My ex went back to his hometown and claimed the children on his taxes when I had them. This mysterious lady from Revenue Canada started harassing me on the phone as she reversed the claim stating that he had the children. I provided documentation 3 times to Revenue Canada proving that the children were in my custody yet they still have not done an adjustment to my taxes. I spoke with a local taxation lawyer and he advised me to cease taking calls from the worker back east (I reside on the west coast) as she had obviously done something illegal. This is going back 10 years now and Revenue Canada has yet to rectify the claim properly. I don't know how government agencies can withhold the money they owe you when a corrupt worker has taken advantage of the situation on someone else's behalf. The most ridiculous thing about this is HR Block was requesting documention of a rental receipt from my landlord, a utility bill in my name in order to prove the children were with me. When I had a Revenue Canada worker on the phone I asked him how these documents proved that the children were residing with me. I told him that I literally could have gone to 10 different neighbors and had them write up affidavits stating this to be true. Would that not be more proof than a hydro bill??? RC needs to seriously revise their requirements as to what information they are collecting as proof. This is utter BS.

Unless everyone all lived in the same household, that’s not how it works. Whoever the child lives with for 6 or more months has the right to claim the child. That’s the irs law. Irs trumps family court.

You know this is a tv show when the judge is going on and on about the history of who had the kids, when that doesn't matter. For tax purposes, outside of a court order, it's all about physical custody. Who had the kids for the most days of the year. Full stop. Child support doesn't come into play when it comes to determining dependents. If a court order says one parent can claim the children on their taxes, then that supersedes the the physical custody portion. Grandma only had the kids for 3 months of the year. If the kids were with their mother the 9 months, then the mother gets to claim the kids, regardless of if custody should have been with the father. Tax law in some situations really isn't that hard. *source - I used to work for the IRS.

As hard as it is to hear about the 10 yr old being sent away, sometimes it is better for the child to be away from the home dynamic. The adults get into patterns of behavior towards the child and get locked into their beliefs about what they expect from the child(good or bad) which locks the child into patterns of behavior that are destructive but gets him what he thinks he wants. By him being outside the home and in a new environment, with adults who do not have a preconceived idea of him and know how to guide him into productive behaviors and how not to react to his destructive behaviors(so he is not inadvertently rewarded), he has a chance to learn and grow in the right direction. Hopefully the adults in his life take that time to learn how to parent him in a more constructive way and learn how to work with him with an open mind. If the adults do not take the time to change themselves, he goes right back into the same dynamic and will revert back to the way he was acting. From a previous post by a cousin it sounds like the young man was adopted into a new home and is doing well.

My son has all custody of his son. The state DCFS showed up at our house and said he’d been placed on a safety plan. Then wouldn’t tell us why. About a week later they came back and let us know his mom had delivered her new baby and it was taken at birth over substances ( she did this with my grandson and had cases pending ) A year later the court said she was completely unfit as she didn’t bother to show up to any court dates or visitation with her son. Guess who claimed on taxes again this year !!!!!!! No flipping court order was made on taxes. Her rights were terminated in October last year , 2022, She claimed him anyway and got her return and we now have a lawyer. She’s claimed him every year and we’ve had him full time for 2 of those years. We never asked her for anything at all. We just begged her to get help and bond with her son. Smh so more lawyer money. It’s outrageous what goes on with taxes for kids. This lady never has had her kids during this time of claiming them . She should go to jail and pay back the money 100%

Years ago when my daughter was born We never allowed the system at the hospital or anywhere to put a number on our daughter Denoting social security voluntary acquiescence and giving the system power over over us and our Daughter. Do any of you out there in the world of the United States understand the contract that you are putting your children under when they are born. ? ? Time for you to start looking into what you are giving and the power you are giving to the state by doing this voluntary contract. Enjoy
