How can the picture ID be required by law to show to a cop? I wasn't driving anywhere. This isn't a traffic stop. If there was a driving infraction, then I would want to prove that I have a valid drivers license.
Also, I did not give the cop permission to delete this video, which he did. However, he forgot to delete it from the recovery file. It needs to be deleted twice, which he didn't do and that allowed me to upload this video.

    My "police videos" are focused here now. I have separated the themes because the "cop videos" are far more popular than anything else I have uploaded onto the other "main channel". I don't like dealing with the cops, but my lifestyle makes run-ins happen every so often. You are interesting. Do you have any other channels where you upload different content? For example, some KZreadrs will make a channel just for "video games." I keep 4 different channels just for the fun of it. Thank you.

    I had a similar experience in Horse Bend back in 2007. I was arrested for smoking a cigarette in the parking lot behind the library. It was later dismissed in court but I still spent time behind bars without cause. The police are corrupt in Horse Shoe Bend or incompetent. Take your pick.

    You take a mortal man, and put him in control, watch him become a God, the peoples heads will roll. Never ceases to amaze me how police will act like bullies towards those they identify as destitute or downtrodden. Confident that these kind of people won’t have the resources to defend themselves they are willing to bully and trample on their rights with full confidence.     I agree. Every time I've seen a video or witnessed, in person, a "peace officer" utter those intent to escalate words, the "peace officer " escalates. Their job is ALWAYS to deescalate.     I have lived in my car for over 10 years and had odd jobs all over the country. It's only illegal it live on your car in a few states. The cops in those states don't even care if you live in your vehicle because it's still better then living under a bridge.

    deleting the video was wrong, and probably done out of anger, but it could have easily been used as evidence in court. it probably was and it probably benefitted the officer. arrestee was loitering and obstructing when he refused to provide identification.

    The first problem I have is why did this cop open his door. #2 this guy answered way too many questions. #3 this cop thinks his badge means that everyone must answer to him.     I love the fearlessness and assertiveness. Travis was NOT required to show ID because there is NO reasonable suspicion of committing a crime. Cops just love to create "criminals." The prosecutor dropped the charges when Travis' public defender wrote a convincing motion to suppress evidence based on this illegal detention and false arrest over NOTHING. Josh McIntosh lied in his report, and tried to delete this video. He is a liar and a criminal who should have been prosecuted for this false arrest and the illegal attempt to delete this recording. I hope that Travis sues this corrupt police department before the statute of limitations expires.

    Did the cop say anything about loitering? What is the definition of loitering? Can you take a break from the library in your car to eat or take a nap? Is that illegal or "suspicious?" I, along with many others, have taken naps *in* public libraries. Is that loitering? In another video, Travis was taking a lunch break from the library in his car when the cops came to harass him. Travis uses *public* libraries for internet access, to read, and to hang out, you know, what libraries are made for. When is that loitering? Is it OK to spend the whole day at the library, or is that "loitering?" What if you spend a 2nd day at the library, is that "loitering?" Travis was not charged with loitering. As I stated above, the prosecutor dropped the charges after being confronted with the defense's motion regarding this illegal detention and false arrest. He paid attention to the judge's comments in a pre-trial meeting. If Travis were loitering don't you think that he would have been charged with loitering, and that the prosecutor would have used that as legal grounds for the detention and demand for ID?

    loitering is a mis-demeanor not a crime, if it were a crime it would have been criminal trespass but they have to shoot through hoops to do that since the owner of the property/business must 1st ask them to leave and the cop must ask them to leave. once the cop has asked if it is refused THEN its criminal trespass. really hop he is suing the cop for everything he can...

    @Jena King I'm not even from the USA and i know you do not have to show your ID if you haven't committed a crime. He didn't obstruct anything, he was just exercising his rights. You can argue that it's simple to just give him your ID, but it's his choice if he hasn't done anything wrong. It's also simple for the cop to just state why he's there talking to him and follow proper procedure, the cop didn't need his ID and was just fishing. If the cop's there because he thinks it's suspicious that he's been there for 2 days, he can investigate all he wants without violating his rights. Suspicion however is not crime, so again, no ID required.

    Qruns El those truck drivers have a sleeping compartment in their vehicle. They are also required by law to sleep a certain number of hours per day, and don't park in places that would be considered irregular. Most of the time they find truck stops or a rest area. Not a library parking lot where they've st up their own homeless shelter so they can use the free library wifi from their car.

    I'm starting to doubt he even tried to erase the video. he never asked for the camera the entire time and the video could've been easily used for evidence. if he had deleted the video that would have made the officer incredibly guilty, but you don't see the original poster commenting on any other comments with legal advice. it's also important to remember that what the poster was doing was illegal. he's loitering and when he refused to provide identification he was obstructing. those are very real crimes. the officer does not have to show id by any law, and by doing so would be playing along with a possible criminals obstructing and delaying. they are taught not to do that because it makes the criminal feel in control. the original poster was mocking the officer when he asked for id. if you were an officer on call and someone told you to do an Irish jig before they'd show their id you'd be pissed. that last part was just me providing some point of view. what original poster was doing is incredibly disrespectful.

    Travis, I've watched several of your vids and really like the way you handle yourself. You are always low key and polite and most importantly ... not hostile. What I can't believe is how in the United States of America someone can go from sitting in one's car to being forced to surrender i.d. under threat of arrest. Further more, being hand cuffed, in the back of a squad car while watching your vehicle being towed followed by a few days in jail.. but that's what those who want a police state like, it's what they get off on. All without a crime being commited.......

    stonefly69 well someone said earlier that the cop saw him sitting there two days. If he was not driving or with the engine running then a cop could say I am investigating because I saw you at the same spot two days ago. I disagree with what the cop did but a cop could use many excuses to suspect you of a crime. It is really hard to tell in this case because you can see all of the surrounding. Case in point just this happen to me I was traveling on 95 freeway in Virginia last month I decided to pull over on the side of the highway to text. As I was texting a cop knocks on my window to ask me if I needed any assistance I told her no thank you mine you my car engine was off The cop ask me where was I going I told her I just driving then she ask me for I’d and I said why you need my iID and she states because you are violating the law by sitting on the side of the road. I did not believe her and made her look that law up and provide to me. After she did that I provided her my ID I had never heard of such law. This was in VA. I live in Maryland and you can pull off on the side of the road to text. Now I was just sitting in my car with my engine off and I had to provide I’d People just need to be careful and understand the situation they are in. Appears by va law I was committing a crime.

A Terry stop is defined as “a brief, temporary involuntary detention of a person suspected of being involved in criminal activity for the purpose of investigating the potential criminal violation. In order to lawfully conduct a Terry stop, a law enforcement officer must have “reasonable suspicion,” which has been defined as “articulable facts that would lead a reasonable officer to conclude that criminal activity is afoot. More than an unsupported hunch but less than probable cause and even less than a preponderance of the evidence.”

    +PostSurgeOperative You forget that Terry requires "Reasonable Articulable Suspicion" (RAS) that the suspect has, is, or is about to commit a SPECIFIC CRIME and that RAS must be particularized to the individual being detained against their will. This cop NEVER articulates any crime he suspects the subject of committing. He REQUESTS ID but doesn't demand it (verbal judo that they are taught in police training). He oversteps his authority when he arrests the suspect for not providing a physical ID when doing so is NOT required IN ANY STATE except when exercising a licensed privilege. Had the suspect been OPERATING the vehicle AND committed a traffic infraction (or some other violation in operating the vehicle) there would be a legal requirement to provide a physical license. THAT IS NOT present here. The cop got pissed because the subject knew his rights and didn't want to play the game. It's called "contempt of cop" and is NOT a violation of the law.

    Yes. In Naziland, Idaho. Boy, are you stupid. Juries always want to pay itinerant bums their municipal $$$. This case would never get to a jury, but get thrown out for any reason the judge could invent. Thus, a lawyer would never take it.

    The Idaho "obstruction" statue is so vague that I could see a judge ruling against anyone for anything. It says, "Every person who wilfully resists, delays or obstructs any public officer, in the discharge, or attempt to discharge, of any duty of his office..." All an LEO has to do is argue they were performing their official duty - the statute doesn't even say that the duty has to be lawful - when you "obstructed" them. Travis could theoretically be found guilty of this, even though demanding photo identification without probable cause is clearly illegal. A uniformed officer could demand $20 from you and you could be arrested for obstruction if you refuse - because he could say it was needed for official business.
