You get a ballot that corresponds with your chosen political party sent to you, but the ones we have here are for people who are either registering to vote for the first time, they moved, or changed their name...." It's never a good idea to anger the judge. Yes, they do have a duty to be as impartial as possible in how they run the trial, but the angrier they get, the harder it is for them to take a charitable view to miststeps. This is what the judge was referencing in terms of credibility as a judge that trusts that they're being given honest answers has the lattitude to relay more on that with less evidence than one that has reason to believe that there's a bunch of lies and BS incoming from just one side. It's a bit like that case where the only evidence was a written document produced at the last minute that was allegedly decades old. It was printed with settings that are normal now, but were impossible at the time and it went from a trial where there basically was no evidence either way beyond the parties to the contract to one of them very clearly being a liar on that detail.

@@if7723 That, or you take the p***. As in the case of Arkell vs. Pressdram. For those who don't know it, the UK satirical magazine Private Eye published allegations that a Mr Pressdram was taking illicit payments. They received the following solicitors' letter: "We act for Mr Arkell who is Retail Credit Manager of Granada TV Rental Ltd. ":His attention has been drawn to an article appearing in the issue of Private Eye dated 9th April 1971 on page 4. The statements made about Mr Arkell are entirely untrue and clearly highly defamatory. "We are therefore instructed to require from you immediately your proposals for dealing with the matter. Mr Arkell's first concern is that there should be a full retraction at the earliest possible date in Private Eye and he will also want his costs paid. His attitude to damages will be governed by the nature of your reply." Private Eye knew it had a rock solid case, so it replied: "We acknowledge your letter of 29th April referring to Mr J. Arkell. "We note that Mr Arkell's attitude to damages will be governed by the nature of our reply and would therefore be grateful if you would inform us what his attitude to damages would be, were he to learn that the nature of our reply is as follows: f*** off." (The original was not censored). Arkell did sue, but after about a year his case fell apart and he was ordered by the court to pay Private Eye's full costs. At which, Private Eye published "Mr Arkell has now, albeit belatedly, complied with the suggestion made to him at an earlier stage in the proceedings." No direct profit in playing it that way, but a lot of publicity and status. And I understand that "I refer you to the reply given in the case of Arkell vs. Pressdram" has become a way for UK lawyers to tell each other to f*** off while *just* staying within professional bounds.

I thought that too, before watching this. As he says, "you never know what juries will do." And Americans seem to have a first-grade level understanding the 1st Amendment (or the 2nd for that matter). They think it means you can literally say anything, which is not true. In my car a couple of weeks ago I heard a caller to a right wing radio show who was furious that the judge at Trump's arraignment had told him to be quiet, "in violation of his 1st Amendment rights." Like a 5-minute rant on how all Americans have "free speech" even in a courtroom, and that the judge was basically being a dictator. (Of course the host agreed with him!) These are our fellow-citizens who make up our juries.
While I am glad that this information came to light, it is deeply depressing to me that the only form of justice we can realistically hope for in the U.S. is that one moneyed interest is offended enough by another moneyed interest to sue.

Who is to say this was a good outcome? Its possible tucker was right if you listen to 2016 democrats. Both sides have constantly talked about this issue overall. But do note the amount fox settled for was worth not taking a risk even regardless of if they were in the right. Remember CNN talked about unsafe voting in 2016 and Steven Colbert did a full episode on those voting machines around the same time saying what tucker said recently but claiming if caused Trump to win. I would argue there is not enough clear info to determine real truth. Both media sides claim the other lies. Any time people are censored in such a way is a crime in my book. But fox is a business and trials are not about truth but perception. The determining factor as to weather fox would win or loose is almost entirely on the political leanings of the jury. So basically a 50 50 chance of losing over a billion dollars. Those are not chances they want to take.

Nice commentary! This really gets into some of the nuts and bolts of this case from a legal perspective.
This channel has taught me something: stupid conspiracy theories always die in the court. The total lack of evidence is just too obvious

Even more than I have loved reading the highlights of these behind-the-scenes communications at Fox lately, I wish I could have been a fly on the wall for Tucker's firing. Have to wonder if it might have been a secret condition of the settlement.

That was the single greatest transition to a sponsored segment I have ever seen Bravo 👏🏼
Have you ever had to remove a potential jury member because they recognized you from Legal Eagle?
The thing I found striking was how, in all of those texts, no one at Fox ever seemed the slightest bit concerned about the truth. Even behind closed doors, I harbored some naïve thought that they were ever the slightest bit concerned, as a news organization, of, you know, the goddamn motherfucking TRUTH.

Nope, the common thread with former hosts of the Faux News Network seems to be that they only want to push particular narratives - either by outright lying, stirring up baseless conspiracies, or reframing viewer’s opinions by leaving out facts.

This video was a rollercoaster of joy. I know we don't get victory most of the time, but I suppose it's as close as we can get to it. Sometimes, seeing legal system in action can be extremely satisfying. Boring, but satisfying.
Imagine having to go through all those years of law school, the sleepless nights, the stress of testing, the amount of note taking and cramming required to get a law degree. Then spending a good amount of your career building up your reputation and doing whatever it takes to get to a high paying job....only to be told you have to watch hours of Fox News clips

To be fair, it's entirely possible that someone who went through all of that hell has a mild masochistic streak. Also, they're getting *paid* to watch Faux News, which is a different story to just being forced to watch it. Honestly, in comparison to digging through hundreds of innocuous personal emails and texts to find nuggets of vital information, watching the stories might be the easy gig.

"if you're waiting for a corporation to save democracy from another corporation you're going to be waiting a long time" I like this, reflects my thoughts on it with everyone being mad about them not "standing up" for justice. It's not a complex lesson but when life offers you a near billion dollar win, you don't double down and bet it all on the bonus spin. Where'd you hear this, "truth" you think you're the keeper of? The truth is there were irregularities in the 2020 election. There's a lot in reality that's the truth that's beyond our ability to prove. It doesn't make those fundamental things any less true though. The quest to seek the truth is never ending.

I'm not surprised they have no problem throwing the truth overboard. After all this is the same company that does not refer to themselves as a "news organization", in their opinion they're An Entertainment Channel. Which they alleged because news have to actually fact check their information and have some semblance of truth, they decided a long time ago they were not doing that. Good to see that come around to bite them Hard.
