...actually Bobby James...with the tree in that condition, it definitely is a hazardous situation. Because the tree has grown on the gents property, and is easily identifiable as such...HE IS responsible for the costs of removing such hazard...he should be grateful that the woman undertook the cost of the removal. Had she notified the City and had inspectors come out, he would have been required under City code to have it removed and the cost would have been all his......

And you. Think. The roots. Do… what? Counterbalance the other tree? Please show your work. My structural and statics engineering courses didn’t cover this fantastic discovery of yours. Please explain how removing the top of an adjacent tree causes a root systems magic ability to cantilever a separate tree to suddenly disappear. It’s more likely the two tree were undermining each other’s balanced growth and removing one made things better, not worse. Not much better though. So when the other falls you magicians will still claims it’s because of removing the other tree. Sheer ignorance.

Look up anything about tree roots and be amazed by just how incredibly huge they are. There will be dozens of massive root systems down there all anchored to mother earth

I had a nasty neighbor who thought he was a lawyer. He and his Karen wife gave me a hard time about everything. Right down to "You cant change your oil on your truck in your driveway". I ended up getting a restraining and no trespass order on them. But the verbal abuse continued from the property line. So I put up a stockade fence. (That's a great story in itself) After a few years I ended up getting a job offer and moved to the country surrounded by a wildlife reservation. My old house was sold to a wonderful young family. The woman was a very sharp young lawyer, and her husband was a police officer. After two attempts at causing trouble for the new family, (and the two law suites against the old neighbors........the old neighbors lost both) my old neighbors, moved away! WIN, WIN!!

I paid to have a tree removed on my property that had NO BEARING or safety issue to MY property but was a major risk to my neighbor. He is a retired marine and his wife died 3 years ago so he is alone and on a fixed income. If anything happened to his property from damage it could ruin him. I paid to remove the tree and wow it’s expensive but worth it. He came over like a couple days later and thanked me profusely. I’ve been that man’s neighbor for 37 years now. Since I was a kid. When my parents retired I bought the house. Let me tell you being on good terms with your neighbors is ESSENTIAL to having a happy life. Don’t be like those assholes because one day you’ll need to count on your neighbor for something and trust me they will remember your actions. That same marine saved my ass when I was 17 and drunk at a party and didn’t know who to call to get home. I called him at 3 am and he picked up and didn’t judge me and got me home safe and sound. Never once told my parents either but he told me as a man I should tell them. He was a role model to me and I’m damn proud to have him as my neighbor. Idk why I felt so inclined to write this but here it is lol

If the tree would of fallen and it was your responsibility you would be liable. They would most likely sue you and home owners insurance would kick in that instance. Bet you any money if his boat was in that danger he would fix it an instant. I hope karma doesn’t bite him in the end.

As a homeowner, if that was my tree and on my property line, I would immediately have it removed for the safety of my neighbor and their property. I would be ashamed and embarrassed otherwise. Shame on him and his snotty wife!

I agree - I would do the same. That said, how does an ethical, moral and good values based neighbor pay Mr.Game of Trees in those tight situations? This is not cheap work and I would loose sleep knowing 5,000lbs of tree will fall on my neighbors garage before figuring out my financial solution. I'm a newbie homeowner.

@@johncollins7044 Here is AZ, if the neighbors tree is hanging over my fence, I can trim to the fence. I have done it to my neighbors oak on one side and my other neighbor has done it to my tree that is hanging over his pool. I have no issues with it either way.

@@GameofTrees the ignorance of angry neighbor once he is on notice of the danger is amazing. Like the good neighbor, I would have mitigated the damage and been reimbursed by angry neighbor or his insurance. My lawyer would of been paid also by them.

I can't believe the dude with the boat can't take ownership of a tree planted on his property. It floors me the level of slimeball trying to get out of paying money to do the right thing.

In the question of "how much can a tree cost?", a formerly wooded lot next to our property was sold for development. The home owner at the front corner of our lot asked to cut down a "crappy tree" on our property, just in from the corner. He wanted it down because it was shading his soon-to-be front yard. We said absolutely not - this is a very old, very valuable tree and would not be touched. Just to be sure, we sent this in writing, by certified letter. He hired a tree company, told them it was his tree and had them remove it while we were out of town. It was a 100+ foot tall, five foot diameter BLACK WALNUT. Likely one of the largest remaining in Ohio. If you just eyeballed it, the tree was something like 11,000 board feet. At something like $5 to $10 a board foot. as in "something like $100,000. And they had LET THE TREE COMPANY HAVE THE TRUNK (because they were idiots). So...we got an emergency order to stop the tree company from selling the log, and sued the property owner. The judge was a country guy and went ballistic when he saw photos of the tree and copies of the letter (with signed receipts). He gave us triple damages at $90,000 valuation ($270,000) plus the tree company had to return the log to us, which we sold for $67,000 (it was actually over 12,000 BF, but the tree company had cut it into shorter logs. If it was in 30' sections it would have been over $100K). The property owners went bankrupt and had to move. so...not exactly common, but "the wrong tree" can cost you a lot.

What state do you live in. I'm in Pa. and we have that triple damage in our laws. I had a woman next door to me that had a chain link fence up and I hated it. I planted a row of arbs along it so I wouldn't have to see it. She came out one day with spray paint and said she was going to paint her fence. She sprayed my arbs also. I went to a lawyer friend of mine and he told me any damages would be tripled automatically. It was nice to hear.

I guess the neighbour figured that once the tree was gone there might be some arguing but not much more. It clearly never entered their mind that the tree might be worth a lot in timber. Surpirised the tree company didn't cut it to maximise value, but they were getting paid twice anyway. Trees like that, the loggers pay you to remove it.

I used to own a house that has a large pine tree that grew right in the middle of the property line and was leaning toward the neighbor's house. I hired people to remove 7 trees on my property after I bought my house. Trying to be a friendly neighbor and because it was on the property line, I offered to remove the tree at my own expense and he told me that he would sue me if it damages his house. The kicker was his house was abandoned due to total damage from a fire. I left the tree alone and a year later, he demolished his house. In the process, he knocked on my door and asked if I wanted to remove the tree and split the expense. I reminded him what he told me and closed the door. Sometimes, people don't have the gratitude for what was offered to them.

Ha! I also offered to pay 50% to cut 3 trees next to my house my neighbor planted 3 feet right next to our bedroom windows on property line. I think it was river birch trees. We lived in a neighborhood where the houses were close to each other. I offered to pay 50%. The roots began growing under my house and out the back yard. We couldn't even barely mow the yard without tripping on them. Then my house started cracking where the roots were growing in the bedroom. Then a limb fell and damaged my roof, not once but twice. She accepted my offer to pay 50%, finally 3 years later.. I was very patient with her. . I offered to find someone to cut the tree and she was adiment that she would do it and that was fine. A man arrived to give her a quote. It was evident they knew each other. . I was sitting on my back porch and he gave her a reasonable offer. Then she told him how terrible her neighbor was (me) and gave a sob story of her financial situation. She asked him to increase the quote and double it and when she got my 50%,it would be the amt of his original quote so she would not have to pay anything.. He agreed. Therefore I would be paying 100% of the bill . When I heard this, I learned how evil and crooked folks could be. She delivered the quote to me, and i told her when they are cut, call me and I will give 50% of his quote to her. When he was through, I gave him 50% of his original quote and told both of them that I heard their entire conversation. They were both in shock and silent. So she was still stuck with her half. Lesson learned. Many people are thieves and crooks..

My neighbors on either side of me had a few big trees leaning over my property that were becoming a hazard. When their arborists showed up you know what I did? I introduced myself, unlocked all my gates, offered them access to my property from both sides, and told them thank you and be safe. No idea how people can be so un-neighborly.

these days people are just assholes, even when walking along side of someone in a store for a few seconds, people just tend to make it awkward when it's really nothing. No one is intentially trying to invade your space, it's just a shared moment in time so there's no need for the long face. I mean we all share these side by side moments all the time everyday. For example we all do it all the time in our vehicles when we are on the freeway. There could be a racist driving along side a thief who is driving along side a sextet who is driving along side an off duty cop who is driving along side a mother driving her children driving along side a man going to work, We all share that same shared space everyday without letting our personal views get in the way of the flow, but as soon as people get out of there vehicles and do the same thing when walking, there's always going to be some asshole who just has to be an asshole. Like I said, in these days People are just assholes, and they are assholes for no real reason but just to be an asshole.

"As a professional Arborist, who has testified as an expert witness in court cases involving tree damage, I can tell you that cutting off this one main trunk is not going to impact the other main trunk structurally at all. So my work here is not going to negatively impact you at all." 2. "Because the trunk that goes into your neighbor's property is crossing his property line, and poses a potential hazard to his property, he has every right to cut off that trunk at his property line." (The fact that the property line goes up into the sky actually works in your client's favor here, not the neighbor's favor.) 3. "Because the tree poses a potential hazard to my client's home, *you* might face liability if we don't cut this tree back, and some might argue it's your responsibility to to do, since it's ultimately your tree, even if he has the right to trim anything crossing his property line. 4. "We're not going to sign anything assuming any liability here, because that wouldn't be appropriate. If you have any issues with your tree later, and want to try to sue me or my client over that, that would certainly be your right. However, I don't believe you'd have any legal basis to prevail on, and you'd therefore just be wasting your money." 5. "I think it would be best for everyone if we cut off the trunk at this specific point, but if you only want me to cut off the portion crossing over my client's property line, that's also fine. I'll then only be working on his side of the property line." 6. "If you want me to cut down your portion of the tree as well, and are willing to pay me for it, I'm also happy to do that. It's just not my or my client's responsibility to do so unless you cover the cost."

Shit like this is so sad. I trimmed a tree and my neighbor came out and encouraged me to trim his side(which I didn't yet out of respect from going on his property). I said I would need to get on his roof, he gave me permission so I did. A week later he knocked on my door and insisted on giving me a $100 bill. I tried to refuse, but he's a stubborn old man and wouldn't let me go inside until I took the money. He's a freaking sweet old man. Nice neighbors are a blessing.

I had a neighbors tree fall on my property. My insurance wanted a deductible. I didn’t want to pay the $500. Brought it to my neighbor. They refused to pay so I brought them to court. I sued for the entire cost of the removal and to repair the fence. Court ordered them to pay because it was their tree. So… in my experience, it’s still your tree even if it falls.

I had a huge Locust tree, and a very large branch came down in a storm crushing my neighbor's fence and damaging my neighbor's roof. The insurance company said it was an "Act of God" and refused to pay my neighbor anything. They never sued me. They rebuilt the fence and the roof themselves.

The tree owner is a perfect example of what society is becoming. No one takes responsibility for their problems, or actions. Stand up and pay the rest of the tab to remove your tree.

Unfortunately alot of us have been in this situation, I have a medium tree about 4 to 5 metres in height, it's an evergreen tibochina, beautiful purple flowers picked from the council list of non offensive species. But still the neighbour hacks at it. If she left it alone it would grow high enough not to be problem. It's not shading anything, their entire yard is concrete. Some people are just plant intolerant.

I can understand the neighbors concern. Recently our neighbor had a tree removed. The removal company asked if they could park the equipment in our yard to avoid their septic system. We agreed as we have been neighbors for 40 years and they are lovely people. The tree company completely ripped up our lawn, bounced a huge limb off our garage causing roof damage and bounced a large branch off our car causing $2500 in damage.

@@kenthomas4668 Depends on the state we went through this a few years ago with a neighboor next door to my mother. Part of the tree had already broken off and damaged her roof. The city arborist had to come and declare the tree a hazzard- the city deemed it need to be removed at the neighbors cost or he would be fined each day it remained standing

Here in the UK, if a tree's root & trunk are on your land & it falls on your neighbour's property, then you are 100% responsible for any damages. Oh & any part of that tree which extends onto a neighbour's property is also the responsibility of the tree owner but it CAN be cut back to the property line & any subsequent issues are solely the responsibility of the tree owner, including said tree's death.

The boat home owner is legally responsible for the removal of that hazardous tree. If the tree had broken in the storm and fell without warning or prior knowledge then that is a different situation. I've been an arborist for 40 plus years, and have been to court on several occasions with people like the boat guy. The court will not rule in boat guys favor because as a property owner, he is responsible for the safety and upkeep of his land, and anything that extends over the property line. Boat guy is a negligent dope and a lousy neighbor.

This is what I honestly can't comprehend - how can one's neighbor's tree that unexpectedly falls on your property (for example in a storm) end up being your own liability? I mean, said tree wasn't ever your property to begin with. Am I just dense, or too tired, I just don't understand. This from someone who just paid them big bucks to have eight dying pine trees along a property line taken down out of caution. Thanks for any insight here!

Some sharp lawyer could donate his services to the non-profit and sue the neighbor on her behalf for the full cost plus legal fees instead of half the cost of the removal as could have been negotiated with reasonable people. I'd love to see that happen.

The boat owner is probably so up to his eyeballs in debt the even though he knows the tree is his liability he can't afford to pay to have it taken down.

The absolute audacity of that neighbor. You’d think he’d be grateful that his neighbor was paying to have a portion of HIS tree removed because it was a liability to HIM. If I were him, I wouldn’t even let my neighbor pay for it, I would. THIS is one reason why my nearest neighbor is 3000’ away from me.

Why would he be grateful? If the neighbor's tree branches overhang your property, you are responsible for those branches. That's the law in most places. The guy who's paying for the branch removal here is the one who's supposed to be paying for it. Duh

This is So Fun! I just got done pruning two big Basswoods and a double stemmed Birr Oak. I've had hundreds of conversations like this. Had a guy call the cops on me. I welcomed him to. After a brief educational moment on arbor culture, I just kept working and in the end, the cops came over to me and said I was doing a good job and to stay safe. Stay safe up there my new friend!

i think the guys concern was genuine. Those trees were connected via the root systen. If one set of roots die, the other will be compromised. As a contractor, I would have walked away from that job, but first try to talk that guy into taking the entire tree down.

He complains about the rest of the tree being a hazard yet parks his boat directly under it. I swear I am so glad to be a country boy living in the country. That way I can stay away from the big cities where life gets complicated. Nothing worse than a difficult, nosey neighbor. If that was any kind of good neighbor, they would split the cost 50/50 and be done with it.

We just won a 2 1/2 year lawsuit with a neighbor whose leaning drive way wall tilted far into her driveway and consequently shifted our concrete steps, sidewalk and dirt away from our home. We live in a cul-de-sac. She refused to the very end to admit there was an issue even tho all damage was evident. We won and her insurance company paid. She also had a tree that threatened our home. When we complained, she would taunt us by trimming her other trees and not the one threatening our home. What a Karen. But once we won lawsuit, had our attorney send letter to her about tree, she caved and was down in one week. Owning a home is a major responsibility and if you are not prepared to Fulfill that responsibility please do us all a favor and rent!

What a nasty neighbor. He’s just trying to get a free tree removal. “I’m just saying” is always the beginning of a debate with a d head.

You were very patient dealing with that guy. Maybe you should have billed him for your time advising him. Even if he was too dumb to listen. :)

When I first moved into my house, I noticed a 70ft oak in the back that had split in the middle. It had heavy branches still on one side that would have taken out my neighbors backyard garage with his Model A and classic car inside...so I immediately trimmend off that branch. A few years later I noticed a woodpecker in the damaged area 35ft up and rented a 50ft boom to trim all the other branches that were a concern to lighten the load. I used to climb and cut, but at 62 I have money. Money is better. The neighbor helped with all the trimming and really appreciated that we were protecting his property. We're friends with the neighbors and they are worth the $500 it cost for the boom rental.

He's clearly trying to end his financial obligations from the boat.

During a bad storm, a tree in our yard fell and went into the roadway. Our street is semi-active, but the storms were so bad it was pretty quiet. We called the city because the power went out and we were afraid that people might hit the tree, not seeing it until it was too late, due to the storm. The city not only got rid of the tree, but were kind enough to come into our yard and remove the stump as well. The tree was badly rotted from the inside. We did offer to pay the city for the work, as we knew the tree was dying and had planned to have a company come in and remove it once the ground was solid enough to get a machine in, the ground was really, really soft from the spring melt, so they sent us a bill. They said don't worry about it, and didn't bill us. Apparently, they take downed branches and wood from downed trees, along with clean yard waste and such, and mulch it, sterilize it, and then use it for city projects. It allows the city to keep the costs down when they're doing landscaping.

I'm a landscaper and I feel your pain. I've had to deal with so many customers neighbors it's not funny. I'm actually currently dealing with a neighbor of my own because I'm putting in a shed and he's trying to put the screws to me by saying that I am putting my shed in the right of way between our properties. I've measured property line to property line done the GPS coordinations and I am exactly 7 in away from the right of way. But just for the sake of being neighborly I moved it over another foot. Some people, I tell you you just can't win for losing with them.

The people who paid to have the tree removed should sue the neighbors for the removal fees.

They could easily win in small claims court. The tree belongs to the neighbor but grows into their yard, creating a hazard. The neighbor is on video complaining about how the arborist can't cut their tree. Smh

I don't think he would win. He did what he was allowed to do which was cut the tree at the property line. You can't make your neighbor cut down an entire tree just because a branch comes over your property line.

@@rogersmith7808 the broken tree was creating an imminent hazard so removal of the tree was needed to prevent any additional damage or injury. Had the tree actually broken down and landed on the garage then the garage owner would have been liable for the damage to their property and removal of the broken tree. In this case I'd bet the arborist donated his time and labor to the non profit and by doing so the boat owner didn't have to pay for the removal. He actually did the boat owner a big favor by not billing him for the removal.

I have a neighbor with an obviously dying tree , it branches across and over my house. but if I remove the limbs over my property line there is still lots of weight that would make it fall my way, on my house. The neighbor is a jerk like the boat owner and wont let me pay to remove it and says it is fine. My arborist that trimmed everything but that tree because he was throwing a fit even about trimming to his property line. My arborist said it is dying and is a hazard and will fall someday. Is this something I could go to the city with and get the tree condemned? Which would make the tree owner responsible for the removal before damages? or if not removed responsible for the damage it causes? Cause I know if it falls on my house it is my damage ,my insurance and possibly my injury.

As a former police officer, I can tell you that the guy was full of it. The police didn't tell him all that hogwash. It's a civil matter and that's more than likely what they told him. I know for sure that cops don't like getting involved in those things because we can be dragged to court on it when we're already in court enough and held to some degree reliable or made out to be the butt if we tell them something inaccurate. We know criminal law not civil unless a civil law directly affects our jobs we're not trained on it.

I would think it is a city/county issue. In our county the inspector would deem it a dangerous tree and the homeowner would be responsible for removing it. If he refuses the county removes it and slaps a lean on the house.

Had two pine trees on my property, they were hanging on my neighbors roof. They asked and I had them removed, because they were a hazard to their roof. The neighborly thing to do, much less the right thing to do.

This nasty guy just didn't want to pay for any of it, even though it's his tree/s. No doubt he's a horrible neighbour. Glad you told this neighbour how it is. Good job :)

I gotta believe these types of neighbor to neighbor tree disputes happen all the time. Happened to me 20 years ago when a new neighbor moved in next door and demanded that I cut the branches from my huge oak tree that were overhanging his lot. I had done my homework on the issue and told him to feel free to trim whatever he wanted from the tree as long as it was over his property line but since the tree was not diseased or otherwise a danger, I was not obligated take care of or pay for the removal of branches hanging over his yard. He has someone come out to trim the branches and told the tree service company that I said it was OK to trim the branches all the way back to the trunk - 10 feet on my side of the property line. I of course disavowed them of that notion and they were aware of the local ordinances and laws and had no problem with it. they dropped a rope from the branch onto the marked property line below and then stayed 6" on the other side of that line on all the branches they trimmed. When the neighbor came home and saw what was (and was NOT) done, he had a fit. Eventually he sued me in small claims court in an attempt to get me to pay for the work. Of course he did not prevail and I pasted the court's verdict on my window facing his kitchen window..

Agreed. As an over-the-road driver on occasion I had to put up with one. Once in Charlotte, NC, I had to back to dock from the street and some entitled woman thought I was going to stop so she could get by when I was a couple of feet from the sidewalk. I acted as if I didn't see her and kept going. She stopped. She only lost maybe 30 seconds.🤷🏼‍♂️ I had another one complain and I just stopped the truck, set the brakes, got out and told them they were welcome to do it for me. They turned around and walked off.

If they own the air space over their house, then that means they can sue any aircraft that flys over it for violating his airspace.

This brings back painful memories plus conversations just like this one! Trying to make sense of NONsense. We finally moved but some people will just not take in common sense, which makes it less common. That neighbor made a trench on our shared property line while my first grandchild was being born. Meanwhile she had no problem stepping over that line whenever she felt like it! Nightmare Neighbor, Thy name is Carol!

With my property I have no issue with a neighbor cutting any branch that encroaches on his property providing if they do they are responsible for removal of anything they trim off....I get pissed off when they dump that shit back over the fence.

@@janesmith5967 Lol, no. I am a retired air traffic controller. The US military owns all US airspace which it delegates to the FAA for the use of commercial, private, and military aircraft. Depending on the area you live, your property line generally extends between 80 to 500 feet in the air. Anything above that you do not own unless there is some exception made, like for tall buildings, etc.

Where i live our laws say if it comes over the fence you can chop it regardless of what happens to the tree. Its the neighbours responsibility to make sure the tree doesnt get to this point.

If his tree is causing an immediate hazard he is responsible for removing that hazard period ! If he doesn't and I'm forced to remove the hazard I would sue him for the cost or tell him to shut the blank up ! What the hell is the matter with people these days ! Take some responsibility people !

I have a lot of experience with this, and while regional laws do vary, in most parts of the country you would not be correct. Yes an owner is absolutely responsible for any part of a tree that that presents an obvious hazard to a neighbor if THAT PART of the tree is present on his own side of the property line. ANY part of a tree however that is present anywhere on the other side of the property line is the sole responsibility of the neighbor. You can take it to court, but in most of the country you would absolutely lose.

I freakin HATE getting involved in those situations. You did a good job.

The disgruntled neighbor feels like someone is touching his property and has no right to do so. He doesn't care how the situation affects anyone else. Really bad and narcissistic neighbor. I have several neighbors just like that too.

I never realize that diplomacy was a required skill for cutting down trees.
