Cop Tries to Harass Law Scholar, Ends Up Humiliated

The incident in question unfolded in a memorial park and adjacent areas, including a police department parking lot. The journalist, equipped with a camera, was documenting the surroundings when his actions elicited police attention and subsequent confrontation.
Central to the dispute is the "plain view doctrine," a principle in U.S. law that allows law enforcement officers to seize evidence and contraband that are clearly visible from a place where they have a right to be. However, the application of this doctrine to citizens, particularly journalists, hinges on different legal nuances. The First Amendment of the U.S. Constitution broadly protects the right to gather information about what public officials do on public property, underpinning a fundamental principle that the government may not prohibit the public recording of public events.
The journalist argued that filming in public places, where no explicit expectation of privacy exists, is legally permissible. This perspective aligns with numerous precedents, such as Glik v. Cunniffe, where courts have upheld the right to film government officials, including police officers, in public settings. The journalist's refusal to stop filming or provide identification stems from these rights, emphasizing a citizen's legal entitlement to observe and record public activities.
The responding officer's approach focused on the perceived privacy violations, particularly around personal vehicles and spaces within the public view. This concern, while valid in protecting individual privacy, encounters legal challenges when balanced against First Amendment rights. The officer’s insistence on curtailing the journalist's activities, without clear legal grounds or an immediate threat to public safety, illustrates the ongoing tension between police responsibilities and civil liberties.
The incident illustrates broader constitutional debates. The Fourth Amendment protects against unreasonable searches and seizures, yet it also intersects with public rights under the First Amendment. The officer's request for identification and cessation of filming, without clear probable cause or immediate threat, potentially encroaches on protections against unreasonable government interference.
Key legal precedents affirm that public spaces offer limited scopes of privacy. The Supreme Court has consistently ruled that actions observed in plain view, in public places, do not carry the same privacy protections as those in secluded settings.

The guy visibly and obviously holding a camera is the big threat with security cameras everywhere, the cops have cameras, every phone is a camera let alone the hidden and micro camera’s available and people think they have a expectation of privacy in public, you would think by now every cop would have had some training on auditors and their rights.

These Bristol police officers do indeed know the law very well…their problem is that they don’t agree with the limitations the law places on them. They are stupid in that they don’t expect ordinary citizens to know when they are lying or stretching their authority beyond allowed limits. The videographer’s effort to educate them or carry on a meaningful conversation is commendable.

It should be a disciplinary offence for a cop to leave his computer screen visible if he exits the vehicle. We all know that the Chiefs are so weak that they don't enforce any discipline in the their ranks.

Instead off giving these cops nice shiny cars that they can/will park in no parking zones for a non-emergency call, maybe they should be skipping the donuts and walking around in the PUBLIC areas for three reasons 1 to loose some of that cop fat , two to work with the public to close the gap between the public and police and three to learn the laws that they are trusted to uphold. I am so tired of seeing over weight and disrespectful Police thugs pushing law abiding citizens around because THEY GOT A CALL. WTF???
