    I have a feeling that your "I'll exchange information" tactic is going to go all the way to the Supreme Court one day and it will be a landmark ruling that will forever change police/citizen interactions just like Miranda V. Arizona. It will be a pivotal day in American jurisprudence when Travis stands before the Justices with the truth and a public defender.

    Mr. Giggles, I believe you are mistaken. A detainment requires reasonable suspicion of a crime, absent that it is unlawful to detain. The reason police often say “you are detained, not arrested” is because they know probable cause is required for an arrest. They either know that or are just stupidly repeating what they have been told to say and they have no knowledge of the law. They want that detainment so they can find or fabricate evidence for probable cause of a crime.

    this reminds me of when we protested at Mall of America for Buy Nothing Day! against young females in forced slave-wage labor making all those fancy clothes, etc. We had six cop cars for six protesters and then they slashed our one car tires. So we took the bus home. hahahaha.

    Both. As an officer, he's always acting as an officer if he's interacting with someone due to a possible crime. Even if he's in plain clothes, off-duty, at a picnic with his wife and kids. He's required to identify himself as such the moment he makes contact with someone. Because of this it would be considered deceptive to wear a generic security uniform. However, in many states civilian attire is fine as long as he has a badge visible and verbally identifies himself upon contact vs it being requested. The uniform prevents any issues with the question of, "at what point did he identify himself".

    Heath T what law are you referring to? off duty police don’t have to identify themselves, there’s no law that says so. it’s usually the department’s policy that an officer has to identify themselves.

    So if the cop was to abuse or shoot Travis, would the security company or the police department be liable? That is why cops should not be allowed to work a side job if they are in uniform. Despite the fact that the department will say that since the cop was off duty, it’s the security’s liability, but if the off duty cop used his taser, baton, pepper spray, or gun those are department issued. In fact if it was just a security uniform the average person would just walk away, but because it’s a police department issued uniform, we believe we can’t just walk away. But is it even a LAWFUL DETAINMENT if the cops off duty? Even to look at it in a petty way; say the cop drops his radio and breaks it. It’s a department issued radio so needs replacing. So the taxpayers pay to replace it. Why would the taxpayers SUBSIDIZE this security company? Does this security company have the necessary permits to have armed security? Or is this a workaround, skipping the need for armed permits by hiring off duty cops? And while this well paid with tax dollars officer is working a side job, he is also taking the job away from a regular security guard. How can a regular security guard compete when the cop is able to offer all these taxpayer funded perks to the security company that a regular security guard wouldn’t be able to provide?

    First Amendment Auditor sentenced to 30 days in jail after resisting arrest charges APRIL 12, 2022 / NPJ After several continuances, the trial of Travis Heinze commenced on April 11 at 9am in front of Judge Robert Owsley. Heinze, whose application didn’t qualify for a public defender, represented himself regarding his actions on Jan. 22 at the Natchitoches Parish Library. Natchitoches Police officers responded to a call from concerned library staff reporting a patron who was behaving bizarrely. This involved carrying multiple bulky bags into the building, setting up multiple cameras for recording purposes, trying to access areas restricted to the public, and pulling on door handles to areas that are off limits. When officers made contact with the suspect he refused to give his name or provide them with an ID. Heinze was taken into custody for resisting arrest and brought to the corrections center where he bonded out. After a lengthy trial with a long list of questions for seven witnesses, Judge Owsley weighed the evidence.     Runyan should retire, he's way over due! The way Runyan acts, he is the type that would plant evidence for a conviction, all his cases over the years needs to be re opened and re-examined by the DA

    Kan. Stat. Ann. §22-2402(1) ... If the police have no reasonable suspicion that crime was, has been, or is about to be committed ... the police have NO legal grounds to demand you identify. The police must have evidence that you committed a crime BEFORE they can demand identification and only then can failure to identify become a secondary offence. And if they do NOT charge you with the INITIAL/PRIMARY crime then they cannot charge you with any secondary offence.

    @@zed9955 ... There are no laws concerning 'Possible Stalking' ... and actual 'Stalking' requires prolonged and repeated occurrences. All these officers had was suspicious behavior (at best) and not a shred of evidence a crime had been committed, was in the process of being committed, or was about to be committed therefore they had no legal grounds for requiring ID. There MUST be an initial crime for which one is being arrested for before one is required to ID.

    Travis, my worst experience was in Park City, Kansas. You should cover them. They're northeast of Wichita. For the most part, Wichita and all the subdivisions are pretty down to earth and calm and collected.

    Is he working as a public servant or a private security? I thought when he got out of his vehicle he said he was in a private capacity as security. Why would ANYONE have to give personal identifying info to private security?

    You are detained. Ask what crime is afoot. Terry v. Ohio requires that "crime be afoot" to detain. There was no crime afoot. The officer did an illegal detainment.

    Travis understands that he is detained. Travis is well aware of Terry v. Ohio. Asking for 'what crime' is not his thing nor do the officers have to explain what their RAS is, just as long as they have it (which they don't). The approach Travis takes in every encounter is genius, refreshing and usually goes straight over the officers heads.

    A sworn Officer of the Law in the United States is what is referred to as a U.S. Peace Officer..His or Her Authority extends to every square inch of this country whether on or off duty.

    You didn’t make the call and they want your side of the story before even finding out her side of the story or even if there would be a reason to detain you. If arriving cops can’t determine first if a detainment is necessary there is no reason to hem anyone up.

    He just threatened you with arrest if you exercise your 5th amendment. And failure to I'd is a secondary offence. They first have to prove for sure that you commited a crime. He needs to learn the law. He's the one that's way out there.... If they arrest you, They are violating your rights. Can you say law suit AGAIN....

    How come cops can't see this is the nicest guy they are ever going to meet. Within a minute or two it does dawn on a few but most are too blinkered like Runyan. He may be a nice man but here comes over as a fool who judges everyone instantly and likes to order and demand and threaten all the time. Is this to help the public respect Police more or less.

    I've never heard of the "wand" deal but it makes sense. In the old days, night watchman had keys to record their position at certain points in the building which recorded the time, mechanically I assume.
