It's a display of authority. They do it just to show you they can force you to do it. They really can't, not legally, it would require RAS that you're armed/dangerous, but are you going to risk getting arrested to prove that point? Or shot. Especially when you know cops will just lie about it; "I observed a bulge under his shirt", "he made furtive movements", "he moved unusually slowly", "he was unnaturally still".. anything will do to justify officer cowardice after the fact.

Except he had no reason to issue him a ticket which is why he didn't. I for one am not willing to silently take a ticket that will cost me expenses in court fees and a lawyer to defend myself if I did nothing wrong. That said, if I have video proof of my innocence, I am probably going to wait until court to argue. Cops can ruin people financially just by issuing citations or arresting them, even if the person is later found innocent.

It would have to meet that combination in order for that order to be legal. You do NOT have to get out of the car unless both have been met, and qualified immunity will not cover them unless both are met. You absolutely do NOT have to do just whatever a cop tells you to do, this is not a fascist police state as they would have you to believe. However, the onus is on you to know better, and to assert your rights

Everytime you hold up an officer like this, a donut somewhere lives a bit longer. Know your rights, and always record. Cops prove time and time again why it's so easy to hate them.

So we begin with orders to get out of the car, which he refuses. A short time later he decides to get out, and what is the command? "Stay in the car!" If you're in, they want you out. If you're getting out, they want you IN. They just want to control people, and it's all supposed to be about officer safety. OK, which is safer? In or out? Both within minutes? Whatever the "subject" _hasn't chosen?_ Yes, that's the ticket!

There was no real reason for the stop- it’s a fishing expedition

The only reason they wanted him out of the car was to give them a reason to man handle him yanking him out of the car as a show of power, because later when he voluntarily started to get out of the car they told him to get back in as another show of power.

The correctional officer should have never opened his door to come out of the car. He should have waited for the cops to come back and then ask for a supervisor. Missouri important to use wisdom.

Officer safety… If they are actually concerned about safety (like if the driver is obviously aggressive and huge) the proper action is to step away and call for backup. “Stay in the car for my safety, no wait get out of the car for my safety”!

When I was with kern county I never had a corrections officer (most who worked in Tehachapi) ever show any kind of disrespect. Dude is going to do that to the wrong inmate and wind up a prison floor mop. I know several corrections officers in California and they are terrified of how the state has let the inmates run out of control.
