    This is why we need people in congress that will reign in these agencies back to the scope of what they were created to do, and if the agency can no longer effectively do its job within that scope then it should be abolished. If abolishment of an agency happens, then congress can have an open debate to decide if a new agency with a new scope should be created, or if we the people can live without a replacement agency. Government has become too large and these agencies are often so ineffective and inefficient that they are a waste of tax dollars. The whole system of agencies needs an overhaul, and in my opinion we could do well without the majority of them.

    They absolutely have the authority to make rules. Congress created these agencies through the "enumerated powers" identified as "implied powers" through the Supreme Court's decision McColloch vs. Maryland. The freedoms established in the Constitution were gone 200 years ago. Homie we dont live in a free country.

    Historically, it is laziness on the part of Congress. The 18 or so departments within the executive branch has zero power to produce policies that include a statute, such as imprisonment or fines. These should be pushed through Congress. But historically, Congress gives the executive branch this power by basically saying don't bother us with all of this - just put the policy out there and enforce it yourself.

    I am a totally disabled combat veteran. I NEED a pistol brace, not for committing any crime, and not for hunting, which means humping through the woods/hills etc, I'm in a wheelchair. But I do want a pistol for home defense. I wouldn't be able to carry concealed because I WOULD NEED a pistol brace. I have zero criminal record,never even been in handcuffs let alone in any kind of trouble. I just want to protect my family, and THAT WOULD MAKE ME A FELON ??? That ain't right!

    My wife and kids can only effectively aim and shoot AR-15 pistols, not AR-15 carbines. They need help with 16" and longer carbines. 24" rifles are out of the question for home defense for them. Pistol braces made AR-15 personal defense weapons into something useful and practical for our family, and apparently tens of millions of others as well.

    It's coming...and that will only be possible thanks to last years SCOTUS' Bruen decision but the NFA is Unconstitutional and will therefore be thrown out, will become a reality as soon as those "ducks" line up. There's been MANY recent victories of the pro 2nd Amendment position with some BIGGIES coming up any day (much to the chagrin of Governor Astro Glide) involving the state of California's latest Unconstitutional anti gun crusade banning "assault" rifles and ammunition limits and low capacity magazines with the real money betting against the state of California as the pro gun side chalks up yet another victory. Constitutional Carry for the entire country could also be in the works.     From ATF website "ATF makes the gun laws. False: Congress makes federal gun laws; ATF enforces them." They also state "ATF has a national gun registry. False: ATF is strictly prohibited by law from having a national gun registry." 252M records would definitely dispute that. Jan 6 2023 (Reuters) - A U.S. appeals court on Friday struck down a rule the Trump administration had adopted following a 2017 Las Vegas mass shooting that banned "bump stocks," devices that allow people to rapidly fire multiple rounds from semi-automatic guns. In a 13-3 decision, the New Orleans-based 5th U.S. Circuit Court of Appeals said that despite "tremendous" public pressure to impose a ban, it was up to the U.S. Congress rather than the president to take action. If a bump stock that irrefutably makes the weapon more dangerous doesn't hold up under scrutiny of laws the a stabilizing brace that in no way makes the weapon more dangerous should be laughed out of court.

    It was my understanding that the bumpstock ban essentially made the bumpstock in and of itself, without being attached to an actual firearm, as a machine gun. Which is obviously patently absurd. A plastic stock is not a machine gun because it's not a gun at all, not in any way, shape, or form. A gun is a gun, while a piece of plastic is not a gun. That would be like trying to say that a supercharger is a racecar. If democrats would actually enforce the law and provide consequences to violent criminals instead of releasing and refusing to prosecute them, we'd be much better off. If democrats would support our fundamental American values and principles in any way instead of trying to take from law abiding liberty loving patriotic Americans, we'd be much better off. If democrats would simply honor their oath and duty that so many have sacrificed and given their lives for, we'd be much better off. Though democrats have been on the wrong side of morality and America itself since before the republican party was founded to combat their horrific bigotry and racism. Democrats have always preferred censorship, confiscation, bigotry, violence, and opposed virtually all of our fundamental American values and principles for well over a century and they still refuse to join polite society. If someone were to make a list of all the most horrific immoral unAmerican ideas and behaviors you could think of, that list would mirror the policy prescriptions of democrats.

    @@terrygrant9140 I certainly appreciate your expression of the court's rebuke of this issue. I suppose I was just speaking to the spirit of the ideas that some individuals push in direct opposition to our founding ideals, or lack of spirit like displayed in this push to infringe. I do find the specifics of these things interesting though, so thank you. I thought I saw the legal wording of this issue somewhere on ATF literature that basically classified the individual bumpstocks as machine guns in and of themselves, though I'm not claiming with absolute certainty to be correct. I think with things like this that the attempted justification and pathway of infringements is important to learn, as is the method and course of rebuke.

    @@trentjacobs3957 I get it. Only one right Staes "shall not be infringed" and yet we have 20K Gun Laws and two entire Congressional Acts that do just that. I served 26 years and I am a firm 2A man. I do however agree with some of the limitations. I mean I don't want anyone having heavy artillery or grenades. I grudgingly agree with auto weapons. I think the SBR registration is bogus. US v Miller affirmed SBR tax stamp requirements in the 1934 NFA albeit for a shotgun. Heller however took from Miller "common use" which makes this stabilizer ban interesting. If as they state there are up to 40M that require SBR stamps that would make them common use. Would be interesting to see someone bring that case if they can't overturn this rule. I can't see it holding up. Simply put only Congress can make laws not the ATF. I have a DDM4 PDW with a EOTECH 300BLK and a Silencer Co Omega 300 can and I pissed beyond words I have to convert it. Bad enough I had to tax stamp a can. As it stands it is the law can't just ignore it because I don't agree. Too old to do 10 years LOL.

    Organized crime was trying to protect the banks on the tail end of Prohibition, going into the Depression, where guys like Dillinger and Bonnie & Clyde were robbing them to make their living. Big gangsters didn't like little wannabe gangsters robbing their accounts, and didn't want people to be able to defend themselves from racketeering. This is really why the NFA was proposed. They discussed it throughout the NFA hearings in 1934.

    Yet this happens over and over again in agencies throughout the government. It's ridiculous, but Congress gave agencies that authority. I haven't checked, but search for the original law that created ATF and see how many pages it took to provide their roles and duties. Then see how large that book is now. Do that for every government agency and you begin to understand the problem of unelected officials running this country.

    The real hazard to firearms is that the American people as a whole have become less responsible and less caring. There was a time where shooting arcades were in every city in the nation with little or no problem. Firearms are inanimate and have no part in the decision to do the wrong thing with a firearm. We as a nation have deteriorated morally, spiritually and ethically and there is no plan to change that. That is the crux of the problem and it is why this nation will ultimately fail unless it is changed.

    There is NO WAY that the ATF will be able to Process 10 million Pistol Brace applications in the 88 days it allotted before it becomes a Felony if you don't have your Tax Stamp

    It would only be a felony if you view it as such. Last time I checked, the agency doesn't have the authority to create laws, therefore a law isn't being broken...until they, or another accompanying agency show up at your residence without authority. The ATF employees obviously never watched conjunction junction about how laws are made in our country. Better yet, maybe they should read the second amendment at face value, which is the way it is intended to be interpreted. And if they don't like that, then they can lobby to have congress amend it to their fitting...and good luck with that. Until then, f*k 'em.

    @@blazerchris5444 the law is the National Firearms Act and it was passed in the 20’s to try and disarm the American public after the mob started to rise to power. The ATF doesn’t write laws, they interpret them, and this whole pistol brace thing is just them “reinterpreting” the law to add things that 10 years ago they said were totally fine. They have the power to do this outrageous stuff because no one has questioned them or tried to stop them before. They will still arrest people using SWAT teams, some people will be killed by the SWAT teams, some people will still sit in jail for months or years, some people will still lose their jobs and go bankrupt defending themselves against this non law. It may easily take years for the courts to find the rule unconstitutional, which means the prosecutions will continue for years. Not a single member of the ATF or the administration will be penalized in any way whatsoever. They don't care.

    Exactly. And if anyone was to get sent to court over this, it's easily beatable, just ask the prosecution site the law that's being violated for owning a pistol brace, if they start citing ATF regulation then appeal.

    Okay mr. Wilcox, I hear what you're saying about The ATF regulating as technology changes, what I don't get is why you think it's OK for them to flip flop on a rule. Once they've made it. My mom said I have to eat my dinner before I can have dessert; she didn't say that on Monday and Tuesday and Wednesday then change it for Thursday and change it back on Friday. The rules were the rules I was given to live by. No matter how many times the ATF changes the rules criminals are still going to be criminals and they're still going to get their hands on weapons they shouldn't have, that's not going to change no matter what the rule is; so as long as the rest of us are obeying the rules, why in the world should we begin 😅required to keep checking in with mom and dad to see which way they're leaning today on the rules for the weapons they permitted us to build last week, last month, or last year? WHEN is the ATF going to spend EVEN HALF AS MUCH time, effort, and money protecting LAW ABIDING CITIZENS - half assed at best - as they do "regulating us as technology progresses" to the point that WE have become prisoners of the state who either cannot defend ourselves as we see the need or become ACTUAL CRIMINALS ourselves while doing so?? I direct your attention to the "Fast and Furious" op which you should ALL still be too embarrased to show your faces in public over frankly, much less tell us we cannot use what the ATF GAVE AWAY TO THE CARTELL!! Did Congress include that in the passage of the law 90 years ago? Did that law dictate that you treat us like criminals while advising the criminals of all the rights that they have that appear to supersede our rights? I'll answer for you, It did not; and you want to know why? Because they didn't know this would be an issue, because they didn't forsee the invention of this product Any more than they foresaw the creation of the ATF. They thought future legislators might use some common sense [ Which we oftentimes don't appear to posess (( What were you guys thinking founding the ATF anyway?)) ] in these matters I'm sure. ALSO, I would direct everyone's attention to the KNOWN ISSUE of ATF agents picking and choosing and taking weapons for themselves on the way to be destroyed or wherever. A citizens don't get to do that either; as a matter of fact, we're sick and tired of you guys taking our weapons even after you have figured out we're not who and they're not what you're looking for; WHEN YOU KNOW DAMN WELL YOU SHOULDN'T take or keep them.

It's why local elections, contrary to what most think, is actually more important than the state or presidential elections to your everyday life.

    If you file with atf for brace you have 90 days to do so but the application is expired 80 days from filling date which means they will have your record plus you will be denied

    I moved to Fl 11 years ago from the People’s Republic of California. I feel so blessed to be free after living under the tyrannical government of Cali for 52 years. I’ve lived in Mr. Donald’s district since moving here but didn’t have a Representative that truly knew what they were supposed to go to Washington for until Byron Donalds got elected 3 years ago. I feel so blessed to have him as my Rep. it is my hope that when Gov Desantis wins the White House in 2024, that Byron Donalds becomes the next Governor of Florida. I just hope that my district will elect a Rep that is half as good as him.
