I got laid off. I have i-140 approved (EB2) and my current H1B expires on Apr 20th, 2024. However - my former employer filed for a H1B extension on Feb 20th, 2024 and this should take some 1.5 to 2 months to complete. Since i am in hunt for the job market - do i only have time till Apr 20th? Or is my status still active? If yes, what is the duration? I am currently on my 2nd H1B term at this time (6th year) My drivers license expires on Apr 4th 2024, Can I still use my existing I-797 documents for the same?

Hi jing, I have a question. If I file my NIW i140 petition during OPT, if I am not selected the H1B in the future, can I still switch back to F1 to attend day1CPT school?

Great and very informative video, thank you Jing !! One question i have is, incase i am not laid off, but have an approved i140 from my employer. Do i need to wait for certain time period (like 6 months), before switching to another employer - if i want my priority date to be ported to the new employer?

You may want to leave your employer 6 months after I-140 approval since your employer could technically cancel the I-140 within 6 months. After 6 months, he can’t, the priority date will stay and to be claimed in your next I-140 filing.

Great video. My I-140 was approved in 2021. I got married after my i-140 was approved, Since I am Chinese and has a long waitting time/years before I can file I-485. Just woundering if I use add my wife to the approved I-140 and use her birthplace to lodge1-485 application now since she was born from a country with much later priority date (later then 2022). Thanks

Please let me know how to approach my employer A to not withrdraw my I-140 in near future. Thanks In Advance (TIA). best regards, Vin
