"I DON'T Take Orders From YOU!, SHUT UP and Get Back to Work!" |7 PIGS OWNED| First Amendment Audit

The right to film government officials, including police officers, in the performance of their duties in public spaces is protected under the First Amendment of the United States Constitution. This right is pivotal, not only for the transparency and accountability of law enforcement but also for the broader exercise of press freedom and free speech. The Supreme Court has upheld that freedoms concerning information gathering are an inherent part of free speech rights.
As the auditor begins filming at the police department gate, his actions are protected under the First Amendment, assuming he does not obstruct or interfere with police operations. The officers' initial approach and inquiry if he needed assistance were appropriate, maintaining community policing standards. However, the escalation seemed rooted in a perceived but unverified obstruction.
Statutory laws define obstruction of justice typically as willfully hindering the enforcement of law. In this context, merely standing and filming without physically or verbally interfering with police duties does not constitute legal obstruction. The officers' suggestion that the auditor was blocking access seems unsupported by evidence from the video.
The extended dialogue about public property rights is critical. Public property, like the space outside a police department, is generally considered a public forum where the First Amendment rights are at their strongest. The auditor's rights to film here are supported unless restricted by clearly established and narrowly tailored laws that serve a significant government interest.
The heated debate about filming rights and police jurisdiction highlights a common conflict in First Amendment audits. Officers often challenge auditors out of concern for security or disruption. However, without clear and immediate threats or disruptions, these challenges can appear as attempts to suppress lawful expressions.
Similar incidents have been reviewed in courts, affirming the right to record in public. For instance, in Glik v. Cunniffe, the First Circuit Court of Appeals held that a private citizen has the right to record government officials in a public space. No interference or breach of peace was evident in Glik's actions, akin to the auditor's conduct in Concord.

@@RichardHead23 The SCOTUS has ruled that you can film public buildings. The limitation is if it would actually compromise security or private information or somebody's legal right to use the facility. However, NO ONE has a legal right to expect privacy in public. Anything that can be seen from a public location can be filmed. Please educate yourself. Because what has also been decided in court is that No regulation or rule trumps a law AND, more importantly, no law trumps the Constitution. Regulations and even laws have been over ruled by courts. Neither can be used to trample Constitutional rights. The case you list was controversial, however, it did not give any government body carte blanche authority, as the Court affirmed Florida’s right to enforce its trespass statute against the protesters, so long as it did so in an evenhanded way. The scariest thing about that case is that it is actually part of a trend by some in government to make protesting (especially against the government) harder. Check out Glik v. Cunniffe, 655 F.3d 78 (1st Cir. 2011) A person has the right to film an officer carrying out their duty in a public (government owned) park. Also try reading this article for a balanced interpretation of the rights of all (mrsc.org/stay-informed/mrsc-insight/april-2023/rights-and-limits-on-filming-in-public-facilities) ans/or (www.freedomforum.org/recording-in-public/) Remember, a Federal Judge struck down a Law passed in Arizona, and signed by the Governor for being unconstitutional and therefore unenforceable - it limited getting within 8 feet of police to film them.

They see the videos..... They talk about them. They need to exert their authority over unwitting citizens is so powerful they can't help themselves. Auditors only expose .00001 percent of their behavior. They are so accustomed to just swarming citizens in numbers and the ignorant citizens just fold.... So it normal for cops to intimidate people knowing 1 out of 10,000 will rile against them. They know very well about the videos .... But the average person will just obey without question.

They love to use situations that are not equivalent in order to try and twist things. Your front steps, being private property, can't logically be used to argue about a publicly accessible area of public property. Those contrast each other and are not comparable.

Once again the gaslighting, the mental gymnastics, the twisting of words and the ignorance is on full display. These cops can’t answer a simple question like what law is being broken? This is pure pride, ego and power tripping. Police culture absolutely needs to be reformed. After observing and evaluating police culture, it’s clear that enforcing the law, protecting rights and property is a distant priority. The priority is protecting law enforcement from accountability, gaining compliance from citizens and extracting money from the public with tickets and citations.

Just a bullies who have no respect for others. Do they ever apologize for detaining a person, lying to person, arresting a person without cause? Never. s
