    I'm a recent law school graduate with a previous degree in criminology. I was sent Ben's "legal analysis" of the verdict and I prepared to fact check it. I barely got through two minutes before it became clear that he actually just doesn't know what he's talking about. Here's as far as I got: Firstly, it doesn't make sense to take particular issue with the third degree murder charge more than the second degree murder charge. Third degree is the lesser degree, meaning there's a lesser intent requirement to fulfill. If third degree is absurd on its face, then second degree would be plainly unconscionable. His statement doesn't make sense. Secondly, depraved heart/mind murder does NOT mean "intent to kill others but you end up killing one person". There is no requirement to prove intent to kill others. In fact, it specifically says in the statute itself that intent to kill others is irrelevant. “Depraved mind” refers to an indifference to human life. The statute reads as follows (emphasis added): 609.195 MURDER IN THE THIRD DEGREE. (a) Whoever, WITHOUT INTENT TO EFFECT THE DEATH OF ANY PERSON, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree and may be sentenced to imprisonment for not more than 25 years. www.revisor.mn.gov/statutes/cite/609.195 Thirdly, while correct that the prosecution needed to prove a felony assault occurred as an element of the second degree murder charge, he mischaracterizes the element of causation. The defendant's act need not be the main or sole cause of death, it need only to have been a substantial causal factor as described in the jury instructions on p 4 www.mncourts.gov/mncourtsgov/media/High-Profile-Cases/27-CR-20-12646/JuryInstructions04192021.pdf Lastly, he says that intent is required for the murder charges. As you can see from the amended complaint filed from the state www.mncourts.gov/mncourtsgov/media/High-Profile-Cases/27-CR-20-12646/AmendedComplaint06032020.pdf as well as the official verdict www.mncourts.gov/mncourtsgov/media/High-Profile-Cases/27-CR-20-12646/Verdict104212021.pdf Chauvin was charged with second degree UNINTENTIONAL murder. It's right there in the name so I'm unsure of how he missed that one. As I previously noted, third degree murder also does not have a requirement for intent to cause death. This all came within three minutes of him talking so I just gave up at that point

There are literally accounts of him watching the insurrection and enjoying it like it was a sports game on TV. His administration told security to allow the mob through the gates and Trump refused to send in assistance until HOURS after the mob began attacking. You're just a whipped child who would rather defend someone who doesn't care about you than think critically for 10 seconds.

    The defense basically amounted to "Well, actually Your Honor, he was already sick and dying when he was sitting down in the car so we decided to just speed things along by squashing him into the cement but Mr. Chauvin didn't actually kill him...he just helped move things along in that direction."

    My ultra Trumpist mother-in-law was just "shocked" about the verdict on Chauvin. It's so crazy. My MIL actually cried when she first watched the George Floyd murder video. For just a little while she had the same horrified reaction as any normal human being. Then she listened to a bunch of bullshit news about the case and talked to her like minded friends. She now has every excuse in the world for cops and Chauvin. So frustrating.

    @@Saturn_Rising I don't think it is so much that she believes Chauvin is "innocent." She believes George Floyd was guilty. She believes George Floyd's drug use and the fact that he was a "criminal" made Chauvin's use of force less inappropriate. She thought the defense actually had a compelling case and that the jury would take forever deliberating and that Chauvin would at most be convicted with the only the lowest of the charges at most. What is most upsetting is if my mother-in-law was there to witness the crime or knew George Floyd personally I know she would feel different. I have never seen her be cruel or racist to anybody in person ever. She treats every person she meets with respect and dignity. She has all of these racist/ right wing opinions that dissolve the moment she actually interacts with someone from a minority group. We live in a state and city with almost no diversity (95% white.) My MIL reads these news stories and tragedies on Fox and she reads about POC from these other cities and states and it is like she can't connect the dots that these people are human beings too. She views any of her friends and acquaintances that are minorities as exceptions to the rule. They are the "good people" to her.

    I think conservatives are upset because someone got convicted of a crime that the prosecution didn’t actually prove he had committed. If the evidence had shown that Chauvin was guilty of either of the two murder charges most conservatives would be happy to have seen him convicted.

    Police officers are not doctors. When they arrive on scene to handle a situation with a supposed criminal suspect, they are not responsible for knowing the suspects medical records/conditions prior to apprehending them. In the case of George Floyd, the officers had no idea he ingested a "speedball" nor that he had a heart condition. It is absolutely ignorant to compare the case of George Floyd to an elderly man being shoved.

The medical examiner counted Mr. Floyd's breaths, and they were within normal range, suggesting that the amount of fentanyl in his system was to low to cause death. It's also not just one man. It was all three of them who contributed to his death, as Hasan points out. Also, also, why would there be signs of bruising? You do know that not all asphyxiation causes bruising, right? That's a TV trope.

Having your chest compressed, for instance, will allow you to get enough tidal volume (air moving in/out of lungs in each respiratory cycle) to speak, but not adequately oxygenate your tissues, including your brain.

Also I see another point by conservatives that "he used less force than he had to" which is extremely flawed. The technique he used is not taught by police and isn't a common restraint either. The guy had no good excuse to pull his gun out, so he went out of his way to choke him to death. Please just watch the video and maybe you'll recognize the fact that he couldn't breathe due to Chauvin's restraint. Besides the absolutely absurd take that he "could have used more force" when he choked a man to death, the idea that he had 3 times the amount of fentanyl in his system is a complete lie that has been spread by conservatives.

    Honestly, I'm very happy with the verdict but I can't help but be a bit disappointed in how short the deliberation was. For one, I strongly believe that a jury should go through all the evidence together and really deliberate. No matter how guilty someone is, they deserve careful deliberation. It's their whole life on the line. Secondly, the short deliberation time gives people that believe Chauvin is innocent more reason to think that the trial was unfair.

They probably had a pretty good idea of which way they were going to go by the time of closing arguments. Only thing they had to decide (and I suspect where the 10 hours of deliberation was spent) was on whether it met the requirements of 2nd degree murder.

    I was actually talking to one of my coworkers today about Ben’s argument. For a Harvard law grad he doesn’t know shit. In Minnesota there is no “depraved heart”. 3rd degree murder is “reckless disregard”

    Also how the hell can Shabibo not comprehend how a trial/jury system works? No way the jury can come up with something that fast because if they did evidentiary findings they'd take longer? This trials deliberation was going to be short af or long af. Jurors take notes and listen, and also pay attention to the details of the evidence as they get admitted. Once your get your instructions you go back and take a show of hands of guilty/not guilty. If all guilty then you proceed to talk about the charges. It's not hard. Also the State only had to prove that Chauvin helped cause Floyds death; they didn't have to pinpoint anything. This is why the defense was reaching far and wide trying to grab any whack ass thing out there. This is why so many people of color are locked up for 20+ years for having weed. "did they have weed on them?" yes "k lock them up" it's that simple and messed up.

    Partially correct. You have to basically blindly go about harming a group and then kill someone in that group. Such as driving a car into a crowd, throwing a brick off a freeway, etc. In the Case hear, Chauvin didn’t show any intent to harm a larger group of people; therefore, the charger wasn’t applicable to the case.

    "When was the last time a sitting resident weighed in on a jury's decision and used words like "fight" to incite violence" Idk, but Tucker sure didn't seem that concerned about a sitting president weighing in on allegations of election fraud before a legal case was even filed, or when that same individual used word like "fight" in a speech preceding the first time in centuries that the capitol had been breached

    If you actually watched either Crowder or Shapiro as I did, and watched the entirety of their streams, you would realize that both of them were by no means defending Chauvin. They even said that Chauvin deserves punishment. Their criticisms were on how the trial was handled. Next time, actually listen to what they say before creating a straw man about them.
