    The court should send an independent surveyor out to mark off the property line, it will confirm that they put the fence on your property, when that is determined, they will have to remove the fence, fix the area that they dug up, and pay for the survey. Case closed.

    Have you ever heard of a court, anywhere “sending an independent surveyor out to mark off a property line”? It’s a civil matter, if a party feels aggrieved they need to file suit to force an action.

    Right. I just moved into a new home. Chain link fence all around. 3 different designs tells me that the owners of this home didn’t pay for them. But I still asked the realtor- didn’t know. I asked the neighbors who’s fence it was - they didn’t know. They believe it is right on the border though. The fences have been here for 20+ years and were there when they moved in. So I told them that I was going to build a wooden fence and leave the chain link up as clear markers. They maintain their fence and I will maintain mine.

    @@kurtdowney1489 - depends on the area. The place I grew up in the nicest side faces out towards the neighbor or street. The frame is on the inside. I like that idea too cause then it makes it harder for someone to jump into my yard.

    Most cities you have to get a fence permit. In my city if the neighbor doesn’t agree to a fence on the property line, then the fence has to go 2 ft into the yard of the person wanting the fence. Perhaps go to your city and ask to see the fence permit, and analyze it.

    Being a former Registered Land Surveyor from Wisconsin , this fence would have been moved to proper location long ago . Take them to court and get orders to have them move the fence and repair any damage to grass . Also show proof you have on her removing your property corner pipe . That too is against the law .     We can't always choose our neighbors, but we can choose how to respond when we have less than friendly ones. We've lived in the same house for over 25 years, and have had issues with two neighbors. The first was funny. I was planning to put up a small metal shed, and made sure that it was well within the lines (5 feet on each side) and even talked to the neighbors. Neither seemed to have an issue or concern, so I built the base/floor, then started putting up the sides. Due to weather and work it was a couple of weeks before I was able to put the roof panels on. My father was over, helping me put the roof on, and we had a couple of panels left, when one of the neighbors wives came out and asked what I was doing. I told her we were finishing the shed, and she got a scowl, then says "Are you going to leave it there?" I replied that I probably was, and asked why. She said something about it blocking her view (which it wouldn't, because her kitchen window (only window on that side of the house) is a good 5 feet higher. She then asked if I would consider moving it. I said "Sure, I'll consider it." and she turned and walked inside. My dad look at me and says "Are you really going to consider it?" I said "Yup. I've already considered it, and I'm not going to move it!" He laughed and we finished building the shed. The shed it still there, and we've had three different people live in that house since. By Karen! The other issue involved mowing. The neighbor complained that I overlapped when I mowed, and they didn't like it. I told them that I wasn't trying to mow their yard, simply overlapping to make sure there wasn't a line of uncut grass. They threw a fit, I laughed and told them to stop being childish. They started yelling at me, so I told them to kick rocks, I wasn't going to change how I mow. If I was malicious, I could have filed all kinds of complaints with the city, about code, parking, and other violations, but I chose not to get into a battle with them. A couple of years later, they lost their house (foreclosure) and moved away. The family that moved in after them was awesome. We get along great, and help each other out all the time. That's how most of our neighborhood is.... we look out for and help each other out.

    Just to be sure I'm clear, to date, your only actions have been: (a) take pictures/videos, (b) get a survey, and (c) resist a specious protective order request that was filed against you. Meanwhile, the clock inexorably ticks forward in your neighbor's favor, as you take no action to secure your property rights. More than a year has passed. In some states, that's over 1/3 of the adverse possession waiting period.

    This scenario reminds me of my neighbor. They have so much room to park in front of their place yet they choose to park right next to my driveway. blocking our view when driving out of our driveway, truly pathetic neighbors.

    My sister and BIL live in Raleigh NC in an 800+k neighborhood. Their neighbor parks in front of their house. When the yard guys come to mow and edge the curbs the neighbor rushes out to move his nice car

    My neighbours did a similar thing. My Dad came in & erected a fence on my boundary line. This meant their stupid illegal fence was on my property. He then gave them 14 days to take it down which they did.

    This is absolutely insane. Surely you should just be able to go purchase an Affidavit from your civil court that proves you're holding legal-documents-(a licensed survey) to enforce this trespassing-fence. Insane that they make us pay for more legal-proof of our land ownership.

    The judge would not grant a restraining order on Redzot and told the woman she didn't prove a need for it and dismissed the case telling her that the boundary line is a civil matter--I think they are trying to get a civil court date. The video from the court room is very telling. I believe this woman will never accept that she is in the wrong and when she passes away will haunt whomever lives there til Jesus sorts every one.

    If they can put up a fence anywhere they want, why not do the same? Put up a fence 10 feet past that fence on their property. Claim it as yours and see what happens!!! If they can do it, do the same thing!!! This is just insane. It should have been old news by now.

    It seems to be resolved already... he said he can't afford a lawyer to take the matter to trial, and his local government doesn't seem inclined to do anything without said trial... so, his neighbors get his property for free.

    And you can recover attorneys fees in the law suit. I like what one of the other viewers said; just pull it out! What are they going to do? You can do it without destroying the fence so they can't throw that in your face! If they try and rebuild, call the police on the trespassers.

It's his land, he's had several surveys done to verify that it's his land, and unless Tennessee does things a LOT differently than Florida he should have zero issues with removing their junk (aka the fence) from his land. But from what he's said, he sees it otherwise and refuses to act without that trial. So she wins by default.

    Hire a surveyor. Have them mark the corners with grounding rods (10 foot ones) so they cannot be removed or moved. Then put a lein on the property for the cost of the survey. You may not be paid for it now but sometime in the future it will be settled because the lein must be satisfied for the property to be sold or deeded to another person

    Just take them to court and stop milking youtube. This could have been handled 6 months ago. I use to feel bad for you until you just did nothing. You spend money on everything but taking them to court which should have been done the first time they pulled your survey markers. I hope this gets settled but I'm not holding my breath. It blows my mind.

    At this point, I would bet that fence is staying and the neighbors will claim fair use. They ARE mowing and maintaining their side of the fence. And once that is done, they will move the fence again.

    Yea but he lives in tenn. I am a surveyor in tenn and you can't do that here. If you pay taxes its yours unless you abandon it and even then its hard to get a judge to take away something along a property line. This guy just doesn't want to call an attorney. I know several that handle these cases. All he needs is a legal survey and an expert (RLS TN) in court to explain his case. Chad is bshitting on him and he is letting him do it. It's that simple.

    Y'know, I ended up subscribed to several neighbor dispute channels about the same time ( you upvote one and you start seeing more) but all of them have been resolved! You had a sympathetic audience but now, people are just annoyed... this jumped the shark already. 😢

    Judge, this fence is obviously on our property. Here's a picture of the fence, installed where we claim the property line is. Here's a picture of his yard, where the fence ain't. I'm sure you can obviously see that the fence isn't in that picture. Your honor, we rest our case.

    Folks, just my opinion, but I don't see anything happening until one of the owners decides to sell their house. It would not be cost effective to resolve it before then....even though I feel the neighbors are really wrong in this case.

    Looks like Jack has downloaded the Landglide app. And is attempting to use it. If he thinks it will give him a clear picture of the property lines he will be disappointed. Landglide will put you within 15 feet of a parcel boundary. It is not a surveyor tool.

    You need to remove the fence at this point, man. If the city is toothless to act against them, then they'll be toothless to act against you for removing it. Stop wasting money on lawyers and pull it out. If they bring contractors in to replace it, call the police on the trespassers and they'll be removed from the property.

    Don't worry my neighbor has had surveyors measured our fence 4 times since we built it on our side of the marker pegs. Gee as if were going to shift a 6 foot concrete fence 40 meters long over a few inches. 🤦‍♂

    I am super curious to know what kind of advice you have been given by your attorney. You have a valid survey as proof of ownership and they will have that legal document notarized. You've been paying your property taxes based on the entire plot of land that includes that 6 to 8 foot wide and 150 ft or so deep strip of land JoAnn is so determined to steal from you one way or another. Cannot think how SHE thinks she can get one over on any judge presiding in arbitration or open court though. There is possibly an issue for you based on how long they've been claiming and maintaining that property as their own. Just curious...can you share with us what your current attorneys advised you to do about this?

    The fence is on your property you get to keep it. They pay damages, lawyer fees court cost survivors fees….everything plus some sort of fee for harassment. Maybe it will cost them so much they finally have to move into a memory care unit…….win win all the way around for you.😊$$$

    That fence would have been history by now if it were on my property..i will deal with the matter later on if i am wrong but a survey is legal and true and the law in my state would say if you build a house on someone elses property its no longer your house.. its whoevers property you built it on
