There was a time when I was meeting guys (to satisfy my parents) for an arranged marriage. Every time I told a guy I am financially very stable and independent, I don't shop much or spend much and don't dream of living in a bungalow, and do not expect them to take care of me or have a say in their finances, they were uncomfortable. I was even ok with them naming properties they hypothetically bought in the future in their mother's names. You seem to be the right person to explain this behavior since you seem to know me well. I'll support anyone who wants a prenup if they are upfront about it. Meaning all cards are out on the table before a wedding. Will help you decide if getting married is right or not.

Indian laws though intended to save the feminine but have now become the cause of marriages being broken as is evident from several court judgements which themselves say are false. So the cause of marriages being broken in one way is ironically the law itself. Unless the legislature builds in necessary checks and balances, the person in whose favour the law tilts becomes powerful and exploits the weak. So the woman who has these unbridled powers uses them unreasonably. Whereas if there were checks and balances then she would know that she is equally responsible in the marriage and she would lead a better life. Why should a person private parts matter outside of bedrooms and bathrooms in today's age when muscle power is almost become immaterial to earn ones daily bread and butter.

Yes but that too before any litigation filed by your spouse. If you do after a suit is filed against you it will be illegal as per section 52 of Transfer Of Property Act.

Regarding home loans it doesn't really matter who is paying if the asset is in the name of a second person the asset belongs to that(second )person.

@@rjarora If you form a trust, technical you don't own anything but trust does and you can make your parents trusties along with you so in case of any future liability you don't own anything so how can the court ask you to give a share of your property but still court may ask you to pay maintenance to your wife

Technically getting in a contract to deny maintenance is illegal due to contract being void however this contract wouldn't deny any support but make them oblighted to pay you the same support and thus shouldn't/mustn't be void?

All these are invalid. None of these will hold in court. Prenup is illegal in India. Period. Quasi-prenup or prenup is invalid. Just marry a foreigner, someone who's not an Indian citizen. If a women files a divorce case against you she is most likely to put a dowry case against you, put marriage cost, put forced to not work, torture and blackmail by inlaws and domestic violence as well not to mention tons of illogical allegation like you being a drunkard, negligent behavior etc all these can be put to rest or atleast be something of a shield against these baseless allegation if you have a prenup or a post nup.

For your question why have pre-nup. Because laws are biased. Even wife cheat, husband can't get out of marriage without paying. Why to live in insecurities. You are man still can't see anti men law!!!

I read a fb post where a loyal husband brought all the money and property and handed it over to her wife. He had complete trust in her and their marriage but the wife worried that in case of a divorce, she would be left empty handed with the child so she transferred all the assets to his brothers name to protect it in case of divorce. Now the brothers wife is filing for divorce and knows all about the asset transfer and wants 50% of the pie. Now the woman is crying and looking for help. She wanted to protect herself in case of divorce but never thought of this possibility where she would lose it all in someone elses divorce. She was so worried about the possibility of divorce that she probably brought a divorce on her marriage because of this worry. The moral of the story is that build trust and learn to compromise, that's how a strong marriage lasts, make a list of deal breakers and discuss before committing. Also statistically 1% Indians divorce which is the lowest in the world. You will not hear good stories of a lasting marriage for 20-30 years or how a married couple made so and so great stuff but you will surely listen about divorce cases and huge alimony because it makes us curious and gets more clicks on the internet. Do yourself a favour and consider that you will fall in the 99% of the married couple and stop worrying about prenup, its anyway not coming in India due to our social fabric and family oriented culture. Mohan is a male feminist so his opinion is worthless on this topic. And the 1% divorce statistic is a complete lie(seen only in rural "purane khayalat wale" areas) Divorce rates are as high as 30% in urban places like Delhi and Mumbai. Stop trying to misguide men into a devastating one sided legal contract which benefits the woman whe she breaks it. Maybe if these misandrist laws change and identify that these modern women are no damsels in distress. Also harsh punishment for adultery.
