Police officials are writing statements on their own and commosioned by other Police officials, the author of the statement will have a copy, if there is anything or I consistance the prosecutor will order for a retake. So it is not common for the state to have only a typed statement.

This is concerning. Adv. Mshololo asks the court to play the recording (which would confirm the witness saying that he indeed had a handwritten statement in addition to notes that he had before). The Judge acts as if he agrees but never proceeds to allow defense to play it. In his court ruling Judge says "This court finds that no written statement exist." Mnisi comes with cross examination 4 hours after at 4.36 and says to the witness " sir you are saying when you made this statement, the typed version, the handwritten original of which the court has ruled that it's non-existent" then Judge interrupts and says "no no no Mr Mnisi don't misquote the court, i never said the handwritten version does not exist" I find this strange because the ruling in fact ended by saying that "no handwritten statement exists". Same court same day! playing the recording would have made everyone hear the witness confirming what would shortly contradict a ruling which the judge had typed a night before....interesting.

That is the procedure of all courts . Advocates are not called by their titles but rather their Surname . They are only Advocates because the courts have admitted them as such.

Last week there was a crime committed in a certain area.the suspects lied even though there was evidence pointing out on them But when I asked one of the suspect in an individual meeting he agreed to everything. I AM being reminded on how Zungu on stand is confused to state when last he saw Gwabini .they killed Gwabeni.Zungu who is on the witness stand is issuing firearms to the inkabi in the hostel working with Gwabini.the Zungu in the stand today is also responsible for a rape case that was thrown under the bus.a young child was a victim .Gwabini refused to lie about the accused so they killed him.but I am hoping that he did leave evidence behind.
