there’s the parents that pretend to be the 1st parent that actually cares more about themselves than there own child, I completely understand what this man going threw

    When my Mom passed away I bought my Dad a handmade blanket made by a Navajo tribe out west-it was gorgeous-Queen sized royal blue with a wolf on it baying at the moon. My elder sister shipped him off to one of my brother’s who he was supposed to live with(I knew nothing about it)-within 3 days my brother and his wife(they have no kids), dumped him into a SNIF unit(skilled nursing facility-meant for Alzheimer’s patients-and he had his full capacities), when I found out,I immediately flew up there to get him out and take him to my home-I noticed he had none of his belongings and he was cold-I asked him where the blanket I got him was, he said “D#####(name redacted-my evil sister-in-law) said I wouldn’t need it where I was going so she said she’d just keep it”…I was pissed!!! I paid $400 for that blanket and had it made special for my Dad! When I asked the B about it, she completely ignored me-I haven’t spoken to them in over 15 years…absolutely zero loss to me! How dare she!!! Since then, on a routine doctors visit, they discovered that she was in complete renal failure and immediately put her on dialysis 4 times a week…she has extensive liver damage & blood cancer….I’ve had a kidney and adrenal gland removed, but my creatinine levels have been steady for over 4 years(God willing they continue to be so I won’t need dialysis-time will tell)-I will not get on a transplant list, because I am 64 and I consider myself too old-I do not want to take a kidney from a young person who could be on the list behind me. She, on the other hand, stated to a family member “it should’ve been ‘her’(meaning me)” whose kidneys completely shut down & got the blood cancer. She has also gotten herself on the kidney transplant list, even though the blood cancer will most likely attack the transplant-she said she’ll just keep getting more transplants-as many as it takes(zero thought as to how many young Moms and Dads there are out there who desperately need a kidney to survive to raise their young families)! And she is my age! Well…that’s my vent for the day….

    No matter what he's gone through, if that car is just sitting there collecting dust, there is no good reason his mom shouldn't be able to use it. What kind of "show car" would that fiberglass peace of junk make? This is a sad situation. The son seems to be punishing his mom for the decisions she made while raising them.
