Not Being Concrete in His Abilities

The plaintiff says she hired the defendant to make a concrete kitchen counter for her, but he broke it. He came back and tried again, but he broke that one too, so she’s suing for a refund. The defendant says the plaintiff’s boyfriend complained and says the plaintiff was impatient.

    I've watched these cases long enough to predict that the Plaintiff was gonna loose, because after all she didn't let the Defendant finish his work, so for that there was no final result for her to complain about.

    If you’re insistent on choosing a concrete counter top even after the contractor suggests otherwise then at least have enough patience and faith to let the guy finish the work. It would not surprise me one bit that she changed her mind after seeing it being done. I think even if this went smoothly and the job was finished perfectly concrete is known to start cracking after so many years. Or something dropping hard on the surface could start a chain reaction of cracking causing the whole thing to need redone. Glad the defendant won.

    concrete counter tops are pour on 1 time and are not done with rapid concrete, it takes a few days to dry and turn over, this guy might be good with granite but he dont know shit about concrete counter tops

    I agree I truly believe he was inexperienced but it was never stated why she eventually went with granite after she told him to not come back. She lost the case only for breach of contract because if she allowed him to continue his horrible work then the defendant would have been proved incompetent and she could have sued for the whole thing back plus the court fees possibly. Was the sudden change of heart because she disliked it or was it a time issue? She left it in a way we will never know.

    @@Possumpat84 you are right, she should wait one more day, but in the pictures it lack still mesh or fibers mesh, it would never hold, the guy is a joke, even if the guy have done the pouring right, it could never be turned over next day it needed at least 3 days before turn over

    I did too and if done right, it's not supposed to crack. Also know someone who installed concrete countertops and they did not have any cracks at any point in time. Don't think concrete countertops was this guy's strong suit and probably why he tried to get them to go granite.

    I poured my own concrete countertops, with molds I built. It's not a multi-step, go back and fix it process. You pour it once, turn it over, and then sand it and seal it. That's it. The mess he made was never going to be fixed, and he has no idea what he was doing. But she should've let him finish and then sued him. That guy is a total joke and shouldn't be pouring concrete for anyone or on anything. Concrete countertops are beautiful, durable, And east to clean. I've had mine for years and haven't had to do anything other than reseal them every 5 or 7 years. I also have poured my own concrete floors in my bathroom, which are stained and sealed. Concrete is an easy, cheap, durable, beautiful alternative to a homeowner with modern taste and artistic know how. My bathroom floors are stained concrete but my countertops are raw concrete. After having them I'd never go back to granite, which is ridiculously expensive and vulnerable to cracking and staining.

    She played herself. First off, everyone knows a contractor would never be like, "I'll give you all your money back (labor + supplies) if you don't like it!" If he did that he would have not only did free labor, but he would have lost his own money on supplies. So its clear she was lying to the judge straight out the gate and lost all credibility. Second, if he DID say that, which is her testimony, then the "100% money back guarantee" would only apply to the finished product. She never actually let him finish, therefore she never saw a finished product to evaluate as to whether she "liked it" or not.

    That’s not how concrete countertops are done. It’s typically one pour with at times an additional wet flood coat as the final coat for tiny bubbles, etc. with a sand down either wet or dry, polish work and water resistant coat. Not yank out loose chunks of concrete and hope a new pour will fix it.

    Sorry but we install tons of these. The defendant was 10000% WRONG! That was a terrible job and the guy installing was not only cutting corners but not trained how to properly install a concrete countertop! Absolutely incompetent! You don’t even take off the mold for at least 2-3 days. Sometimes 4. Wasn’t even cured yet after less then 24 hours!

    My Wife has worked with the cement that he used and it does set extremely rapidly. She uses an additive that slows it down a little but it sets extremely fast. The last project she made was a backsplash for a sink area. She was able to do as the defendant mentioned, do it over several days and she worked in an area each day. She incorporated Mexican tiles into the wall and floor enhanced with polished stones. It’s beautiful! Again as he said it isn’t a one day job and it takes going over parts already done previously. One other thing is the cement used along with the additives is very expensive and its easily seen that $700 was spent on materials. It’s too bad that inexperienced people know more than the people who work with it. The person that he had helping him didn’t overcharge a bit for doing the work.

    His first mistake was going forward with someone who out of the box, gets the bid for what she asks for and then asks "what if I don't like it?" That question right there tells you there may be a problem with that client and there's at least a 50% chance she's going to come back and say "I don't like it" and want her money back. All businesses are faced with people who are uncertain as to what they want. All businesses have people that think they want one thing when they really want something else and just don't know it. You have to be able to listen to what they say, how they express themselves, and if you get an inkling they're uncertain, give the some other options, even if those options mean recommending something you don't provide.

    Sorry but the defendant does not appear to know what he is doing, and if those are 'Hairline' cracks, I'm Bob Villa! (PS, I'm not!!) He was trying to use distracting language to flim-flam JM, that actually made no sense. The reason he was getting the cracks is due to shrinkage, it has to do with the water to cement ratio, why did he not precast the countertop, use rebar or even mesh for some reinforcement? I cannot believe this guy is 7th generation, wasn't he taking notes? My Dad was a carpenter all his life, owned a small construction company all my life, and wore his knees out pouring cement, he would just shake his head at this. I have never personally poured a cement countertop, I have however made umpteen stepping stones, and even I know this job was messed up from the get-go!!

    I just googled concrete counter tops, while they do look nice, in many of the pics there are cracks but on the sides and the front. I also saw a lot of air bubbles. Several had cracks that were filled in on top (they almost seemed to make it like a fault line). The tops always looked beautiful but when looking closer many many defects everywhere else.

    Concrete is such a porous substance, it can be difficult to work with in a fine detail capacity. But you would think they would come up with a different way of creating a concrete countertop other than flipping it when it's hardened. I feel like that just creates the potential for it to get damaged.

    I have a cement counter and it took a week to build the top... Cement and concrete will crack, it has to be kept moist till hardened and the slower it can dry the stronger it gets. This guy suggested something else and she wanted what she wanted... She is the dummy not the contractor. Besides you have to pour concrete in parts, even pavements and roads have seams...

    its like the plantiffs acted like they knew how to do the defendants job after laughing at him when he explained how it works- in that case they couldve done it themselves if they think its so easy lol they dont understand how countertops work. they wouldnt even let him finish his job first. shady on the plantiffs part. her karen attitude at the end as well

    He doesn't know what he's talking about. Concrete should be poured all at once. It didn't look like he had an rebar or mesh reinforcement in there either. Letting it shrink and crack and trying to fill in the cracks on the surface is asking for disaster

    Ya'll must have some voodoo construction products in the USA. In europe concrete worktops particularly with a breakfast bar overhang would require reinforcement such as rebar. Seems this guy has his 'flash finish' off to a tee as it's his most common technique for covering up structural defects. That said, the plaintiffs first clue that he was not going to be able to do the job was when the defendant "tried to talk them into buying a granite worktop".

    Plaintiff said that she was flipping the house. Want to keep the costs down. Instead of paying $1700, look for an old door, and cut it for the counter. Much cheaper, and much easier to work with.

    I did some research on Pinterest for other people who built concrete countertops, and they poured the concrete in stages of thin layers. They smoothed out, and sanded each layer. I believe the way this guy was doing it he was pouring too thick of a layer at first, and because it dried so quickly it cracked. She should’ve let him finish, and then determined the quality of his work.

    Pouring the concrete at the house was a dead giveaway that this was done on the cheap. Usually it’s done at the factory so they have better control over temperature, humidity, etc. Then there’s the sanding. Who wants dust everywhere from the sanding inside their kitchen. Then at the end usually an epoxy coat is put on to prevent chipping and this stuff smells terrible. Again, something that you don’t want done inside your kitchen. You want cheap, you get cheap.

    He is so full of BS and says it with such confidence, that he actually convinced the judge that botching it with huge cracks and then hiding the cracks is what everyone does, NO IT IS NOT, just a shoddy workman botches it up and hides it. If he had been left to finish it, that wouldn't have changed the fact that he had botched it, all those cracks have rendered the work surface weak. This is no different than if he was installing a mirror and broke it and said we just need to glue the corners, these are hairline cracks, that's all normal. Would you leave him to finish, NO. I can't believe the judge found in his favor, he was totally incompetent...

    He's not telling the truth, cement for countertops does dry faster but not that fast, wouldn't work if it did dry in fifteen minutes, it wouldn't be spreadable and you have to cover it with plastic to slow the curing time to make the cement harden to the optimum.

    Defendant said this was years ago and the plaintiff says no it wasnt but when asked if the defendant was there for two days the plaintiff said this was years ago so she cant remember... 😂

    Yeah, the contractor must not be experienced with concrete. Pouring in fits and starts and attempting to fill in cracks is a recipe for disaster.
