    The best part: One of the games gave you like 2000 points and then started counting down in intervals of 5 until you win. His Highscore? 999,999 He just went down a list of games and wrote his name and a high number on it, at least 100 times greater than the current number 1 player. He never even started or looked at most of the games once. I think playing "Have you seen this game before" with him would be great. And Todd has to guess if he is the self-proclaimed world record holder who blow everyone out of the water or has never played it. "Oh yeah I have the record" "No, you are not in the list." "Never seen that game before" "oh yeah? you are 300 times higher than any other player ever according to this highscore..."

    My personal favorite is that he said he had a score of over 10k in a game where your character is literally killed and given an instant Game Over the moment you hit 5k or something like that. Sorry, it's been a while so I don't remember which game it is. It was featured in Apollo Legend's coverage of it.

    Hi Karl! Lawyer here. As always, I am very impressed by your non-lawyer legal analysis. The reason Twin Galaxies and Guinness cannot recover fees from Todd is that in the U.S. parties typically bear their own attorneys’ fees absent an agreement (i.e. a contract) or specific statute that allows the prevailing party to recover attorneys’ fees. Parties usually cannot get fees for winning a standard tort case. However, parties can recover “costs” like filing fees-but early on the filing fees (~$1,000) are not worth the expense of filing a motion. Theoretically, Twin Galaxies or Guinness could recover attorneys’ fees by filing a malicious prosecution action against Todd. However, a malicious prosecution claim is hard to prove because it requires showing a lack of “probable cause” and, even if successful, would take years to adjudicate. After being dismissed, most clients are just happy they aren’t being sued anymore and move on. Todd can try again in Florida if the dismissal was “without prejudice.” If the dismissal was with prejudice, Todd cannot refile an amended complaint in the same case. The personal jurisdiction holding means that Todd cannot sue Guinness and Twin Galaxies in Florida, but leaves open the possibility that he could theoretically sue them where they are based (assuming the claims are still timely). I guess we will have to stay tuned to see what happens next. Thanks for the great vid.

    Attorney here as well - just want to add to this fantastic response. Most states have a vexatious litigant law, which does allow for the defendant to potentially recover attorney's fees. However, these law usually require the party to file several lawsuits pro se (without an attorney) in a period of years (here in Texas it's 5 lawsuits in 7 years) which the courts found to be frivolous or were determined adversely to the plaintiff filing the lawsuit. If the party is found to be a vexatious litigant then the defendant can request that the plaintiff be required to post security which would cover the reasonable costs, including attorney's fees, of the defendant. I don't know what the law is in Florida (if there even is a law) since I'm not licensed there, but I suspect there is one, but it likely doesn't apply. Yet. Give him a couple more lawsuits, though, and they may go this way if such a law exists in Florida. Love the videos - keep up the good work!

    Back in 2010 when I was pursuing the Yars’ Revenge world record high score, there was a category for a 15 minute contest, wherein Todd led the leaderboard with a 700k score. I constantly puzzled over techniques to figure out how he could have scored that high that quickly. The pace of Yars Revenge starts slow, and simply doesn’t allow this. I should have figured he just made up that score. My WR submission to Twin Galaxies at that time even included some commentary on Todd’s 15 minute record. I should dig up that VHS tape.

    Lawyer here! Will they get their costs back in any fashion? Highly doubtful. The odds of them seeking costs (if not done so already in their motion) are low. But even if they do, Todd is what we call "judgment proof" meaning he doesn't have any assets they can take (assuming that in this jurisdiction a sanction award/cost shifting award can attach to property like a judgment can). And then, of course, even if they did get an award for their costs, he just wouldn't pay them.

    ​@@namelessliberty9869 Yup! Though usually it's the other way around, with a wealthy business using the legal system to club individuals of modest means. It's exactly as abusable as it sounds, but I don't know of a good solution. Forcing the losing side to always pay costs makes it even harder for a little guy with a legitimate grievance to attain justice, since if he fails in his quest he will be saddled with ruinous debt.

    With respect to costs, they'd need to provide proof of whatever costs they asserted. Rogers would also get an opportunity to defend against the asserted costs so he could demand a hearing. Ultimately even with the bare minimum obstinance from Rogers it would probably cost almost as much to get costs as it did to write a response to the original lawsuit, because you have to pay the lawyers to sit in court all day until their case is called.

    I will say this. I used to be a Todd Rogers believer. Todd and I used to be friends; in fact, he was a huge motivator in me quitting smoking back in the late 2000's/early 2010's.     Not a lawyer but I do work in litigation - my guess is they are very aware that he's not going to be able to pay up re costs, and consider the idea of chasing those to be more trouble than it's worth. Whether they'd be so lenient a second time would be interesting to see.

    they don't have to collect to move to enforce a decision, however they should do it for the message; My professor taught me "when you get that shiny decision worth 1million dollars you can wipe your posterior with it until you've seized their assets and actually have money. (because that takes more litigation and filings to get what the decision says you're owed right?)

    the moral of the story is, it's only people who make a fortune off their lies and misdeeds or even crimes, deserve to have nice things. Remembering how Microsoft was caught in much bigger scandals than this yet their largest shareholders are living large much like the VW CEO who oversaw emission scandals which actually killed people.     You know what this situation with Todd Rogers and Billy Mitchell reminds me of? There was a great Soviet movie, The Ordinary Miracle, and one of the characters in it was Hunter, who is, well, a supposedly great and famous hunter who spends all his time defending his past achievements ("So far he procured fifty diplomas confirming his fame and shot sixty detractors of his talent") instead of actually going and shooting some game because he's too afraid that other hunters will scrutinize his every shot. And when he actually goes on a hunt again, he cheats.

    For the legal cost issue: Yes, a judge WOULD likely affirm a reasonable asking amount for costs. The fact it was thrown out so quickly only strengthens that likeliness since the court obviously and correctly saw it was a clown show being run by an idiot simply to waste time and try and coerce a company into doing what he wants. Also, SLAPP suits are quickly fading out in North America, as court after court after court is rejecting them and ordering costs to be paid out.

    7:55 the captions picked up "Todd is" as "TARDIS" Funny... If Todd could travel though time, I assume he'd attempt to prevent his records from being discovered as fake. Though, knowing how Todd handles things, he'd probably uncover more falsified records by mistake. If he was the TARDIS itself, then... well... don't think he could do all that much, unless the Doctor or someone else was around-but at that point, it'd be the Doctor or a companion preventing Togers' records from being uncovered as fake, and I think Doctor Who has more important duties to attend to than reinstating bogus records via time travel.

    He sent the paperwork to the wrong company. They had no real obligation to respond at all, which was how they argued to get the case thrown out, also taking it a step further and explaining that even if he had filed correctly, there was no merit to the claim. They did what is called good leg work, or in other terms due diligence.

    Really started off my day strong when I clicked this. Less than 5 minutes after waking up I hear "Silly Bitchell" and it's put a smile right on my face. Thanks for your updates Karl.     Attorney (and gamer) here. Generally corporations do not seek costs against pro se (unrepresented) litigants unless their conduct is quite egregious - because, frankly, it looks bad, and usually feels somewhat unfair. Courts do not favor penalizing lay persons for not knowing the law - in Todd's case, he is so oblivious that he hardly poses a threat to a major entity like Guinness, and his complaints were so incompetent that dismissal was inevitable. He is not armed with an attorney or millions of dollars, and, further, he is patently unsophisticated. That's not to say that an order for fees or costs would never follow, but that would probably take a few more baseless or aggressive filings from Todd to get there. If Todd hired an attorney and had the disposable assets to throw excessive legal challenges indiscriminately against many more people, and tried to use the legal system as his own personal sword to attack anyone that said his name, a court would be more prone to issue some kind of sanction at that stage. But until then, a court will usually be satisfied by sanctioning him in the most direct way possible - dismissing his case and demolishing any chance he may have had for money damages.
