He is toooooo involved, he should play referee but he can’t help witnesses remember what they said earlier, how do we check if they are credible or not!!! You and most of us here do not know who killed Senzo, not even Tumelo, by his own admission by the way, knows who killed Senzo. He said so! And HE was in that house when things happened!!! These lawyers are here to find out the truth. Even though these guys may be criminals, it doesn’t mean they committed every crime in South Africa. You probably eat meat, would you be happy to be arrested for stock theft just because you eat meat!!! Lawyers know the law, where they play outside of the Rules of the Court, the Court just have to correct them, not get involved as much as this judge is doing!

When the witnesses denies what is on their statements and blames the police he agrees with them, stating that “ you know how our police are”. When the police who are witnesses comes he supports them. I mean a judge accepts and defends a police when asked how did he search/do his investigation, the answer given is “ngi bheke nje”. I mean part of the basic out come of the police training is how they do investigation. The judge does not ask clarification on what is the first responders’ procedure when arriving at an alleged shooting crime scrne, esoecially when told thst the victim has been transported to the hospital. I mean all these are categorically stated in police training and duties. You are not going to be suprised. The court’s out comes are clear now.

Ballistic investigation should have been done on the hole to establish the external ballistic that means to establish where the shooter was standing inside the house. Hybo there is a toolmark mos that is supposed to be done by the same forensic expert.

The judges is not convinced that the crime scene was contaminated. On his 2nd or 3rd day, he stated that it did not matter that one witness states that Senzo was lying in the sitting room and the other states that he was lying in the bedroom, the fact of the matter was that intruders got in and a shot was fired. The judge does not even find it a bit perculiar for the first responders to leave the crime scene unguarded, and rush to the hospital, I mean there were two seasoned police officers and two students in the car. If the police could decide st the hospital to leave two student police, why wouldn’t they thought that they can leave one seasoned police officer at the crime scene or accompanied by one student; and as they drive for hospital call for a backup support at the hospital?

These Mshololos will be Judges tomorrow ... I wonder!
