Officer Nadeau of Baxter Springs, KS tells me to leave his city

He's investigating a vehicle that he has already run the tag and thru c.j.i.s., and knows full well that you are taking a cat nap, but this is becoming the norm, it's ok if you pitch a tent on the sidewalk in California, but if fortunate enough to have a vehicle then becomes an issue with law enforcement because " they don't know who you are. " What a crock of Schitt !

Exactly. He couldn't fight the man cause he knew his rights, so he threatened him with arrest to get his way. Bunch of tyrants. Dudes sitting in his car, did nothing wrong. No suspicion of a crime, wasn't causing a disturbance. Yet this pig decided he wanted to act tough and bully someone around cause he was bored at 11:30 at night. When he didn't get his way he threatened him. I personally would of told him if he unlawfully arrested me I would sue him and he would have no qualified immunity to hide behind. He needs to go. This guy needs to fired immediately. I find it very hard to believe nobody has made a complaint on him in the 20+ years he's worked as a tyrant.

This tyrant officer with 20 years on the job just proved that a man who chooses to live in his car knows more about the law than he does. Shame on Officer Nadeau and the Baxter Springs Kansas police department for treating travelers and visitors to their town like this. If he knew the names of the suspected robbers and one matched the car's tag, you'd have seen a different response. He is a liar, but then again police are allowed to lie to you as part of their job.

You shine a light on the despicable way police and other public servants treat citizens just because you look different, talk different, and live your life differently from others. YOU WERE SUSPECTED OF BEING SUSPICIOUS. "Reasonable suspicion exists if, under the totality of the circumstances, the officer has specific facts that would lead a reasonable officer to suspect illicit activity". United States v. Winters, 782 F.3d 289, 298 (6th Cir. 2015). This officer clearly cannot comprehend the difference between suspicious activity (a feeling) and reasonable articulable suspicion (of a crime). He doesn't know that he can't force ID under threat of arrest because he can't articulate what crime he suspects is being committed. The police might be suspicious of you but if they cannot articulate a crime that they suspect you have, are or about to commit, they have no reason to detain you. Without RAS of a crime that would not be a Terry stop, it would just be a 4th Amendment rights violation Palmer V. City Of Euclid 1971, Brown V. Texas, 443 U.S. 47 (1979)

In this way the burden of proof and the liability remains squarely on the claimant which is the cop. please learn this brothers and sisters.

At least the citizen was given two additional minutes to leave after the failed exchange. However, as I watch the situation unfolded, I couldn't help but to think that If he were a Black man, he would have been snatched out of the car, tased, handcuffed or worst. Whether one wants to acknowledge it or not, this is another example of the workings of white privilege. I'm glad the citizen stood on his square, did not relinquish his rights, and was okay in the end.

You have to say it out loud a few times and hear yourself before you'll get it down pat but uh, Police Contact Script!! You can still ask all the questions you want to ask (if he hangs around long enough), just stick to the outline. AND PRACTICE...EVERY TIME YOU THINK ABOUT A COP, SAY IT!! 1. Pardon me.!? REPEAT OFTEN, ADD What's your name and badge number? 2. What's the emergency and how can I help? 3. Am I under arrest/being detained/free to go? 4. If I give you ANYTHING (including my name, ID, consent, info), will you use it to further a legal charge against me? YES = NO GIVE. NO = NO GIVE. 5. Aside from your willingness to use violence, what facts or evidence are you relying on to prove (your opinion is true) that THAT LAW applies to me? kzread.info/dash/bejne/m5d1pJRtd93aXcY.html (compact) kzread.info/dash/bejne/hXqdza-tlsaeipc.html (extended *new) See it work and not work @ CopBlock Hot Springs. Cops always say theyve had several robberies tonight or lately. They did that to my brother and forced him to empty his pockets while pointing a tazer at him while walking home from the bar on the piblic sidewalk. He had some Marijuana in his pocket. Lucky a buddy was with him. We went and filed a complaint with the officer and filed for freedom of information act for the reported robberies in the area. Needless to say, there were no robberies, the cop got fired and my brothers Marijuana charge was dropped because of illegal search and seizure
