Cops tracked him to his house over a tailpipe, but it didn't end there | PAR

Bellingham, WA resident, Andrew S., was surprised to experience a traffic stop while parked in his own driveway. The encounter with local police only became more bizarre as the officers changed their rationale for stopping and questioning Andrew multiple times. From claims that there were problems with his tailpipe to accusations that he had been doing donuts down the street, Bellingham police attempted multiple approaches to catch Andrew in a bind. Police Accountability Report goes through the cell phone video of the encounter provided by Andrew, which provides insight into how police can violate our civil rights under the mask of a pleasant demeanor and "innocent" questions.

    No such thing as "reasonable suspicion" at law. The law requires probable cause. Probable cause requires articulated evidence . Why are you people not demanding their enforcers of crime to adhere to the law?

    That is a fair point. Normally, I watch encounters where the officer is aggressive physically and verbally but this stood out to me, because even though the officer was polite... it could be considered a "fishing expedition."     Pulling them out of his Heineken. I've had cops do the same to me years ago, and I didn't know there was a way to fight back. Of course, we didn't all have phones with cameras in them back then either. I wouldn't have had proof. And even though judges are _supposed_ to be impartial, we all know that the judges and the cops and the ADAs all get paid by the same corrupt system. To say they're in cahoots would be an understatement.

    The cop is trying to cover his ass for clearly violating the young man's rights. There were witnesses to the officer's harrassment. They were hoping to catch him dirty somehow. All of it will be thrown out in court, because it's no way that charge would stand without the Cop actually seeing it. He knows that the Department would be sued without charges and still could be if they don't hold up in court. Classic case of driving while Black!

    As soon as the lights come on your under arrest. It's called a custodial arrest and the arresting officer is required to marandise the arrested. Then just invoke your right to remain silent until your attorney or counsel is present. This is the questions everyone should ask , then envkoke the right , then shut up !!!

    Been there and done that. A cop followed me 2 miles, all the way to my house, a quarter of a mile off the highway. I was out of my truck and unlocking my front door when he pulled up in my driveway and initiated his strobes. First he said I was speeding, then it was failure to maintain one lane of traffic, he ended with a no seat belt ticket. I'm believing he was simply bored and I was available entertainment.

I turned to stephen and said, "If I was the officer, I would have left the other cop by Andrew's car, ran the plates, ran the address and then returned to the gentlemen." there were so many other ways to approach this.     As soon as the cop said " just let me run your name and see if you have any warrants " tells it all . Too many officers think a call or suspicion is enough to make the detain and demand for ID so they can run their subject for warrants and it makes for an easy arrest and keeps them looking like they are properly policing when they are acting with no RAS or PC and are showing no restraint for constutional rights ! It leads to unresonable searches and any decent lawyer will have all charges dropped and any other charges are fruit of the poisonous tree ! Also in most police departments it is in department policy for an officer to dispatch a superior officer upon request by a subject in most departments !

    I’ve literally had this happen to me in my 20s for an unpaid ticket and I spent the night in jail and then I never didn’t pay a ticket immediately when I got one and I was also very careful about not getting tickets after that what if the warrant was for like a DY or vehicular manslaughter, look at the stats driving is very dangerous. It Hass to be taken seriously if you got a problem with cops and don’t get in your car walk to the store.

    @@ronaldsummerlin9772 I just remembered that I was driving back to Austin, Texas on I 10 coming over the bridge in Baton Rouge and some truck had had a small ladder fall off it that was sitting perpendicular in the middle of the road and I just barely missed it, and that thing would’ve surely given my little car a flator even maybe punctured the oil pan cars are extremely serious it’s what kills most people after natural causes and exhaust keep cancer, causing chemicals like low level ozone from being in the air that stuff can give kids asthma and stuff so if you’re driving a bucket and it ain’t safe that everybody else on the road is the victim

    When does this become harassment? In the UK if you're wrongfully pulled over on three occasions without a valid reason that becomes harassment and is a criminal offence. A colleague was pulled over on three successive days on his commute to work and breathalysed. On speaking to his lawyer he was advised to state this is the fourth time you are attempting to breathalyse me, three times constitutes harassment. The officer backed down and there were no more stops. Harassment in the UK is a criminal offence and would put the officer out of a job.

    Bellingham and Whatcom County have a history of all things authoritarian..... The Lummi Nation will not allow the Sheriff and City of Bellingham, in any capacity, on their land, due to years of abusive interaction. They must submit a request for approval prior to arrival and have legitimate reason to visit: business. It's insane up there.

    @@CrazyBear65 Yeah, the 28 Washington Tribes, like many nations, have quite a history. I'm not native. I worked several projects and heard many stories of their past and present fights. Most tribes have opened cultural/historical centers and many have opened casinos as well as other commercial ventures: Puyallup, Squamish, Lummi, Tulalip, Yakima and Kalispell, are the big guns of self-sufficient nations. It's worth your time to pay them a visit.

    One reason why we are seeing so many of these insane arrests is bc the current Attorney General, Merritt Garland... has created dozens of police grants which stipulate that in order for the police to receive the allotted cash... they must make a specific number of arrests every week, (drunk driving grant is for the number of DUI arrests, Traffic grants are for the # of traffic arrests, etc). There are literally dozens of these and one of the highest paying grants is the 'anti-police grant... which is why we are seeing so many obstruction and resisting arrests but literally every type of arrest is now financially rewarded by the DOJ. It does not matter if the charges are dropped, even w/in hours... as long as the arrest was made. They must be gathering a data base to see which citizens do not simply obey... who knows. But this is why these cops are so insane now, they have huge financial incentives to arrest people.

    My mom got a call that I, her son was doing donuts in the community park gravel area. I was sitting next to her the whole afternoon. Pissed her off and she jumped her car went to park and donuts . They called about me and I said how can I be there and answer the phone here. HA ha ha

    I think most departments have a policy that when a citizen requests a supervisor that they have to provide one on scene. I think we should ALL make it our policy to record police and request a Supervisor for each interaction so that if they violate your rights it will show a practice of abuse and a culture supporting that abuse when a supervisor is present. This combined with video footage will help you in court.

    @@MicheleHow777 I would be glad to chat with ANYONE if you’d like re: definition of DISABLED, discrimination and noncompliance with the Civil Rights Act and the parallel Statutes. Sadly a majority of AmeriCANs don’t know their human (civil) rights. Even less know that there are other special separate protections and rights GRANTED under the Fair Housing, Americans With Disabilities, Rehabilitation, and Civil Rights Acts. The definition of disabled is VERY BROAD and to be interpreted to the GREATEST EXTENT POSSIBLE TO MAXIMIZE COVERAGE consequently there are MANY people that likely are DISABLED under the Acts and have protections afforded to them. It is imperative to understand this and to share this with as many people as we can. Persons with disabilities not only share the same civil rights as everyone else, they/we are also entitled to PREFERENTIAL treatment to ADJUST for or accommodate the (the practical) limitations and/or disabilities. This is known as an accommodation, modification and/or exemption. Anyone may request an accommodation for someone else, including an agency, like Disability Rights Florida etc. There are also several private housing agencies that investigated allegations of housing discrimination. They use TESTERS. That’s kind of what we all are as “auditors”. Another important item is that ANYONE can report of file a grievance with a government entity and/or the appropriate Federal Agency; the DOJ, the EEOC, and/or HUD. You can also report issues to various State Commissions like the Florida Commission on Human Relations or private housing agencies. You don’t have to be disabled to do so. The grievance can be for one of two things: 1) noncompliance; and/or discrimination. The former is for noncompliance with Federal, State or local anti discrimination laws, the latter for discrimination against you or someone you know. Another very important fact that most people let alone government agencies don’t know, and frankly loathe, is the concept of associative discrimination. If you, I, or someone associates with or has a relationship with someone with a disability, BOTH groups of people are protected under the Acts. REREAD THAT EVERYONE!! It’s important to note that there are many “types” of disabilities and NOT just physical disabilities. Invisible or mental disabilities are OFTEN overlooked including in court settings. Court personnel including jury services, clerk staff and court staff including JUDGES rarely know the laws. Invisible disabilities must be accommodated in PARITY with physical disabilities and MUST be done privately. The Acts even REQUIRE private corporations and public entities to VIOLATE STATE STATUTES TO COMPORT WITH FEDERAL STATUTES; the FHA, ADA, RA & the CRA. READ THAT AGAIN!! They CANNOT use (the existence of and/or compliance with) state statutes as a valid justification for noncompliance with Federal Statutes. So, if a state statute of local policy, for example, states that any request for accommodation must be requested 48 hours in advance, such policy is subject to modification or accommodation. The state statute is limitations is also subject to modification under the Acts!! YES YOU READ THAT RIGHT!!! If there are multiple people that reside in a household, for example, the public entity MUST accommodate the needs of the person with disabilities REGARDLESS of the presence of others in the household. The entity CANNOT rely on and/or expect others to HELP the person with disabilities. Every person with disabilities has a right to ready, full, equal, independent, and dignified access to all public services, activities and/or programs. Every person with disabilities has a right to EFFECTIVE communication. In order for communication to be effective, it must be timely, in an accessible format, and in such a way as to protect the privacy, independence, and dignity of the person/s with disabilities. (3) cases that elucidate this theory are: 1) Tom is incarcerated. His partner is not. Tom wishes to communicate with his partner via telephone in the jail. Tom asks for “accommodation” to speak to his partner who is hearing impaired. The jail denies his request stating that Tom is not disabled and thus does NOT qualify for accommodation and/or protections under the Act. WRONG! The jail must accommodate Tom due to his association with a person with disabilities! BOTH Tom and his partner are protected by the Acts and have standing to sue under the same. 2) Tina has a court hearing. Tina’s daughter chooses to attend the PUBLIC hearing. (As a separate matter, everyone has a right to attend a public hearing and/or event and the public entity MUST ACCOMMODATE everyone in attendance even if not an active participant and/or party.) Tina is hearing impaired. Tina AND/OR her daughter may request accommodation in the form of a QUALIFIED sign language interpreter if that’s the persons’ PREFERRED method of communication. They may make such request verbally to anyone associated with the court and at anytime. The request must be handled CONFIDENTIALLY. Such act is considered administrative in nature and/or function and NOT JUDICIAL, if handled by a judge and/or magistrate. BOTH Tina and her daughter are protected and have standing under the same Acts. Tina relies on her daughter for her daughter support, interpretation, and guidance. Tina’s daughter has a right to attend and to communicate receptively, in this instance, at a PUBLIC hearing. Her mother happens to be a party in this case, which is irrelevant, but which gives her mother standing and protections under the Acts. 3) Jack and Jill are partners. Jill is disabled. Jack is NOT. Jill has a service animal. Jill is in a (mental health or medical) hospital for care. The hospital denies Jill’s service animals’ entry to the facility. Jack is forced to travel back and forth to the hospital with the service animal. Jack and Jill, again, BOTH are guaranteed the protections under the Acts and BOTH have standing to sue for discrimination and damages under the same. No special words and/or methods are required to request accommodation. An accommodation may be request AT ANY TIME. VERY IMPORTANT!! Even AFTER an event, action and/or inaction. I’ll answer any questions on this to shorten my response. Drop your email and I’d be happy to email you and from there I’d be happy to share my google number to chat more freely. The FHA, Fair Housing Act and the ADA, BOTH apply to housing ownership, rental, and/or boarding environments. The FHA applies to ALL municipal, county, state and Federal agencies. What that essentially means is that EVERY code, ordinance, rule, policy, procedure, pattern, practice, custom act and/or omission by a public entity - is SUBJECT TO THESE LAWS. The public entity MUST accommodate the person/s with disabilities and/or their associates, modify its’ policies, ordinances, etc., and must follow specific mandates when doing so and/or when refusing to do so. Lastly, for now lol, every time a public entity applies for and receives Federal funds, it CERTIFIES, under PENALTY OR PERJURY, through a written ASSURANCE to the Federal Govt, that the requesting entity is in FULL COMPLIANCE with ALL FEDERAL STATUTES AND THAT THE REQUESTING ENTITY WILL USE THE FUNDS IN FULL COMPLIANCE WITH ALL FEDERAL STATUTES. Failure to do so is a violation of the FALSE CLAIMS ACT. ANYONE can sue any public entity for violating the FCA. The rewards for a successful lawsuit are a percentage of what the Federal Govt lent to the public entity over the entire period of any violation/s. The amount is quite substantial! One may bring a private lawsuit and/or may report it to the Federal Government and be entitled to a percentage of what the Federal Government recovers from the Feds lawsuit against the Public entity; a whistleblower lawsuit/claim. Again, the rewards are staggeringly HIGH! I encourage EVERYONE to look into this and to report incidents of noncompliance, discrimination, and False Claims to the Department of Justice, to the Department of Housing and Urban Development and to local governments. To report incidences locally one may do so ANONYMOUSLY, unless accommodations are sought personally. Let’s all work to expose their abuse, lawlessness and corruption. I encourage and implore everyone to reach out to your local government and to ask for their ADA transition plan and emergency preparedness plan in standard print format, digital audio format, accessible electronic document format, and braille format. The entity is PROHIBITED from charging a SURCHARGE to produce the documents in alternate formats. FYI, discriminatory, sentiments and statements are also unlawful and actionable, and most importantly, indefensible. If the statements on their face or discriminatory, NO CONTEXT is required, however, if the statements are questionably discriminatory on their face, context MAY be required to substantiate the discriminatory nature. Intent is irrelevant! Please share your results and experience with me by sending your email so that I can share the responses and create a centralized database to compare and contrast compliance and violations across this great nation.     There's a good podcast series called "Running from COPS". It highlights how the show COPS have made police more interested in getting that arrest and putting on a good show for the cameras. The officers don't get put on TV unless the make an arrest and make it TV worthy.

    When your expert claimed that our rights were given to us by the founding fathers, you are completely ignorant of the facts. Our rights are God given and the Bill of Rights was put in place to protect our rights. No one can give or take away those rights from a free people. However there is also the fact that the government at every level is incorporated, and that claiming citizenship puts you under those corporate statutes. So technically, you have no rights if you claim citizenship.

    I live 20 min from Bellingham and in washington state theres so many cars that have a loud Muffler in fact I had my Cadillac converter stolen and I had to drive around for like 6 months or more so I believe that cop was intentionally doing this to him

    I was a security in nathawash minnesota for five years and every night my car got called in by the police sometimes three time.. I always got followed home with high beems on right behind me.. Got pulled over.. I was called in like 2000 times.. I am the most profiled native in american.. I complained and people got mad and the sheriff told the cops to leave me alone.. And i never got a diving ticket in my lifetime..none.. I quit that job because of how i was treated..

    Here is the real problem. A citizen can be 100% right. But unless he has a lot of money and doesn't mind sitting in a cage for god knows how long. He has no choice but to comply.     The U.S. Supreme Court opened the door for police to stop, arrest and search citizens without reasonable suspicion or probable cause. [In a 5-3 ruling in Utah v. Strieff] Justice Sonia Sotomayor blasted the court for holding “that the discovery of a warrant for [as little as] an unpaid parking ticket will forgive a police officer’s violation of your Fourth Amendment rights.” Sotomayor further warned, “[t]his case allows the police to stop you on the street, demand your identification, and check it for outstanding traffic warrants-even if you are doing nothing wrong… So long as the target is one of the many millions of people in this country with an outstanding arrest warrant, anything the officer finds in a search is fair game for use in a criminal prosecution. The officer’s incentive to violate the Constitution thus increases: From here on, he sees potential advantage in stopping individuals without reasonable suspicion-exactly the temptation the exclusionary rule is supposed to remove.” Sotomayor wrote that the case "implies that you are not a citizen of a democracy but the subject of a carceral state, just waiting to be cataloged" and that unlawful stops "corrode all our civil liberties". Her dissent was called "ringing", citing "a canon for modern critiques of mass incarceration" in the prison for profit pipeline. Justice Elena Kagan also wrote a dissenting opinion, in which Justice Ginsburg joined in full. Kagan argued that the majority's ruling "creates unfortunate incentives for the police".[13] She explained: "So long as the target is one of the many millions of people in this country with an outstanding arrest warrant, anything the officer finds in a search is fair game for use in a criminal prosecution. The officer's incentive to violate the Constitution thus increases: From here on, he sees potential advantage in stopping individuals without reasonable suspicion-exactly the temptation the exclusionary rule is supposed to remove. Because the majority thus places Fourth Amendment protections at risk, I respectfully dissent." At issue 'prime factor' in *this case* is the uncertainty about “lawful orders” and civilians’ rights during police encounters - a pretextual 'fishing expedition' to ID for warrants. The police systemic controversy of 'unlawful orders' is what prompted legal scholar Orin Kerr to write his now famous opinion, "Sandra Bland and the 'lawful order' problem". He wrote, "Neither state laws nor federal regulations define the term “lawful order” even though it is a crime to disobey such a command. But what they do define is that the public should know the law. If an officer walks up to you and gives you an order, you’re “presumed” to immediately know every area of state and federal law. And on top of that, you’re presumed to know all the facts known to the officer that the officer won’t tell you. It begs the question, "isn’t a law punishing me for failure to obey an unlawful order unconstitutionally vague?" Too many cops attempt to exert dominance using the erroneous doctrine in 'color of law', a mere semblance of legal right; something done with the apparent authority of law but actually in contravention of law, where none exists. [Section 1983 lawsuits, 42 U.S.C. § 1983]. Unlawful demands are a common denominator to systemic misconduct by police that often escalates into unreasonable use of force incidents. At some point the courts will have to deal with the 'unlawful order problem' that's systemic in the institution of law enforcement. Retaliatory arrests ruin lives when police ego operates by the idiom, "You may beat the rap, but not the ride". Compliance to unlawful orders is no guarantee and often leads to spending the night in jail ruining innocent lives with malicious prosecution 'out of principle' of cops ego. In fact, "We lock up a higher percentage of our people than any other nation on earth." [Madar, professor of law at NYU.] In the 1960s, courts began to limit our right to resist an unlawful arrest, apparently influenced by Warner and by the Model Penal Code, which had eliminated the right on two grounds. First, there were better alternative means of resolving the issue i.e. - court. Second, resistance would likely result in greater injury to the citizen without preventing the arrest. Keep in mind this was before the U.S. Supreme Court created the qualified immunity doctrine out of thin air in Pierson v. Ray (1967), a case litigated during the height of the civil rights movement - severely limiting those legal grounds. SCOTUS made "alternative means of resolving" police misconduct through the court an even higher bar to achieve. Unfortunately, our legal system works only to correct wrongs after they have happened. There is no legal mechanism for prevention. The majority of present day court opinions follow this case law example: “simply stated, the law recognizes that liberty can be restored through legal processes but life or limb cannot be repaired in a courtroom. And so it holds that the reason for outlawing resistance to an unlawful arrest and requiring disputes to be resolved in the courts has no controlling application on the right to resist an officers' excessive force.” On the other hand, law also recognizes qualified immunity for police which exempts them from responsibility for poor decisions and misconduct. During recent argument in a similar case heard before the (NJ) Supreme Court the following exchange took place as reported in the press. The defense attorney was quoted as saying, "a person has a public duty to refuse to obey an illegal police order." Chief Justice Joseph Weintraub's answer was, "You'd have anarchy if you didn't have order." To this the defense attorney replied, "It's a police state otherwise."

    "Show me your papers" was once reasonable ground until the duplicity was revealed in a final solution. In a free society we must be vigilant against this culture of authoritarian susceptibility. This is alarmingly reminiscent of another account of how average middle-aged working-class men became cold-blooded order followers for Germany. In a disturbing similarity the book 'Ordinary Men' the author warns us how average people can succumb to the pressures of a group setting inside a corp d'esprit of a budding police state and commit violent acts and even atrocities they would never do of their own volition. Essentially lays claim that peer group 'cultural' pressure can lead seemingly normal men to commit the most heinous of crimes. The level of detail in the indictments and interrogations of ex-Nazis was chilling, especially because it revealed just how ordinary the men who perpetrated extreme acts of violence evidently were. This inspired Browning, a historian to write 'Ordinary Men' using the testimonies of more than 125 policemen from Reserve Police Battalion 101 (RPB 101). 'We the people' did not authorise police to act and dress indiscernible from occupied combat soldiers - licensed to act without restraint - imposing martial law and suspending habeas corpus. History has amply demonstrated where this will end up ..

    Exclusionary rule aside, while the courts ignore a law that prohibits the use of illegally obtained evidence in a criminal trial, they also ignore obvious exculpatory evidence. These pretextual stops zero in on 'fishing' for crimes, even going as far as manufacturing narratives of crime for malicious prosecution. Far too much discretionary power is being welded under guise of authority. We know this from the 'Milgram Experiment' where just 'over 60% of research subjects would execute orders to k*ll or injure another human being if the order came from someone of authority, someone with a lab coat, uniform or title. "That the whole experiment was designed to see if ordinary Americans would obey immoral orders, as many Germans had done during the Nazi period." Holocaust survivor & psychologist Ervin Staub pioneered active bystander training to limit violence between police and the public. Staub survived the Nazis, then lived a decade under communism before becoming professor emeritus of psychology at the University of Massachusetts at Amherst. He spent decades studying violence, genocide and bystander activism around the world and back at home in the United States. He has written a shelf of books which expose emerging police states that allow mass atrocities, both past and present. Auschwitz survivor Sonia Klein warned "hate and silence can lead to murder. And I hope the people realize that sometimes history has a way of repeating itself." Holocaust survivor Vera Sharav is one of the most outspoken alarmists of these ominous parallels. She said in a recent speech, "If we are to avert another Holocaust, we must identify ominous current parallels before they poison the fabric of society .. I came to Nuremberg to provide historical context to the current global threat confronting our civilization. These past two and a half years have been especially stressful, as painful memories were rekindled." (75th Anniversary Event of the Nuremberg Code in Nuremberg, Germany, on August 20, 2022).

    Taya The important thing to me was that the Neighbour approached police and gave a reference for the guy and cops just blew him off. He made 2 separate statements. ok He was probably his buddy but with policing like it is, purposely putting yourself in the line of fire is still a pretty impressive Reference. We shouldn't have to be afraid to monitor police / Gov actions. But deep in our hearts where we hardly dare to look we All are.

    Usually providing a supervisor upon request is in the police stations policy. Policy only applies to those who have signed the agreement. If cops can't follow their own policy how can they follow and uphold laws.

    They are hoping they have warrants, and in return, it's an arrest and a win for their bottom line. Most murders aren't solved because it's hard to close cases without the help of citizens, so the easiest way to give citations, arrests, and demand IDs for fishing are with traffic stops. Smh

    Cops are indoctrinated to believe that if they run everyone's name through their system, they will get murderous criminals off the street. The real reason is to allow government to eventually track every person in the country through a lack of anonymity. It's a requirement to successfully implement electronic currency as well as a social credit system to control income and spending. Cops are merely useful idiots in this situation.

    If you are operating a vehicle and have been lawfully pulled over then you have to ID! This was an unlawful stop and is shown in that because the officer didn't see anything that he wrote the tickets for!

    They don't care, they've already decided all police are evil and therefore they all trample on our rights. We'll ignore the fact that this traffic stop was ENTIRELY reasonable and legal and that the driver failed to ID... They like to ignore what's right in front of them lol
