I am losing count how many times a gun has been pulled on me. They are adding up. The statistics of probability are working against me that one will be fired.
An anonymous caller reported my car for being parked in the parking lot of the City Square (public parking). At about 5:30pm, when I was eating a bowl of cereal, a Sheriff Deputy pulled next to my car and started demanding my name. They had to identify me.
This is a town where they closed their police station down and rely on the Sheriff Dept to do their law enforcement.
I am so tired of these anonymous callers giving the cops permission to harass me. This process of vetting isn't right.
The caller complainer needs to take some responsibility for themselves and be fully identified when they make a stupid complaint!

    He didn't shoot though... This guy was not answering questions and was acting suspiciously. The cop doesn't know if the guy has a bomb or a gun, the cop is just doing what he was trained to do. Just because this guy knows he doesn't have anything doesn't mean shit to the cops. For all the cop knows there's a bomb in there and it'll go off any second. I'm surprised how well the cop kept his cool through this process. This guy was just asking to be a target.

    In order to be detained you must be suspected of a crime, which in this case was cited as "failure to identify". Yet you only need to provide ID if you are being detained for a crime, which he wasn't when he was asked for ID. But in order to be detained in the first place there needs to be suspicion of a crime. He never had that initial suspicion of crime and had no right to detain. Just looking suspicious is not grounds for detainment, and therefore he has no legal obligation to present ID. Obviously the cop is in the wrong, and more than likely it didn't matter.

    It's impossible to know beyond a reasonable doubt that was going on the LEO head at the moment of encounter. We can't say that the LEO didn't have reasonable suspicion because we were not there, we don't have all the facts surrounding the situation....

    I looked up the law You only have to identify if you are lawfully stopped in a public place under Utah code 77-7-15. Which states the officer has to have reasonable suspicion that the person is committing a crime

    Cop lied which isn't surprising. "In order to trigger the requirements of Utah Code 76-8-301.5, a police officer must first meet the requirements of Utah Code 77-7-15. This section of the Utah criminal code provides that a police officer may stop or detain a person in a public place if the officer has reasonable suspicion to believe that the person has committed a crime, or is currently in the act of or attempting to committing a crime. This law then provides that the officer may then "demand" the person's name, address, and "an explanation of his actions."

    Don't sue the department. They are funded by stolen tax dollars. Instead, please go to the nearest federal court and file an Oath of Office violation. If you win an Oath of Office violation it does two things, 1. the officer has to pay, (not the police department), a fine for every violation he or she committed and 2. he or she can never be a public officer again on U.S. soil, (banned as a cop for life). Next, go to the nearest state court and file an Oath of Office violation. If you win an Oath of Office violation again it also does two things, 1. the officer has to pay, (not the police department), a fine for every violation he or she committed and 2. he or she can never be a public officer again on state soil, (banned as a cop for life). Finally, file a claim against the insurance bond, (that the police officer or law enforcement officer has to carry by law), for damages. This will cause the insurance company to charge more to have a bond against each officer, thus providing an incentive for the police department to actually fire bad officers instead of putting them on paid vacation or doing nothing at all.

    In order for "Failure to ID" to be a crime, you must first be obligated to ID due to reasonable articulable suspicion of a past, present or future crime. Failure to ID cannot be the compelling reason for the detainment in the first place.

    At first I thought this was a violation of the Stop and identify law in the state of Utah. Upon further review..... right at the start of this video the man says "am I being detained"... the officer says "no, I'm just talking to you, trying to find out who you are." Even under the authoritarian Utah law, the officer shot himself in the foot by saying no..     That was a scary shakedown! Utah's stop & ID law (77-7-15) doesn't authorize police to detain an individual without a particular offence, so that was a fat lie. Even if they though you might have committed an offence, then all they could lawfully demand, at most, would have been your name, address & an explanation of your actions. But drawing his gun on you was way over the line.

    Because if you are a criminal, your driver's license says "CRIMINAL" on it in big red letters. Seriously though, they are fishing for a warrant because under Utah vs. Strieff, it can be used to turn an unlawful detention into a lawful one after the fact. Even if the warrant is for an unpaid parking ticket in another state. Thanks, Supreme Court!

    They know the law but left out the part about " when the officer has a reasonable suspicion to believe the individual has committed or is in the act of committing or is attempting to commit a public offense..." No crime was reported because there simply wasn't any.

    Failure to identify when no reasonable suspicion that a crime has, is or is about to be committed is not a crime in Utah. The police are lying. Utah code 77-7-15: Effective 5/8/2018 77-7-15. Authority of peace officer to stop and question suspect -- Grounds. A peace officer may stop any person in a public place when the officer has a reasonable suspicion to believe the person has committed or is in the act of committing or is attempting to commit a public offense and may demand the person's name, address, and an explanation of the person's actions. The text before being amended read: The words (he) and (his)was struck and replaced. 7244 Section 85. Section 77-7-15 is amended to read: 7245 77-7-15. Authority of peace officer to stop and question suspect -- Grounds. 7246 A peace officer may stop any person in a public place when [he] the officer has a 7247 reasonable suspicion to believe [he] the person has committed or is in the act of committing or 7248 is attempting to commit a public offense and may demand [his] the person's name, address, and 7249 an explanation of [his] the person's actions. It still said the same thing, (reasonable suspicion of a crime) prior to anything else. You can't legally be charged with not identifying, when no other crime has been committed. You can't put the cart before the horse.

    It’s a stop and Id state only if you’re suspected of committing a crime or have already committed a crime, or suspect a crime is about to be committed. They couldn’t articulate a crime being committed other than not providing papers which isn’t a law he can break unless he had already broken the law. We have freedom of movement and when the officer says the man videoing is detained for not identifying himself, the officer is infringing on that mans rights due to the fact he has not committed a crime. You even hear the officer assume that the man videoing has a warrant which isn’t the case, aka profiling. You also notice the first time he asks the officer if he was being detained he says “no were just having a conversation” but then decides to make up laws and changes his mind. I’ve had the fortune of being stopped only for traffic violations and always had a cordial experience with most the officers I’ve dealt with, but the day that I start to get asked for “my papers” as if I were in nazi Germany then we’ve got a problem. Be informed and be knowledgeable. We as a people have given police too much power and they abuse it, but they can’t if you understand the law.

    Not only are cops trained to lie in the US they're also trained to escalate a situation until they gain compliance. Notice how the encounter started off with a vague "just seeing if everything's okay" and "you're not being detained" to "you're being detained for failure to ID" and then again when the weapon is pulled on him and pointed directly at his chest (a killshot) when he tries to get his picture ID.

    Ian Battles this is absolutely true. I find it to be ABSOLUTELY fucked up however though. because they can lie to get information to arrest citizens but then they're viewed as being credible and are supposed to "tell the truth" under oath in court. It's such a fucked up system.

A call of a suspicious person by a citizen is not reasonable suspicion by itself. This clown just starts asking questions and demands ID. What happened to simply asking questions and using those answers to build a reasonable suspicion or better yet a probable cause case to charge him. Being threatened jail time when they can't do it is bullshit all day long. Terry vs Ohio doesn't apply unless he see's activity concurrent with probable cause that he has or is about to commit a crime. God, these guys are poorly trained.
