Hi! My priority date is Feb 3 2023 for I 140 and I 1485. My status here I94 ends in Dez 2 2024, after 7 years in L1. Do you think I will need to go out of the country to complete my application? It’s on premium, but the PD still in January 15th and lawyers are saying that might not move till October. If the visa bulletin move in mid September, Do you think I will have time enough to wait for adjustment of status until my I94 ends in dezember ? Thank you!!

I have B1/B2 Visa and my LC is under process - Once the LC is approved and submit the I-140 (still outside the US). When my PD is current so i can travel to USA on my B1/B2 Visa then file the I-485 ?

Should I file for premium processing? My PD is Feb 26, 2024 under EB1C from India

I sent my paperwork to Nebraska service center via USPS priority mail. They received it couple days later on June 17 2024 and I kid you not they printed out the reciept notices the very next day on the 18th and just 3days later the notices were in my mailbox. I guess now, as of July 2, am waiting for my biometrics appointment for my I-765.

I think for this you should contact an immigration attorney but from my understanding he/she will have to get a VISA and then apply for GC. Please confirm with attorney.

When was your fingerprinting? Also sometimes USCIS might just adjudicate your I485 so hopefully you will have news soon!

This happens when your Priority date has retrogressed. This means a VISA number is not available for you at the moment. Nothing to worry about. USCIS will start processing your case once you PD becomes current

I apply my asylee based I 485 on February 23, but still I don’t get any receipt latter, I don’t know why, my lawyer told me I will get it 2-4 weeks, but still not getting this, can you tell me why it delay?

It could be several reasons! One plausible reason could be the load of applications sorting. For some people it is taking around 6 weeks to get receipt.

Now it’s been 5 years waiting for my green card. I check online every time it just tell me my case still processing. What action should I take?

Dear Yared, If it’s been 5yrs since you filed your I486 then first to check is if your PD is current or not. Also you should contact your local congressman’s office for help.

Great question! If you are waiting for I485 adjustment then you will be status until your case been adjudicated. You should not travel unless you have your AP which is advance parole.

The Concurrent Filing “Estimated Time Until Case Decision” went up from 7 months to 10 months and this increase in processing time went up once before!… Any reason for this and what is the USCIS doing for all these months?… Is the file just sitting in a queue to be accepted and the Green Card mailed out because there’s a backlog or are they looking for reasons to reject the application?

I think the wholesome reason is the load. In 2023 based on estimates USCIS processed around a million cases. More the backlog higher the processing time!

What would happen to my Combo Card if my I-485 is "administratively closed" due to the unavailability of visas for 4th preference Special Immigration at the time of filing and fees refunded? Can I still use the Combo Card to travel abroad, or is it automatically cancelled?

Hey, my mother has entered USA on a visitor’s visa and her I-94 is valid till 04/22/2023. I have submitted an I-130 online for her and have got the I-130 receipt notice. I have mailed her I-485 application to USCIS which was delivered on March 15th. USCIS will issue me an I-485 Receipt notice once they start working on my mother’s I-485 application but that may take some time. My Question is, Will my mother be able to stay legally in USA after 04/22/2023 if she does not get the I-485 receipt notice till then. Thanks

Dear Mercy, if your PD is current with respect to visa bulletin then USCIS will adjudicate your case soon. It takes 5-8 months atleast to get the GC adjudication. All the best

The Dominican Republic submitted my fiance medical exam on a CD. USCIS rejected the application for this reason. They will not look at a CD and you have to do the exam again. Terrible, so make sure to get a paper copy in your packet.

Exactly! USCIS only accepts paper copies. In case of medical examination it has to be sealed as well!

Hi… my i 485 form says that i need to submit a sealed copy of marriage certificate which the immigration has to open. But i am unable to get that copy from the court or state capitol. They said that they don’t provide the sealed marriage certificate. I need it to prove that i got married within 90 days of coming to US. What should i do? From where i will get the sealed copy? We were never told to file a i485 we were told the greeen card will be sent in the mail after few weeks when my wife enters the US ! Her biometrics were done at the japanese empassy … before we came to the US , Its been a month since she has been in the US called USCIS and they told me to call Homeland security homeland security dont answer their phones

If you are in US then you can file I485 or AOS. If you are outside of US then you will have to go through consular processing. Address change can be done from USCIS website instructions

If you have B1/B2 VISA then you cannot file for I485 or Adjustment of Status until your EB-1 A or EB-2 NIW I-140 is approved. Also, you can come to US on a non immigrant VISA like H-1B to pursue your GC journey.

I think you can go back to UK and then file a NVC which is equivalent to i-485 when staying outside of US

Fact remains once you apply I-585 your valid B1/B2 visa stands cancelled. Logically it seems true isn't it

If your I-485 is in processing then you should not travel in and out of country until you are on h-1b or L-1
