Karen & Chad Measure

We have no idea where they got that 100 foot measuring tape but they used it in every way that is wrong if they want to establish boundaries.

    I could not tell what they were doing. The tape was on both sides. If she was saying 7.5 feet to move farther on her land why did she not have the fence put up there. The people that put up the fence did not act like real fence workers. If someone told me to stop and check the surveys then i would check the surveys. Come on you 2 it looks like you are wrong. Anyway thanks for taking the time to listen for us

    @@AzraelThanatos I do believe she is going to take pictures of the camera that's pointing directly at their home and show the judge and try to charge them with stalking or peeping or snooping. I don't think you can have camera's like that. But I really don't know for sure.

    @@pitbull1026 as far as I know, they can have cameras directly to the neighbors property as long as they don’t show directly into their house. Then that’s a privacy violation. None of the cameras do that as far as I know.

    She said she worked for a lawyer and she knows all the people in law enforcement and she was filing criminal trespass on her property but she hasn’t proved where her line is the surveyors can’t put a line anywhere someone says they have to measure honestly or nobody’s line will come out right! That’s so childish!

    They think measuring from the fence is accurate. Apparently they don’t realize their yard is rectangular in shape and the corner markers are what matters. So simple but so sad. It’s unbelievable. They’re gonna get taught a lesson in court when ever the hell that will ever happen.

    he made reference to a code officer coming by and looking months ago and pointing out how badly out of code there house is so they may wind up being forced to leave for being buried under fines and repair costs

    From the reading of from the channel owners. There is a 7ft easement at the the property line. It seems the neighbors believe the "real property line" is halfway into the easement. Which you can see when they have the measuring tape on the ground over hanging both sides of the fence.

    Wow, Joanne and Jack Webb are two of the oldest, craziest, know-it-all kids I've ever seen! They had a tape measure that was plenty long enough to reach 80 feet and not ONCE did they locate their front corner marker pin that's on the other side of their driveway (it ALSO HAS TO BE ON their property, or they don't own it) and measure from IT to the front of their fence (because THEIR LOT is only 80 feet wide). Had they DONE THAT, they would have said (if they were being logical, rational and honest), "Oh dang!...our fence starts almost two feet over on their lawn...sh_t!" Lol

    I would be worried about them claiming squatter's rights to your property. File paperwork with the court that you are disputing the placement of the fence so you have record of it happening.

    @@redzot Come on, wrap this up. Small Claims Court, call your Surveyor to the stand and have him explain his findings. Show your video warning them that they should get a survey and ask the Court for an order that they remove the fence or after 30 days it is yours. Also ask that they be ordered to pay your costs incurred thus far.

    Any idea when this will be settled? Court date? How can they get away with this when the surveyor has already placed the property pins and they just pull them out? Some people are unbelievable. Good luck and keep us updated when you can.

    Measuring, collecting data, documenting, photographing. All in preparation for court, I guess. I wish they would just accept defeat, move their fence and live without ever having to interact with this neighbor again. When you are retired, being annoying is your roll in life.

    No way. He already paid one time. It’s on paper and documented. Plus it’s on video. An abundance of proof. The judge will ask a few questions and look at the paperwork and decide in less than 10 minutes. The seniors should survey their yard but they won’t because they’re so certain that they are right. The seniors are gonna be in for one hell of a shock.

    ​@@NorthlanderMN Actually I think he had it surveyed twice. The first survey didn't do some sort of report, and he wanted that report in order to use in court....so he had it resurveyed. Poor guy. Karen I and Karen II should have paid for a survey when they put up a fence.

I’d bet the fence company made them sign off that if the fence was installed not in their yard they’d have to pay the company to come out to remove it. If the seniors don’t pay to have it removed by a certain time and the judge will establish a time limit that they’d have to move it. If they didn’t move it than it would be redzot fence and he’d have to remove it himself.

    @@robraleigh8614...mmm hmm...because studies have shown that the loud, grating, screeching sound of angry Joanne's voice can damage people's hearing. Other studies have shown that the sound of her voice can also drive people crazy or drive them to drink so good earplugs are an absolute must! (She throws rocks, sand, dirt and plants at people too so eye protection should also be worn.) 😎

    Why hasn’t the County sent out their own surveyor? Or at least someone who has authority to tell this couple they are wrong and stop this before it goes to court. I guess that’s what will eventually happen.

    Yeah, that might be it. They might be saying that if there is an easement 7 feet on each side of the property line, that they can put the fence anywhere in that 14 foot easement.

    Where I live we can put a fence in the easement. The property line runs through the center of the easement. However if utilities need to work in the easement you have to remove the fence. If a utility has to remove the fence they aren’t responsible for damage nor do they have to put it back.

    I'm hooked. Just rejoined Discord so I could keep up! I felt some sympathy to "Karen" at first because of her obvious dementia. But after binge watching the whole situation, I'm angry at her. I guess we all put ourselves in your shoes as we watch, and we react accordingly. I just want to see the dam fence down. I hope for the safety of all involved as this situation resolves.

    It looks like the 100’ tape was very close to being on the actual property line, so they can’t claim they don’t know where that line is. I wonder if they’re going to try and claim half the easement too?

    Yeah, the drainage easement runs the property line but the telephone pole is 2-3 feet into his property. And it looks like they're going to claim _his_ 6' feet of the easement for their own.

    They look like their honing their surveying skills for a second career. Doesn’t seem like it’s going well. Every once in a while they scratch their heads almost in defeat but not quite. They’re not giving up or giving in. Their craziness won’t let them.

    If they think that the telephone pole is the property line, they are sadly mistaken. Karen(?) knows where they properly marker is because she pulled it up and the surveyors had to come back for a special trip to concrete it in! That is if someone hadn’t pulled concrete and all out of the ground. By the way, that fence is so crooked, one could not have an actual measurement! Wondering what was on that little sign she was holding up so chad can take a picture of their little folly!

    To me it looks as if there was a 15’ easement between the properties for the road drainage. The contractor put the culvert within the right-of-way, but not centered within it. That’s common practice because it gives them a guaranteed place to put there equipment where they don’t have to pay for part of the lawn they tear up if they need to do maintenance. The Karen next door is mistaking the gutter drain as the middle of easement and measuring from there ignorant of the offset. As for not being allowed to build their fence within the easement most municipalities don’t care. They’ll simply rip it out, do their work and the owner has no recourse for for the damages.

    I'd love to read what's on the cardboard that they slipped onto the power pole and photographed. It almost looks like they're laying out the easement based on their incorrect property line, but then their fence would be in the easement, which I think is not allowed. I don't know. they are definitely confusing.

    The surveyors have been out, time and time again, but they still expect the boundary to be where they say it should be. A definition of INSANITY is, doing the same thing over and over again, expecting a different result. When it gets to court maybe the judge will have them committed for their own good.

    It looked like they were using the utility pole as a reference point but as they came further down the line they were reaching further into your property with their tape. It looked much more than the pole. They just kept measuring over and over like they were hoping the numbers would change.

    Years ago, Karen asked the local government to install a drainage pipe because the rain from the street caused damage to their property. An easement was granted, half on Karen's, half on Red's. She thinks she owns all of the easement. I imagine there is a prohibition on building on the easement. Karen can not build a fence directly over the pipe, that is where the property line is, so she took it all. This is my best guess.

    At first it appeared as though they might be measuring how much they were gonna have to move the fence, but then when the tape measure came through the fence....I don't know. It might be something about the restraining order, and how close you're gonna be allowed to be to her fence and her property!! Something is definitely up with these two. Who says you can't tear down the fence now, if it's on your property?? The longer that fence is there, it may make you look like you had no problem with it, or something. None of it makes sense to me. I can't believe the court would continue to make you wait for a court date. I mean she got her court date set up pretty quick, didn't she?

    Floss Daly is on the right track. They are measuring the easement as their property line and trying to gain more than the 6ft. easement stated in a previouse video. Technically an easement is your property but with limitations as to the city/county codes. You as a home owner cannot build or install anything on an easement. The fence is not only on redzot's property but is installed on the easemant as well. Keep up the good fight and you will prevail.

    8ft in is city easement. The metro water easement that they have is 7ft on either side of the property line. Which actually they are pretty close to. I believe that they now thing that they can cross the property line and just use any easement land the wish.

    As a matter of fact, referring to my post below, if you go back a year to “Chad is Trying to Tell Us Something”, You see Chad doing exactly that. He extends his fence line with the non-survey approved arm swing out to the road. Steps into the road, turns and does the back sight arm swing to align with the drain with the fence. It’s clearly seen that the fence does line up with the drain.

    My guess: the 100' tape measure was strung out about where the property line is. There is an easement, and they were measuring the easement, which is why it extended past the fence. Only a guess, and trying to apply a logical answer to two people who are clearly NOT logical. Good luck!

    All measuring tapes should come with a small booklet that clearly explains the difference in a slope distance and a horizontal distance, because most people do not have a clue about either.

    I can’t believe how long this has dragged on. That fence should have been removed long ago. If they can put up a fence on your property, why don’t you put up another fence on her property line!!!! Let’s see them try and fight for the remove in court!!! Maybe you’ll get somewhere with the removable of their fence on your land. If they can just throw up a fence on your property and it’s still there, do the same thing!!!

    Those cable anchors being placed where they are, on private land, makes me wonder if there is a easement on the land which can often lead to confusion over boundarys, but they are still clear to a surveyor. It looks like they're about to claim another yard or so, they may as well, they got away with the first grab.

    The property boundery is toward the neighbors house. The entire easement is on Redzots property. The utility pole is on the easement. The ½ height iron fence was illegally built entirely on Redzots property. The neighbor mistakenly believes that the easement should be divided equally but that is not the case as it would result in a lot smaller than allowed by code.

    I think Adverse Possession is the term you're referring to. In most states, the fence would have to be in place without dispute for 7 years for there to be adverse possession. It hasn't and is indeed in dispute.

    They will probably lose. The only thing I could think is if they always thought the property line was there, and they have been maintaining to that point ever since they owned the house, they may have some squatter's rights involved.
