Not a chance of that happening under the current status of judicial law. There is no _Bivens_ First Amendment retaliation cause of action against _any_ federal actors. This is one of the holdings from _Egbert v. Boule,_ Supreme Court 2022 and even the dissenting Justices agreed with the majority on that issue.

These VA police officers are all federal actors. { Now presented with the question whether to extend Bivens to this context, we hold that there is no Bivens action for First Amendment retaliation. As a disabled veteran I had a "buddy" who was a VA cop. My primary care doctor started repeating things I told my "buddy" so I "unbuddied" him.

I find it astonishing that the cop who actively says a vet smells like ass didn’t also delete the recording of him doing so. It’s almost like he thinks he can get away with anything, and with that mindset, an oversight occurred and he accidentally did a good thing that day by not deleting the video off of the phone he picked up.

I think it is even more disturbing that this is happening at the VA where many military veterans are coping with PTSD and deserve even more patience and compassion

Qualified Immunity isn't the only problem. It is a symptom of the problem. We empower police to do entirely too much. I just read an article about a small town in my state where all the cops quit because the pay wasn't competitive (very small town, one full time cop, 4-5 part time cops). This town, I can just sense it, is going to end up paying a ton of money for new police. I looked it up, in 2021 - the crime spike year - the town had 10 crime reports. None of them violent. 9 property thefts, and one auto theft. They don't need a goddamn full time cop for that amount of crime, much less all the rest.

Fully agree, but why does it have to be "an extreme violation" ??? ANY violations of our Constitutional Rights deserves a swift and severe penalty. Our Founding Fathers, after writing the Declaration of Independence in 1776, didn't write the Constitution until 1785, and even then, it took them almost SIX YEARS. THAT is how much thought, and care was put into it. They were very wise men, to have created this "Democratic Experiment". The way these "Officers" have acted here is beyond disgraceful, it's CRIMINAL, and they should ALL be fired, stripped of all Police Certification so they cant go one town over, and SUED. Abolish Qualified Immunity, so they all lose their Pensions. I'm not an attorney, but clearly, there were a LOT of Laws broken here, and they should all be facing charges. As a Marine Combat Veteran, the fact that these thugs treated another Marine Veteran, AT THE VA, in this manner is absolutely unacceptable and this needs to be seriously legally pursued. Veteran or not, you simply cannot treat people like this. Moreso, a Veteran, literally AT the VA. I'm SO friggin pissed off right now I'd like to drive there and beat the brakes off of these pieces of shit, just for the fun of it. @@ASUTASTUD It's a really big problem in our Country. Cops go thru their respective academies, get all kinds of training except for training in the LAW. Most of them have NO clue what the actual laws are, and yet, they've sworn an oath to support, uphold, and defend The Constitution, but watch any KZread channel, and it's SO painful to see these people walking around with guns, batons, tasers, mace, and body armor, and ZERO knowledge of the law. That has to change.

Sickening to watch, these cops are sub human and belong in Jail. I hope there is a constitutional lawyer out there who will help Curtis sue these tyrants.

As a disabled Veteran. I feel for him. I was homeless not too long ago for nearly a year. Right when COVID first hit. Shit isn’t okay. It’s tough enough out there as is, you don’t need someone fucking with you especially at the VA. That’s the one place you’re supposed to feel valued and relatively safe. I hope all three of them were fired. I hope my fellow Marine brother is doing better. Semper Fidelis my brother.

Those police need to be identified and every veteran in the US should see this video and serve justice on them.

Can you ban a vet from the VA if they haven't broken a law? His only crime was not bending to the will of police who hate the constitution.

If I were the young marine I hope he sues the crap out of this department and every one of those officers. Call this VA and make your thoughts known. @@StvzNuts You have no idea what trespassing is firstly. The fourth Amendment allows you not to identify to anyone unless you have broken the law. You must be asked to leave a property first in order to trespass. Secondly a veteran cannot be trespassed from a veterans hospital unless he breaks the law. Lastly you cannot be searched unless a law has been broken. His rights were violated not less than four times. Including illegal detainment. Illegal arrest, false imprisonment and illegal search and seizure. Learn the constitution and therefor your rights before you criticize anyone. You are ignorant of the law and therefore ignorant of you rights. Oh and a thing called the first amendment gives you freedom of speech. It is not illegal to yell, say obscenities, flip off, chastise or say anything to police...

Fact: He had no obligation to answer questions, at all. Fifth Amendment. Fact: The officer(s) lacked any probable causes for the encounter. Fact: You have to commit a crime to be detained even for a second. Fact: No crime was committed whatsoever. You are a bootlicking, back the blue sycophant and I am sorry for you. Before you answer, read the constitution and laws aboout rights. This happened to me at the Houston VA. I didn't have my phone to record because I was going in for a procedure and didn't want to take stuff with me. Then I arrived early so I sat in the lobby for about 45 minutes and the VA cops came up and demanded to know why I was there and if I had ID (which I didn't because I left that in my car too). Finally it was time for me to go to the department I was there to see so I started walking with them in tow...then they asked the receptionist for my information which they gave to the cops. I now carry my phone inside every time!

Veteran or not, the cop had no business asking the man why he was there or what services he needed unless the man needed some info from the cop! When hexwent straight to "federal property" and "need to see ID", I knew where this was going. The second cop was totally off the rails. They both need to be fired, prosecuted and ordered to pay this man out of their own pockets! Ridiculous!

Why do the cops think you need to identify absent a broken law? They are dumb beyond belief.

You can’t tell a veteran he can’t come back. If this is where he’s been assigned there’s nothing a cop can do to change that. The disrespect for veterans makes my blood boil. Glad he called them out in the end.

In Iowa city at the VA there was a guy out in his vehicle in the parking lot on a Sunday, looked as if he may have been living in it. He said he was from an area at least a few hours away and had an appointment the following day at the VA hospital. VA police came out to talk to him after viewing him on camera. I listened in on the conversation long story short, officer went inside and got him a voucher so he could stay at a nearby hotel. It was nice to see compassion for once
